They [Yûsuf’s (Joseph) brothers] said: "His penalty should be that he, in whose bag it is found, should be held for the punishment (of the crime). Thus we punish the Zâlimûn (wrong-doers)!"

(Ayah75) {مَنْوُّجِدَفِيْرَحْلِهٖفَهُوَجَزَآؤُهٗ:} From this it is understood that with Yaqub (peace be upon him), the punishment for a thief was that he would become the slave or captive of the owner of the stolen item, either permanently or for some period of time. 75. 1. That is, the thief would be handed over for a period of time to the person from whom he had stolen. This was the punishment in the Shariah of Yaqub (علیہ السلام), according to which the brothers of Yusuf (علیہ السلام) suggested this punishment.
75. 2. This statement is also from the brothers of Yusuf (علیہ السلام); according to some, it is the statement of the companions of Yusuf (علیہ السلام) who said that we also give such a punishment to wrongdoers. But the next part of the verse, that "in the king's law he could not have seized his brother," negates this statement.

The brothers of Yusuf said, "The penalty for it is that the one in whose possession it is found—he himself will be its recompense. This is how we punish [70] wrongdoers in our land."
[70] The Punishment for Theft in Canaan:
The brothers of Yusuf said, "We belong to a noble family; we are not thieves or people of mischief. We had come from Canaan to get grain and now we are returning with the grain." Those who were pursuing them said, "That is fine, but show us your belongings, and also tell us, if by chance the stolen goods are found among any of your belongings, then what will be the punishment for that?"
The Recovery of the Cup:
They replied, "In our country, the punishment for a thief is that if the stolen goods are found among someone's belongings or in his house, then the thief is handed over to the owner of the stolen goods for a year." The guarantor said, "Alright, we accept your statement as well." Saying this, the guarantor began to search their belongings. After searching the belongings of a few brothers, when Binyamin's belongings were searched, the missing cup was found in them. Thus, the guarantor took possession of the stolen cup and also took Binyamin into his custody.
