باب مَا جَاءَ فِي كَرَاهِيَةِ بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً

Hadith 1237
حَدَّثَنَا أَبُو مُوسَى مُحَمَّدُ بْنُ مُثَنَّى، حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، عَنْ حَمَّادِ بْنِ سَلَمَةَ، عَنْ قَتَادَةَ، عَنْ الْحَسَنِ، عَنْ سَمُرَةَ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " نَهَى عَنْ بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً " . قَالَ : وَفِي الْبَاب ، عَنْ ابْنِ عَبَّاسٍ ، وَجَابِرٍ ، وَابْنِ عُمَرَ . قَالَ أَبُو عِيسَى : حَدِيثُ سَمُرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَسَمَاعُ الْحَسَنِ مِنْ سَمُرَةَ صَحِيحٌ ، هَكَذَا قَالَ : عَلِيُّ بْنُ الْمَدِينِيِّ وَغَيْرُهُ ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ، فِي بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً ، وَهُوَ قَوْلُ : سُفْيَانَ الثَّوْرِيِّ ، وَأَهْلِ الْكُوفَةِ ، وَبِهِ يَقُولُ أَحْمَدُ ، وَقَدْ رَخَّصَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ، فِي بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً ، وَهُوَ قَوْلُ : الشَّافِعِيِّ ، وَإِسْحَاق .
Samurah (may Allah be pleased with him) reports that the Prophet Muhammad (peace and blessings be upon him) forbade selling an animal for another animal on credit. © Imam Tirmidhi says:
1- The hadith of Samurah (may Allah be pleased with him) is Hasan Sahih (good and authentic).
2- Hasan’s hearing from Samurah is authentic. Ali ibn al-Madini and others have said the same.
3- In this chapter, there are also hadiths from Ibn Abbas, Jabir, and Ibn Umar (may Allah be pleased with them).
4- Most of the scholars among the Companions and others act upon this hadith regarding the issue of selling an animal for another animal on credit. This is also the view of Sufyan al-Thawri and the scholars of Kufa. Ahmad also holds this view.
5- Some scholars among the Companions and others have permitted selling an animal for another animal on credit. This is also the view of Shafi’i and Ishaq ibn Rahwayh.

Hadith 1238
حَدَّثَنَا أَبُو عَمَّارٍ الْحُسَيْنُ بْنُ حُرَيْثٍ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ نُمَيْرٍ، عَنْ الْحَجَّاجِ وَهُوَ ابْنُ أَرْطَاةَ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْحَيَوَانُ اثْنَانِ بِوَاحِدٍ لَا يَصْلُحُ نَسِيئًا ، وَلَا بَأْسَ بِهِ يَدًا بِيَدٍ " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ .
Jabir (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) said: "It is not permissible to sell two animals for one animal on credit; there is no harm in selling them for cash (on the spot)." © Imam Tirmidhi says: This hadith is Hasan Sahih.
