باب مَا جَاءَ فِي اسْتِقْرَاضِ الْبَعِيرِ أَوِ الشَّىْءِ مِنَ الْحَيَوَانِ أَوِ السِّنِّ

Hadith 1316
حَدَّثَنَا أَبُو كُرَيْبٍ، حَدَّثَنَا وَكِيعٌ، عَنْ عَلِيِّ بْنِ صَالِحٍ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، قَالَ : اسْتَقْرَضَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سِنًّا ، فَأَعْطَاهُ سِنًّا خَيْرًا مِنْ سِنِّهِ ، وَقَالَ : " خِيَارُكُمْ أَحَاسِنُكُمْ قَضَاءً " . قَالَ : وَفِي الْبَاب ، عَنْ أَبِي رَافِعٍ . قَالَ أَبُو عِيسَى : حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَقَدْ رَوَاهُ شُعْبَةُ، وُسُفْيَانُ، عَنْ سَلَمَةَ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ ، لَمْ يَرَوْا بِاسْتِقْرَاضِ السِّنِّ بَأْسًا مِنَ الْإِبِلِ ، وَهُوَ قَوْلُ : الشَّافِعِيِّ ، وَأَحْمَدَ ، وَإِسْحَاق ، وَكَرِهَ بَعْضُهُمْ ذَلِكَ .
Abu Hurairah (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings of Allah be upon him) borrowed a young camel and repaid it with a better camel, and said: "The best among you are those who are best in repaying debts."

1- The hadith of Abu Hurairah (may Allah be pleased with him) is Hasan Sahih.
2- Shu’bah and Sufyan have also narrated it from Salamah.
3- In this chapter, there is also a narration from Abu Rafi’ (may Allah be pleased with him).
4- Some people of knowledge act upon this; they do not consider it disliked to borrow a camel of any age.
5- And some people have considered it disliked.

Hadith 1317
حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ، حَدَّثَنَا شُعْبَةُ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ نَحْوَهُ . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ .

حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى، حَدَّثَنَا وَهْبُ بْنُ جَرِيرٍ، حَدَّثَنَا شُعْبَةُ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَجُلًا تَقَاضَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَغْلَظَ لَهُ فَهَمَّ بِهِ أَصْحَابُهُ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " دَعُوهُ فَإِنَّ لِصَاحِبِ الْحَقِّ مَقَالًا " ، ثُمَّ قَالَ : " اشْتَرُوا لَهُ بَعِيرًا ، فَأَعْطُوهُ إِيَّاهُ ، فَطَلَبُوهُ فَلَمْ يَجِدُوا إِلَّا سِنَّا أَفْضَلَ مِنْ سِنِّهِ " ، فَقَالَ : " اشْتَرُوهُ ، فَأَعْطُوهُ إِيَّاهُ ، فَإِنَّ خَيْرَكُمْ أَحْسَنُكُمْ قَضَاءً " .
Abu Hurairah (may Allah be pleased with him) narrates that a man demanded repayment of a debt from the Messenger of Allah (peace and blessings be upon him) and spoke harshly. The Companions intended to deal with him, but the Messenger of Allah (peace and blessings be upon him) said: "Leave him, for the creditor has the right to speak." Then he said: "Buy a camel for him and give it to him." The people searched and found a camel better than his camel. He said: "Buy it and give it to him, for the best among you are those who are best in repaying debts."
Hadith 1317

Hadith 1318
حَدَّثَنَا عَبْدُ بْنُ حُمَيْدٍ، حَدَّثَنَا رَوْحُ بْنُ عُبَادَةَ، حَدَّثَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ، عَنْ أَبِي رَافِعٍ مَوْلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : اسْتَسْلَفَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَكْرًا ، فَجَاءَتْهُ إِبِلٌ مِنَ الصَّدَقَةِ ، قَالَ أَبُو رَافِعٍ : " فَأَمَرَنِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ أَقْضِيَ الرَّجُلَ بَكْرَهُ " ، فَقُلْتُ : لَا أَجِدُ فِي الْإِبِلِ إِلَّا جَمَلًا خِيَارًا رَبَاعِيًا ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَعْطِهِ إِيَّاهُ فَإِنَّ خِيَارَ النَّاسِ أَحْسَنُهُمْ قَضَاءً " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ .
Abu Rafi’ (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) took a young camel as a loan. Later, a camel from the charity came to him, so the Prophet (peace and blessings be upon him) ordered me to repay that man’s camel. I said to him: “I am not finding any camel except for a fine four-toothed camel.” He said: “Give it to him, for the best among people are those who are best in repaying debts.” .

حَدَّثَنَا أَبُو كُرَيْبٍ، حَدَّثَنَا إِسْحَاق بْنُ سُلَيْمَانَ الرَّازِيُّ، عَنْ مُغِيرَةَ بْنِ مُسْلِمٍ، عَنْ يُونُسَ، عَنْ الْحَسَنِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " إِنَّ اللَّهَ يُحِبُّ سَمْحَ الْبَيْعِ ، سَمْحَ الشِّرَاءِ ، سَمْحَ الْقَضَاءِ " . قَالَ : وَفِي الْبَاب ، عَنْ جَابِرٍ . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ غَرِيبٌ ، وَقَدْ رَوَى بَعْضُهُمْ هَذَا الْحَدِيثَ ، عَنْ يُونُسَ، عَنْ سَعِيدٍ الْمَقْبُرِيِّ، عَنْ أَبِي هُرَيْرَةَ .
Abu Hurairah (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings of Allah be upon him) said: "Allah Almighty loves gentleness and ease in selling, buying, and demanding repayment of debts." © Imam Tirmidhi says:

Hadith 1320
حَدَّثَنَا عَبَّاسٌ الدُّورِيُّ، حَدَّثَنَا عَبْدُ الْوَهَّابِ بْنُ عَطَاءٍ، أَخْبَرَنَا إِسْرَائِيلُ، عَنْ زَيْدِ بْنِ عَطَاءِ بْنِ السَّائِبِ، عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ، عَنْ جَابِرٍ، قَالَ : قَالَ رَسُولُ للَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " غَفَرَ اللَّهُ لِرَجُلٍ ، كَانَ قَبْلَكُمْ ، كَانَ سَهْلًا إِذَا بَاعَ سَهْلًا ، إِذَا اشْتَرَى سَهْلًا ، إِذَا اقْتَضَى " . قَالَ : هَذَا حَدِيثٌ صَحِيحٌ حَسَنٌ غَرِيبٌ مِنْ هَذَا الْوَجْهِ .
Jabir (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings of Allah be upon him) said: "Allah, the Exalted, forgave a man who lived before you because he was gentle when selling, when buying, and when demanding repayment of a loan." © Imam Tirmidhi says:
