Hadith 1259
حَدَّثَنَا
هَارُونُ بْنُ عَبْدِ اللَّهِ الْبَزَّازُ ، حَدَّثَنَا
يَزِيدُ بْنُ هَارُونَ ، أَخْبَرَنَا
حَمَّادُ بْنُ سَلَمَةَ ، عَنْ
أَيُّوبَ ، عَنْ
عِكْرِمَةَ ، عَنْ
ابْنِ عَبَّاسٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " إِذَا أَصَابَ الْمُكَاتَبُ حَدًّا ، أَوْ مِيرَاثًا وَرِثَ بِحِسَابِ مَا عَتَقَ مِنْهُ " ، وقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " يُؤَدِّي الْمُكَاتَبُ بِحِصَّةِ مَا أَدَّى دِيَةَ حُرٍّ وَمَا بَقِيَ دِيَةَ عَبْدٍ " . قَالَ : وَفِي الْبَاب ، عَنْ أُمِّ سَلَمَةَ . قَالَ أَبُو عِيسَى : حَدِيثُ ابْنِ عَبَّاسٍ حَدِيثٌ حَسَنٌ . وَهَكَذَا رَوَى
يَحْيَى بْنُ أَبِي كَثِيرٍ ، عَنْ
عِكْرِمَةَ ، عَنْ
ابْنِ عَبَّاسٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ . وَرَوَى خَالِدٌ الْحَذَّاءُ ، عَنْ عِكْرِمَةَ ، عَنْ عَلِيٍّ قَوْلَهُ ، وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ، وقَالَ أَكْثَرُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ، الْمُكَاتَبُ عَبْدٌ مَا بَقِيَ عَلَيْهِ دِرْهَمٌ ، وَهُوَ قَوْلُ : سُفْيَانَ الثَّوْرِيِّ ، وَالشَّافِعِيِّ ، وَأَحْمَدَ ، وَإِسْحَاق .
Narrated from Abdullah bin Abbas (may Allah be pleased with them) that the Prophet Muhammad (peace and blessings be upon him) said: "When a mukatab slave becomes entitled to blood money or inheritance, he will receive a share according to the extent to which he has been freed." He also said: "The mukatab will be given blood money in proportion to the amount of the contract price he has paid, and for the remainder, he will be given the blood money of a slave." © Imam Tirmidhi says: 1- The hadith of Ibn Abbas (may Allah be pleased with them) is Hasan (good). 2- Similarly, Yahya bin Abi Kathir narrated from Ikrimah, and Ikrimah from Ibn Abbas, and Ibn Abbas from the Prophet Muhammad (peace and blessings be upon him). 3- In this chapter, there is also a narration from Umm Salamah (may Allah be pleased with her). 4- However, Khalid al-Hadha also narrated from Ikrimah (but according to him), Ikrimah narrated from the statement of Ali (may Allah be pleased with him). 5- Some of the people of knowledge among the Companions and others act upon this hadith. And most of the people of knowledge among the Companions and others say that as long as even one dirham remains upon the mukatab, he is a slave. This is also the saying of Sufyan Thawri, Shafi'i, Ahmad, and Ishaq bin Rahwayh.
Hadith 1260
'Abdullah bin Umar (may Allah be pleased with them both) says: I heard the Messenger of Allah (peace and blessings of Allah be upon him) say during a sermon: "Whoever makes a contract of manumission with his slave for one hundred uqiyyah (twelve hundred dirhams), and the slave pays all except ten uqiyyah, then is unable to pay the remainder, he remains a slave." © Imam Tirmidhi says: 1- This hadith is hasan ghareeb. 2- Hajjaj bin Arta'ah has also narrated a similar hadith from Amr bin Shu'aib. 3- Most of the companions and other scholars act upon this, that as long as any amount of the contract remains unpaid by the slave, he remains a slave.
Hadith 1261
حَدَّثَنَا
سَعِيدُ بْنُ عَبْدِ الرَّحْمَنِ ، قَالَ : حَدَّثَنَا
سُفْيَانُ بْنُ عُيَيْنَةَ ، عَنْ
الزُّهْرِيِّ ، عَنْ
نَبْهَانَ مَوْلَى أُمِّ سَلَمَةَ ، عَنْ
أُمِّ سَلَمَةَ ، قَالَتْ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِذَا كَانَ عِنْدَ مُكَاتَبِ إِحْدَاكُنَّ مَا يُؤَدِّي ، فَلْتَحْتَجِبْ مِنْهُ " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَمَعْنَى هَذَا الْحَدِيثِ عِنْدَ أَهْلِ الْعِلْمِ عَلَى التَّوَرُّعِ ، وَقَالُوا : لَا يُعْتَقُ الْمُكَاتَبُ ، وَإِنْ كَانَ عِنْدَهُ مَا يُؤَدِّي حَتَّى يُؤَدِّيَ .
Umm al-Mu’minin Umm Salamah (may Allah be pleased with her) reports that the Messenger of Allah (peace and blessings of Allah be upon him) said: “When any of you has a mukatab slave who possesses enough money to pay the price of his contract, then he should conceal this from him.” © Imam Tirmidhi says: 1- This hadith is hasan sahih. 2- The people of knowledge act upon this hadith out of piety, righteousness, and caution. They say that a mukatab slave does not become free until he pays the price of his contract, even if he possesses enough money to pay it.
