باب مَا جَاءَ فِي بَيْعِ الْمُدَبَّرِ

Hadith 1219
حَدَّثَنَا ابْنُ أَبِي عُمَرَ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ جَابِرٍ، أَنَّ رَجُلًا مِنْ الْأَنْصَارِ دَبَّرَ غُلَامًا لَهُ فَمَاتَ ، وَلَمْ يَتْرُكْ مَالًا غَيْرَهُ فَبَاعَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللَّهِ بْنِ النَّحَّامِ ، قَالَ جَابِرٌ : عَبْدًا قِبْطِيًّا مَاتَ عَامَ الْأَوَّلِ فِي إِمَارَةِ ابْنِ الزُّبَيْرِ . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَرُوِيَ مِنْ غَيْرِ وَجْهٍ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ، وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ، لَمْ يَرَوْا بِبَيْعِ الْمُدَبَّرِ بَأْسًا وَهُوَ قَوْلُ : الشَّافِعِيِّ ، وَأَحْمَدَ ، وَإِسْحَاق ، وَكَرِهَ قَوْمٌ مِنْ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ بَيْعَ الْمُدَبَّرِ ، وَهُوَ قَوْلُ : سُفْيَانَ الثَّوْرِيِّ ، وَمَالِكٍ ، وَالْأَوْزَاعِيِّ .
It is narrated from Jabir (may Allah be pleased with him) that a man from the Ansar 1 made his slave a mudabbar 2 (that is, he said to him: "You will be free after my death"), then he died, and he left no wealth except for this slave. So the Prophet (peace and blessings of Allah be upon him) sold him 3, and Nu‘aym bin ‘Abdullah bin Nahham bought him. Jabir says: He was a Coptic slave. In the first year of the governorship of ‘Abdullah bin Zubair (may Allah be pleased with them both), he died. © Imam Tirmidhi says:
1- This hadith is hasan sahih.
2- This is also narrated from Jabir bin ‘Abdullah through other chains.
3- Some of the people of knowledge among the Companions and others have acted upon this. They do not see any harm in selling a mudabbar slave. This is also the view of Shafi‘i, Ahmad, and Ishaq bin Rahwayh.
4- And some of the people of knowledge among the Companions and others have considered the sale of a mudabbar to be disliked. This is the view of Sufyan Thawri, Malik, and Awza‘i.
