'Abdullah bin Abbas (may Allah be pleased with them) says that the Messenger of Allah (peace and blessings of Allah be upon him) said: "An evil example is not suitable for us; the one who takes back a gift is like a dog that vomits and then licks it." 1.

قَالَ : وَفِي الْبَاب ، عَنْ ابْنِ عُمَرَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهُ قَالَ : " لَا يَحِلُّ لِأَحَدٍ أَنْ يُعْطِيَ عَطِيَّةً ، فَيَرْجِعَ فِيهَا إِلَّا الْوَالِدَ فِيمَا يُعْطِي وَلَدَهُ " . حَدَّثَنَا بِذَلِكَ

حُسَيْنٍ الْمُعَلِّمِ ، عَنْ
عَمْرِو بْنِ شُعَيْبٍ ، أَنَّهُ سَمِعَ
طَاوُسًا يُحَدِّثُ ، عَنْ
ابْنِ عُمَرَ ،
وَابْنِ عَبَّاسٍ يَرْفَعَانِ الْحَدِيثَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِهَذَا الْحَدِيثِ . قَالَ أَبُو عِيسَى : حَدِيثُ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ، قَالُوا : مَنْ وَهَبَ هِبَةً لِذِي رَحِمٍ مَحْرَمٍ ، فَلَيْسَ لَهُ أَنْ يَرْجِعَ فِيهَا ، وَمَنْ وَهَبَ هِبَةً لِغَيْرِ ذِي رَحِمٍ مَحْرَمٍ ، فَلَهُ أَنْ يَرْجِعَ فِيهَا ، مَا لَمْ يُثَبْ مِنْهَا ، وَهُوَ قَوْلُ : الثَّوْرِيِّ ، وقَالَ الشَّافِعِيُّ : لَا يَحِلُّ لِأَحَدٍ أَنْ يُعْطِيَ عَطِيَّةً فَيَرْجِعَ فِيهَا ، إِلَّا الْوَالِدَ فِيمَا يُعْطِي وَلَدَهُ . وَاحْتَجَّ الشَّافِعِيُّ بِحَدِيثِ عَبْدِ اللَّهِ بْنِ عُمَرَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " لَا يَحِلُّ لِأَحَدٍ أَنْ يُعْطِيَ عَطِيَّةً ، فَيَرْجِعَ فِيهَا إِلَّا الْوَالِدَ فِيمَا يُعْطِي وَلَدَهُ " .
‘Abdullah bin ‘Umar and Ibn ‘Abbas (may Allah be pleased with them) narrated that the Prophet (peace and blessings of Allah be upon him) said: “It is not permissible for anyone to give a gift and then take it back, except for a father who gives something to his son.” © Imam Tirmidhi says: 1- The hadith of Ibn ‘Abbas (may Allah be pleased with them both) is Hasan Sahih. 2- Some of the people of knowledge among the Companions and others have acted upon this hadith. They say that if someone gives something as a gift to a close relative (mahram), then he does not have the right to take it back, but if he gives something as a gift to someone who is not a close relative (non-mahram), then it is permissible for him to take it back if he has not received compensation for it. This is also the saying of Thawri. 3- And Shafi’i says: It is not permissible for anyone to give a gift and then take it back, except for a father who gives something to his son. Shafi’i has used as evidence the hadith of ‘Abdullah bin ‘Umar (may Allah be pleased with them both), which he narrated from the Prophet (peace and blessings of Allah be upon him), that he said: “It is not permissible for anyone to give a gift and then take it back, except for a father who gives something to his son.”
