باب مَا جَاءَ فِي كَرَاهِيَةِ الْمُقَامِ بَيْنَ أَظْهُرِ الْمُشْرِكِينَ

Hadith 1604
حَدَّثَنَا هَنَّادٌ، حَدَّثَنَا أَبُو مُعَاوِيَةَ، عَنْ إِسْمَاعِيل بْنِ أَبِي خَالِدٍ، عَنْ قَيْسِ بْنِ أَبِي حَازِمٍ، عَنْ جَرِيرِ بْنِ عَبْدِ اللَّهِ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَعَثَ سَرِيَّةً إِلَى خَثْعَمٍ ، فَاعْتَصَمَ نَاسٌ بِالسُّجُودِ ، فَأَسْرَعَ فِيهِمُ الْقَتْلَ ، فَبَلَغَ ذَلِكَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَأَمَرَ لَهُمْ بِنِصْفِ الْعَقْلِ وَقَالَ : " أَنَا بَرِيءٌ مِنْ كُلِّ مُسْلِمٍ يُقِيمُ بَيْنَ أَظْهُرِ الْمُشْرِكِينَ " ، قَالُوا : يَا رَسُولَ اللَّهِ ، وَلِمَ ؟ قَالَ : " لَا تَرَايَا نَارَاهُمَا " ،
Narrated from Jarir bin Abdullah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) sent a detachment to the tribe of Khath'am. Some people (among the Muslims living among the disbelievers) sought protection by prostrating, yet they were hastily killed. When the Prophet (peace and blessings of Allah be upon him) was informed of this, he ordered half the blood money to be paid and said: "I am free from responsibility for every Muslim who lives among the polytheists." The people asked: "O Messenger of Allah! Why is that?" He said: "(A Muslim should reside at such a distance from the disbelievers that) they should not be able to see each other's (cooking) fires." __QUR_N__, __XREF_N__, __REF_N__
Hadith 1605
حَدَّثَنَا هَنَّادٌ، حَدَّثَنَا عَبْدَةُ، عَنْ إِسْمَاعِيل بْنِ أَبِي خَالِدٍ، عَنْ قَيْسِ بْنِ أَبِي حَازِمٍ، مِثْلَ حَدِيثِ أَبِي مُعَاوِيَةَ وَلَمْ يَذْكُرْ فِيهِ عَنْ جَرِيرٍ وَهَذَا أَصَحُّ ، وَفِي الْبَاب ، عَنْ سَمُرَةَ ، قَالَ أَبُو عِيسَى : وَأَكْثَرُ أَصْحَابِ إِسْمَاعِيل ، عَنْ قَيْسِ بْنِ أَبِي حَازِمٍ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَعَثَ سَرِيَّةً ، وَلَمْ يَذْكُرُوا فِيهِ عَنْ جَرِيرٍ ، وَرَوَاهُ حَمَّادُ بْنُ سَلَمَةَ، عَنْ الْحَجَّاجِ بْنِ أَرْطَاةَ، عَنْ إِسْمَاعِيل بْنِ أَبِي خَالِدٍ، عَنْ قَيْسٍ، عَنْ جَرِيرٍ، مِثْلَ حَدِيثِ أَبِي مُعَاوِيَةَ ، قَالَ : وسَمِعْت مُحَمَّدًا يَقُولُ : الصَّحِيحُ حَدِيثُ قَيْسٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مُرْسَلٌ ، وَرَوَى سَمُرَةُ بْنُ جُنْدَبٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " لَا تُسَاكِنُوا الْمُشْرِكِينَ ، وَلَا تُجَامِعُوهُمْ ، فَمَنْ سَاكَنَهُمْ أَوْ جَامَعَهُمْ ، فَهُوَ مِثْلُهُمْ " .
‘Abdah narrated this hadith via: «إسمعيل بن أبي خالد عن قيس ابن أبي عن النبي صلى الله عليه وسلم» (mursal) similar to the narration of Abu Mu‘awiyah, but in it, he (i.e., ‘Abdah) did not mention the intermediary of Jarir. © Imam Tirmidhi says:
1- This narration is more authentic,
2- Most of the students of Isma‘il ibn Abi Khalid narrate (mursal) from Qais ibn Abi Hazim from Isma‘il, that the Messenger of Allah (ﷺ) dispatched a detachment, and in it, they did not mention the intermediary of Jarir, and Hammad ibn Salamah narrated it via: «الحجاج بن أرطاة عن إسمعيل بن أبي خالد عن قيس عن جرير» (marfu‘an) similar to the narration of Abu Mu‘awiyah,
3- I heard Muhammad ibn Isma‘il al-Bukhari say: The correct view is that the hadith of Qais is mursal from the Prophet (ﷺ), and also Samurah ibn Jundub narrated from the Prophet (ﷺ), he said: “Do not live with the polytheists nor associate with them; whoever lives with them or associates with them is considered one of them.”
3- There is also a narration from Samurah in this chapter.
