And when the relatives and the orphans and Al-Masâkîn (the poor) are present at the time of division, give them out of the property, and speak to them words of kindness and justice.

(Ayah 8) That is, the heirs should give some portion of the inherited wealth as charity and alms to those relatives, orphans, and needy who are present in the family and arrive at the time of distribution. And if those people are overly eager, then "speak to them kindly," meaning apologize that this is the property of the heirs, and you have no right to it. Some scholars say that this command was before the "obligatory shares," that is, before the shares of the heirs were fixed. Now Allah has given every rightful person his due, so now this giving is not obligatory; now charity and alms can only be given according to the deceased's will. However, in Bukhari, it is narrated from Ibn Abbas (may Allah be pleased with them) that this verse is definitive, not abrogated, and the heirs are commanded to show them kindness and generosity with those relatives who have no share in the inheritance when they come at the time of distribution.
