وَلْيَخْشَ ٱلَّذِينَ لَوْ تَرَكُوا۟ مِنْ خَلْفِهِمْ ذُرِّيَّةً ضِعَـٰفًا خَافُوا۟ عَلَيْهِمْ فَلْيَتَّقُوا۟ ٱللَّهَ وَلْيَقُولُوا۟ قَوْلًا سَدِيدًا ﴿9﴾
And let those (executors and guardians) have the same fear in their minds as they would have for their own, if they had left weak offspring behind. So let them fear Allâh and speak right words.
وَلْيَخْشَ walyakhsha And let fear
ٱلَّذِينَ alladhīna those who

تَرَكُوا۟ tarakū they left
مِنْ min from
خَلْفِهِمْ khalfihim behind
ذُرِّيَّةًۭ dhurriyyatan offspring

(Ayah 9) {وَ لْيَخْشَ الَّذِيْنَ لَوْ تَرَكُوْا … :} This command is for those who execute the will of the deceased and also for those who are appointed as guardians and executors of orphans. All of them are being instructed that, fearing Allah, they should take care of the interests of the deceased’s children and orphans in the same way as they would wish their own young and helpless children’s interests to be taken care of after their death. Therefore, they should treat the orphans better and provide them with the best possible education and upbringing. This verse seems more appropriately related to the guardians of orphans, because the warning that follows regarding those who wrong the orphans is more relevant to the guardians. However, ordinary Muslims are also commanded to show special kindness and good treatment towards orphans.

9. 1. According to some, its addressees are the executors (those to whom a will is made). They are being advised that those orphans under their care should be treated in the same way as they would like their own children to be treated after their death. According to others, its addressees are the general people, that they should treat orphans and other small children well. It is their responsibility to make the dying person understand good things so that he does not fall short in the rights of Allah nor in the rights of mankind, and in the will, he should keep both these matters in view. If he is well-off, then he should definitely make a will for one third of his wealth in favor of those among his close relatives who are poor and deserving of help, or make a will to spend it on some religious purpose or institution so that this wealth becomes provision for his Hereafter. And if he is not well-off, then he should be prevented from making a will for one third of his wealth so that his family does not later face poverty and need. Similarly, if someone wants to deprive his heirs, he should be stopped from this and it should be considered that if his children are faced with poverty and hunger, what would he feel at the thought of it. 9. People should fear that if they themselves were to leave behind weak children, how anxious they would be for them. So let them fear Allah and speak words that are appropriate and straightforward.

[15] That is, if you were to die leaving behind young children, you would certainly be concerned that after you, these children should be treated well. In the same way, those orphans who are under your care at this time, treat them likewise out of fear of Allah. And do not say anything that would break the hearts of the orphans. Whatever you say should be for their good. The way orphans and widows were treated in that era is clearly illustrated by the following hadith:

The Share of Wife and Children in Inheritance:

Sayyiduna Jabir ؓ says, "The wife of Sa'd bin Rabi' ؓ came to the Messenger of Allah ﷺ along with her two daughters and said: 'These are the daughters of Sa'd bin Rabi' ؓ. Their father was martyred in the Battle of Uhud. Their uncle (Sa'd bin Rabi's brother) has taken possession of all of Sa'd's estate and has left nothing for them. And without wealth, they cannot get married.' The Prophet ﷺ said: 'Allah Himself will decide in this matter.' Then, when the verses of inheritance were revealed, the Messenger of Allah ﷺ called Sa'd's brother and said: 'Give two-thirds of Sa'd's estate to his daughters, and one-eighth to their mother. Whatever remains (i.e., only 5 out of 24 shares) is yours.'" [ترمذی، ابواب الفرائض]
