Bequest for Legal Heirs Is Not Permissible in Islam

❀ Bequest to Legal Heirs is Not Permissible ❀

The Messenger of Allah ﷺ said:

"إن الله أعطى كل ذي حق حقه فلا وصية لوارث"

"Indeed, Allah has granted every rightful person their due, therefore it is not permissible to make a bequest in favor of a legal heir."

[Hasan: Sahih Abu Dawood: 2494, Kitab al-Wasaya: Chapter on Bequest for Heir, Abu Dawood: 2870, Darimi: 3128, Ahmad: 17004]

✔ Summary:
Islam strictly prohibits making a will (وصیت) in favor of those individuals who are already legal heirs (ورثاء) under Islamic inheritance law. The Prophet ﷺ clarified that since Allah has already designated shares for every heir, an additional bequest to them would be unjust and is therefore not valid.
