Hadith 1527

حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ , حَدَّثَنَا إِسْحَاق بْنُ يُوسُفَ الْأَزْرَقُ , عَنْ هِشَامٍ الدَّسْتُوَائِيِّ , عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ , عَنْ أَبِي قِلَابَةَ، عَنْ ثَابِتِ بْنِ الضَّحَّاكِ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " لَيْسَ عَلَى الْعَبْدِ نَذْرٌ فِيمَا لَا يَمْلِكُ " , قَالَ : وَفِي الْبَاب , عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو , وَعِمْرَانَ بْنِ حُصَيْنٍ , قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ .
´Narrated Thabit bin Adh-Dahhak:` That the Prophet (ﷺ) said: "It is not for a person to vow about that over which he has no control."

Explanation:
1:
That is, when making a vow (nadhar), if the matter is not within the servant’s control, then such a vow is not valid.
Even if later he gains control over that matter, the vow will still not be fulfilled,
and there is no expiation (kaffarah) upon it either.

Benefits and Issues:
At such places where the people of disbelief and polytheism, and the people of innovation, perform their specific acts,
a Muslim who follows the Sunnah should refrain from worshipping Allah at those locations.
Similarly, those specific days and dates in which these people have made their innovations well-known, it is better to avoid performing acts of goodness resembling theirs on those occasions,
so that disassociation from them and their innovations may be expressed.

«أخرجه أبوداود، الأيمان والنذور، باب مايؤمر به من وفاء النذر، حديث:3313، والطبراني في الكبير:2 /75، 76، حديث:1341، وحديث كردم:أخرجه أحمد:3 /419 وهو حديث حسن.»©Explanation:
➊ This hadith is evidence that making a vow (nadhar) regarding permissible matters is allowed.
➋ Slaughtering (an animal) at the place of idols or at the sites of the festivals and gatherings of the disbelievers is among the major sins, even if the intention is nothing but seeking Allah’s pleasure, because this involves promoting the manifestations of their polytheism and the symbols of their religion.

Clarification: « حضرت کَرْدم رضی اللہ عنہ » bin Sufyan al-Thaqafi.
In “Kardam,” the letter “kaf” has a fatha (a), and the “ra” is sukun (silent).
From him, his daughter, Lady Maymunah radi Allahu anha, and Abdullah bin Amr bin al-As radi Allahu anhuma have narrated.
