So, when they despaired of him, they held a conference in private. The eldest among them said: "Know you not that your father did take an oath from you in Allâh’s Name, and before this you did fail in your duty with Yûsuf (Joseph)? Therefore I will not leave this land until my father permits me, or Allâh decides my case (by releasing Benjamin) and He is the Best of the judges.

(Ayah80) ➊ {فَلَمَّااسْتَيْـَٔسُوْامِنْهُخَلَصُوْانَجِيًّا: ’’ اسْتَيْـَٔسُوْا ‘‘} here is in the same meaning as {’’ يَئِسُوْا‘‘ } (became hopeless). The form "istif‘āl" is for emphasis, meaning they became completely hopeless, just as in {’’عَجِبَ‘‘}, {’’اِسْتَعْجَبَ‘‘ ، ’’سَخِرَ‘‘}, and {’’ اِسْتَسْخَرَ ‘‘}, the "sīn" and "tā’" are only for emphasis, the meaning is the same. The same point is in {’’اِسْتَعْصَمَ‘‘} (Ayah 32) earlier. {’’ خَلَصُوْا ‘‘} means there was no one else among them, they began to consult alone. {’’ نَجِيًّا ‘‘ ’’فَعِيْلٌ‘‘} is on this pattern, meaning consultation, those who whisper, etc. This pattern is used for singular, dual, plural, and both masculine and feminine in the same way, that is why with {’’خَلَصُوْا ‘‘} the singular is used. ➋ { قَالَكَبِيْرُهُمْاَلَمْتَعْلَمُوْۤااَنَّاَبَاكُمْ … :} Their eldest said (meaning the eldest in age, or the one who was their chief in knowledge, understanding, and leadership): "Do you not know that your father took a firm oath from you that you must surely bring your brother back with you, and before this, what negligence you committed regarding Yusuf? Now how can I go before my father? As for myself, I have decided that I will never leave this land until my father gives me permission to return, or Allah decides something about me, that is, a way for my brother’s release is found, or my death comes."

80. 1. Because leaving without Binyamin was a difficult stage for them, they were not able to face their father. Therefore, they began to consult among themselves about what should be done now.
80. 2. The eldest brother, in this situation, did not find within himself the strength and courage to face the father, so he clearly said that he would not leave from here until the father himself investigates and becomes convinced of his innocence and grants him permission to return.

80. Then, when they lost all hope of [persuading] Joseph, they withdrew to confer privately. The eldest among them said, "Do you not know that your father took a solemn pledge from you in Allah’s name, and before this, you also fell short in your duty regarding Joseph? So I will never leave this place until my father permits me or Allah decides for me, and He is the best of judges."
[77] The Eldest Brother's Refusal to Return:
When Yusufؑ clearly refused to do such a favor, all the brothers went aside in seclusion and began to ponder over the current distressing situation. It had become a matter where there was neither a way to go forward nor a place to stay. If they had not committed excess in the matter of Yusuf earlier, the situation would not have become so grave now. In these circumstances, the eldest brother, mentioning the previous incident, said that he did not consider himself worthy of facing his father. However, he told them to go and inform their father of this situation. He would remain there and then try to bring Binyamin back from those people, or else he would die, or if his father ordered him to return, only then would he face his father. Now, whatever Allah wills will be acceptable to him, and He alone will decide what is best for him. In any case, he was not ready to return home with them and preferred death over it.
