Hadith 1239
حَدَّثَنَا
قُتَيْبَةُ، أَخْبَرَنَا
اللَّيْثُ، عَنْ
أَبِي الزُّبَيْرِ، عَنْ
جَابِرٍ، قَالَ : جَاءَ عَبْدٌ فَبَايَعَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى الْهِجْرَةِ ، وَلَا يَشْعُرُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ عَبْدٌ ، فَجَاءَ سَيِّدُهُ يُرِيدُهُ ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " بِعْنِيهِ فَاشْتَرَاهُ بِعَبْدَيْنِ أَسْوَدَيْنِ " ، ثُمَّ لَمْ يُبَايِعْ أَحَدًا بَعْدُ حَتَّى يَسْأَلَهُ أَعَبْدٌ هُوَ . قَالَ : وَفِي الْبَاب ، عَنْ أَنَسٍ . قَالَ أَبُو عِيسَى : حَدِيثُ جَابِرٍ حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ ، أَنَّهُ لَا بَأْسَ بِعَبْدٍ بِعَبْدَيْنِ يَدًا بِيَدٍ ، وَاخْتَلَفُوا فِيهِ إِذَا كَانَ نَسِيئًا .
Jabir (may Allah be pleased with him) reports that a slave came and pledged allegiance to the Prophet (peace and blessings of Allah be upon him) for migration, and the Prophet (peace and blessings of Allah be upon him) did not realize that he was a slave. Meanwhile, his master arrived and was demanding him. The Prophet (peace and blessings of Allah be upon him) said to him: "Sell him to me." So he bought him in exchange for two black slaves. After that, the Prophet (peace and blessings of Allah be upon him) would not take allegiance from anyone until he asked whether he was a slave or not. __REF_N__
Imam Tirmidhi says:
1- The hadith of Jabir (may Allah be pleased with him) is Hasan Sahih.
2- There is also a narration from Anas (may Allah be pleased with him) in this chapter.
3- The people of knowledge act upon this hadith that there is no harm in buying a slave for two slaves in cash, but if it is on credit, then there is a difference of opinion regarding it.
