وَكَيْفَ يُحَكِّمُونَكَ وَعِندَهُمُ ٱلتَّوْرَىٰةُ فِيهَا حُكْمُ ٱللَّهِ ثُمَّ يَتَوَلَّوْنَ مِنۢ بَعْدِ ذَٰلِكَ ۚ وَمَآ أُو۟لَـٰٓئِكَ بِٱلْمُؤْمِنِينَ ﴿43﴾
But how do they come to you for decision while they have the Taurât (Torah), in which is the (plain) Decision of Allâh; yet even after that, they turn away. For they are not (really) believers.
وَكَيْفَ wakayfa But how can
يُحَكِّمُونَكَ yuḥakkimūnaka they appoint you a judge
وَعِندَهُمُ waʿindahumu while they (have) with them
ٱلتَّوْرَىٰةُ l-tawrātu the Taurat
فِيهَا fīhā in it
حُكْمُ ḥuk'mu (is the) Command
ٱللَّهِ l-lahi (of) Allah
ثُمَّ thumma Then
يَتَوَلَّوْنَ yatawallawna they turn away
مِنۢ min from
بَعْدِ baʿdi after
ذَٰلِكَ ۚ dhālika that
وَمَآ wamā and not
أُو۟لَـٰٓئِكَ ulāika those
بِٱلْمُؤْمِنِينَ bil-mu'minīna (are) the believers

(Ayah 43)➊ {وَ كَيْفَ يُحَكِّمُوْنَكَ:} Here, their ignorance and stubbornness are described, meaning they know that the case they are bringing to you has its verdict present in the Torah, yet they bring the case to you hoping that perhaps your decision will be lighter than that of the Torah. However, when your decision is the same as that of the Torah, they refuse to accept it, which proves that they neither believe in the Torah nor in you. In reality, they are slaves to their own interests, and their very purpose in life is to obtain worldly benefits. (Kabir)
{وَ عِنْدَهُمُ التَّوْرٰىةُ فِيْهَا حُكْمُ اللّٰهِ:} In this verse, Allah Almighty has declared the verdict of stoning present in the Torah as Allah’s own decision. Those who deny stoning, even though many Sahih ahadith also refute them, this verse is the strongest and most solid proof that the Qur’an has declared the command of stoning in the Torah as Allah’s command. Then neither has it been refuted nor declared abrogated, rather Allah’s command has been enforced upon both Jews and Muslims. It is thus evident that the mention of stoning is also present in the Qur’an.

43. But how can they make you a judge when they have the Torah, in which is Allah’s command? Yet they turn away from it. In fact, these people do not truly believe [79].

[79] That is, on one hand, they consider youﷺ a false prophet and yet they bring their disputes to you for judgment. And on the other hand, there is the Torah, which they do consider to be the true Book of Allah, but they do not follow its rulings either. What greater proof of their disbelief can there be than this?
