Hadith 1224
حَدَّثَنَا
قُتَيْبَةُ، حَدَّثَنَا
يَعْقُوبُ بْنُ عَبْدِ الرَّحْمَنِ الْإِسْكَنْدَرَانِيُّ، عَنْ
سُهَيْلِ بْنِ أَبِي صَالِحٍ، عَنْ
أَبِيهِ، عَنْ
أَبِي هُرَيْرَةَ، قَالَ : " نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ الْمُحَاقَلَةِ ، وَالْمُزَابَنَةِ " ، قَالَ : وَفِي الْبَاب ، عَنْ ابْنِ عُمَرَ ، وَابْنِ عَبَّاسٍ ، وَزَيْدِ بْنِ ثَابِتٍ ، وَسَعْدٍ ، وَجَابِرٍ ، وَرَافِعِ بْنِ خَدِيجٍ ، وَأَبِي سَعِيدٍ . قَالَ أَبُو عِيسَى : حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَالْمُحَاقَلَةُ بَيْعُ الزَّرْعِ بِالْحِنْطَةِ ، وَالْمُزَابَنَةُ بَيْعُ الثَّمَرِ عَلَى رُءُوسِ النَّخْلِ بِالتَّمْرِ ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ كَرِهُوا بَيْعَ الْمُحَاقَلَةِ وَالْمُزَابَنَةِ .
Abu Hurairah (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings of Allah be upon him) forbade muhaqala and muzabana. © Imam Tirmidhi says:
1- The hadith of Abu Hurairah (may Allah be pleased with him) is hasan sahih,
2- In this chapter, hadiths have also been narrated from Ibn Umar, Ibn Abbas, Zaid bin Thabit, Sa’d, Jabir, Rafi’ bin Khadij, and Abu Sa’id (may Allah be pleased with them),
3- Selling standing crops of ears in exchange for wheat is called muhaqala, and selling dates on the tree in exchange for plucked dates is called muzabana,
4- Most of the people of knowledge act upon this. They consider muhaqala and muzabana to be disliked.
Hadith 1225
‘It is narrated from Abdullah bin Yazid that Abu Ayash Zaid asked Sa’d (may Allah be pleased with him) about selling wheat with its husk removed in exchange for barley. So he (Sa’d) asked: Which of the two is superior? He replied: Wheat. So he (Sa’d) forbade it. And Sa’d (may Allah be pleased with him) stated that he heard the Messenger of Allah (peace and blessings of Allah be upon him) being asked about buying dry dates in exchange for fresh dates. So he (the Prophet) asked those sitting nearby: “Will the fresh dates decrease when they become dry? 1” The people said: Yes (they will decrease). So he forbade it. The author has narrated a similar hadith with chain «وكيع عن مالك». © Imam Tirmidhi says:
1- This hadith is Hasan Sahih,
2- The people of knowledge act upon this, and this is also the saying of Shafi’i and our companions.
