باب مَا جَاءَ فِي أَهْلِ الذِّمَّةِ يَغْزُونَ مَعَ الْمُسْلِمِينَ هَلْ يُسْهَمُ لَهُمْ

Hadith 1558
حَدَّثَنَا الْأَنْصَارِيُّ، حَدَّثَنَا مَعْنٌ، حَدَّثَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ الْفُضَيْلِ بْنِ أَبِي عَبْدِ اللَّهِ، عَنْ عَبْدِ اللَّهِ بْنِ نِيَارٍ الْأَسْلَمِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ : أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَرَجَ إِلَى بَدْرٍ ، حَتَّى إِذَا كَانَ بِحَرَّةِ الْوَبَرَةِ ، لَحِقَهُ رَجُلٌ مِنَ الْمُشْرِكِينَ يَذْكُرُ مِنْهُ جُرْأَةً وَنَجْدَةً ، فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَلَسْتَ تُؤْمِنُ بِاللَّهِ وَرَسُولِهِ ؟ " ، قَالَ : لَا ، قَالَ : " ارْجِعْ ، فَلَنْ أَسْتَعِينَ بِمُشْرِكٍ " ، وَفِي الْحَدِيثِ كَلَامٌ أَكْثَرُ مِنْ هَذَا ، هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ ، قَالُوا : لَا يُسْهَمُ لِأَهْلِ الذِّمَّةِ وَإِنْ قَاتَلُوا مَعَ الْمُسْلِمِينَ الْعَدُوَّ ، وَرَأَى بَعْضُ أَهْلِ الْعِلْمِ : أَنْ يُسْهَمَ لَهُمْ إِذَا شَهِدُوا الْقِتَالَ مَعَ الْمُسْلِمِينَ . (حديث مرفوع) وَيُرْوَى عَنْ الزُّهْرِيِّ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَسْهَمَ لِقَوْمٍ مِنَ الْيَهُودِ قَاتَلُوا مَعَهُ " ، حَدَّثَنَا بِذَلِكَ قُتَيْبَةُ بْنُ سَعِيدٍ، أَخْبَرَنَا عَبْدُ الْوَارِثِ بْنُ سَعِيدٍ، عَنْ عَزْرَةَ بْنِ ثَابِتٍ، عَنْ الزُّهْرِيِّ، بِهَذَا .
´Umm al-Mu’minin Aisha (may Allah be pleased with her) says that` the Messenger of Allah (peace and blessings of Allah be upon him) set out for Badr. When he reached Harrat al-Wabrah 1, a polytheist joined him whose courage and bravery were well-known. The Prophet (peace and blessings of Allah be upon him) asked him: “Do you believe in Allah and His Messenger?” He replied: “No.” The Prophet (peace and blessings of Allah be upon him) said: “Go back, I will never seek help from a polytheist.” 2. © Imam Tirmidhi says:

3- Some people of knowledge act upon this, they say that a dhimmi will not get a share from the spoils of war even if he fights alongside the Muslims against the enemy,
4- Some people of knowledge are of the opinion that when a dhimmi participates in battle alongside the Muslims, he should be given a share,
5- It is narrated from Zuhri that the Prophet (peace and blessings of Allah be upon him) gave a share to a group of Jews who participated in battle alongside him.

Hadith 1559
حَدَّثَنَا أَبُو سَعِيدٍ الْأَشَجُّ، حَدَّثَنَا حَفْصُ بْنُ غِيَاثٍ، حَدَّثَنَا بُرَيْدُ بْنُ عَبْدِ اللَّهِ بْنِ أَبِي بُرْدَةَ، عَنْ جَدِّهِ أَبِي بُرْدَةَ، عَنْ أَبِي مُوسَى، قَالَ : " قَدِمْتُ عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي نَفَرٍ مِنَ الْأَشْعَرِيِّينَ خَيْبَرَ ، فَأَسْهَمَ لَنَا مَعَ الَّذِينَ افْتَتَحُوهَا " ، هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ غَرِيبٌ ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ ، قَالَ الْأَوْزَاعِيُّ : مَنْ لَحِقَ بِالْمُسْلِمِينَ قَبْلَ أَنْ يُسْهَمَ لِلْخَيْلِ ، أُسْهِمَ لَهُ ، وَبُرَيْدٌ يُكْنَى أَبَا بُرَيْدَةَ وَهُوَ ثِقَةٌ ، وَرَوَى عَنْهُ سُفْيَانُ الثَّوْرِيُّ ، وَابْنُ عُيَيْنَةَ ، وَغَيْرُهُمَا .
Abu Musa Ash'ari (may Allah be pleased with him) says: I came to the Messenger of Allah (peace and blessings of Allah be upon him) at Khaybar with a group from the Ash'ari tribe. The people who had conquered Khaybar, the Prophet assigned a share for us along with them 1. © Imam Tirmidhi says:

2- Some people of knowledge act upon this, and Awza'i says: Whoever joins the Muslims before a share is assigned for the horse, he will be given a share.
