1؎: In reality, Ibn ‘Umar radi Allahu anhuma said this in refutation of Ibn ‘Abbas radi Allahu anhuma, who used to give the fatwa permitting the stipulation of a condition. The hadith of Dubaa‘ah radi Allahu anha had not reached him; otherwise, he would not have said such a thing. And his indication was towards the incident in the Treaty of Hudaybiyyah, when the Prophet sallallahu alayhi wa sallam was prevented from performing ‘umrah.

Commentary: 1 ؎ : In reality, Ibn Umar radi Allahu anhu said this in refutation of Ibn Abbas radi Allahu anhu, who used to give the legal verdict (fatwa) permitting the stipulation of a condition. He (Ibn Umar) had not received the hadith of Duba‘ah radi Allahu anha; otherwise, he would not have said such a thing. And his indication was towards the incident in the Treaty of Hudaybiyyah, when the Prophet sallallahu alayhi wa sallam was prevented from performing ‘umrah.
