Hadith 1876

حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ بْنُ سَعْدٍ، عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " نَهَى أَنْ يُنْبَذَ الْبُسْرُ وَالرُّطَبُ جَمِيعًا " ، قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ .
Jabir bin Abdullah (may Allah be pleased with both of them) says that the Messenger of Allah (peace and blessings of Allah be upon him) forbade making nabidh by mixing «گدر» (half-ripe) dates and fresh dates together. 1© Imam Tirmidhi says:

Explanation:
1:
Because when mixed (when both are combined), intoxication develops in it rapidly,
even though its color does not change,
therefore, the one who drinks it assumes that it is not yet intoxicating.

Hadith Commentary: Benefits and Issues: Since mixing two things together to make nabidh causes it to become strong and intoxicating more quickly, the Prophet (sallallahu alayhi wa sallam) prohibited it as a preventive measure (sadd al-dhari‘ah). According to Allamah ‘Ayni, the Imams of Hijaz—Malik, Shafi‘i, and Ahmad—consider this act to be haram, and according to Allamah Nawawi, this is for the purpose of blocking the means (sadd al-dhari‘ah), so the prohibition is one of dislike (tanzih), and as long as intoxication does not occur, it is not haram. This is the view of Shafi‘i and the majority of scholars. According to some Malikis, it is haram, and according to Imam Abu Hanifah, there is no harm in it. Allamah Taqi gave preference to the opinion of tanzih (dislike without sin). (Takmilah, vol. 3, p. 619).

Benefits and Issues:
Nabidh is when these items are soaked in water,
after some time their sweetness develops in the water, and it can be drunk before it becomes intoxicating.
If soaked separately, intoxication does not develop quickly,
but if two things are mixed together, intoxication develops quickly.

Benefits and Issues:
Benefit: According to the explanation mentioned in Nihayah Ibn Athir, one of the methods of making intoxicating nabidh in the pre-Islamic era was that raisins and dates, or ripe fresh dates and semi-ripe dates, were mixed with water and then boiled.
Then it would be left for such a duration that intensity (fermentation) would develop in it.
It is narrated from Layth ibn Sa'd that when two different things were mixed, intensity would develop very quickly.
And the drink would become intoxicating.
Therefore, nabidh prepared in this manner was prohibited.
In hadith number 3706, this very process has also been explicitly described.
This too has been prohibited; however, if the pulp of fruits is mixed in such a way that the process of fermentation does not occur, then there is no harm in it.
As is made clear from hadith numbers 3707 and 3708.

Benefits and Issues:
➊ If dates, dried dates (chuhaara), or raisins (munqqa) are placed in water, then overnight their sweetness dissolves into the water and a sweet drink is prepared. This is called nabidh. This is a lawful (halal) drink because it does not contain intoxication.

➋ By mixing two types of things to make nabidh, there is a risk that intoxication will develop quickly in it. Therefore, one should avoid this.

➌ If there is a risk that a lawful act may result in the commission of an unlawful act, then it is better to avoid even that lawful act.

➍ In winter, soaking for a longer period also carries less risk of intoxication developing. Whereas in the summer season, its state changes quickly. This can be judged by its taste. If the drink is sweet, it should be drunk. And if the taste changes and bitterness or sourness is felt, then it should be discarded.
