A Muḥrim Is Permitted to Eat Lawful Game

✿ Ḥadīth 251: Eating Game Meat by a Non-Muḥrim for Muḥrims​

Arabic Text:
عَنْ أَبِي قَتَادَةَ الْأَنْصَارِيِّ { أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَرَجَ حَاجًّا... }

Translation:
Abū Qatādah al-Anṣārī رضي الله عنه narrates that the Messenger of Allah ﷺ set out to perform Ḥajj, and people accompanied him. He directed a group of them, including Abū Qatādah, to follow the coast and meet him later. As they took the coastal path, everyone in the group entered into iḥrām except Abū Qatādah. While they were traveling, they saw a group of wild donkeys. Abū Qatādah attacked and struck one of the she-donkeys. They dismounted and ate from its meat. Then they began to wonder whether it was lawful for them, being in a state of iḥrām, to eat game meat. So they took the remaining meat and brought it to the Prophet ﷺ, and asked him about it. He said:
"Did any of you command him to hunt it or gesture toward it?"
They replied, "No."
He said, "Then eat what remains of its meat."

In another narration:
The Prophet ﷺ asked, “Do you have any of it with you?”
I replied, “Yes.” I handed him the foreleg, and he ate from it.

✦ Explanation of Terms:​

  • Ḥumr waḥsh: Plural of ḥimār waḥshī – wild donkeys.
  • Atān: Female donkey.
  • ʿAqara: He wounded – specifically, he severed the legs (hind limbs).

✦ Commentary:​

This ḥadīth illustrates that if a person who is not in iḥrām hunts an animal independently—without any directive or help from a muḥrim (pilgrim in iḥrām)—then the game is lawful for those in iḥrām to consume. As long as there is no direct or indirect involvement of the muḥrim in the act of hunting, it remains permissible, as seen in the narration.

✿ Ḥadīth 252: Refusal to Accept Game Hunted for the Muḥrim​

Arabic Text:
عَنْ الصَّعْبِ بْنِ جَثَّامَةَ اللَّيْثِيِّ { أَنَّهُ أَهْدَى إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حِمَارًا وَحْشِيًّا... }

Translation:
Sayyidunā Ṣaʿb ibn Jaththāmah al-Laythī رضي الله عنه narrates that he presented a wild donkey to the Prophet ﷺ as a gift while he was at al-Abwāʾ or Waddān. The Prophet ﷺ returned it. Ṣaʿb says that when he saw sadness on his face, the Prophet ﷺ clarified:
“We returned it only because we are in the state of iḥrām.”

In another narration from Muslim: He gifted the leg of a wild donkey. In other versions: its side or its hindquarters.

✦ Commentary:​

In this ḥadīth, the Prophet ﷺ explained why he declined the gift of the wild donkey: he was in the state of iḥrām and assumed that the animal may have been hunted specifically for him. Since it is impermissible for a muḥrim to eat from game hunted for him, he did not accept it. This shows the high level of caution and adherence to the rules of ḥajj by the Prophet ﷺ.

Ṣaʿb ibn Jaththāmah رضي الله عنه
He was a Madinan Companion. He narrated sixteen aḥādīth from the Prophet ﷺ. He passed away during the caliphate of Abū Bakr in Kūfah.
