عَبْدَةُ بْنُ سُلَيْمَانَ , عَنْ
مُحَمَّدِ بْنِ عَمْرٍو , حَدَّثَنَا
أَبُو سَلَمَةَ، عَنْ
أَبِي هُرَيْرَةَ، قَالَ : جَاءَ مَاعِزٌ الْأَسْلَمِيُّ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ , فَقَالَ : إِنَّهُ قَدْ زَنَى فَأَعْرَضَ عَنْهُ , ثُمَّ جَاءَ مِنْ شِقِّهِ الْآخَرِ , فَقَالَ : يَا رَسُولَ اللَّهِ , إِنَّهُ قَدْ زَنَى ، فَأَعْرَضَ عَنْهُ , ثُمَّ جَاءَ مِنْ شِقِّهِ الْآخَرِ , فَقَالَ : يَا رَسُولَ اللَّهِ , إِنَّهُ قَدْ زَنَى , فَأَمَرَ بِهِ فِي الرَّابِعَةِ فَأُخْرِجَ إِلَى الْحَرَّةِ , فَرُجِمَ بِالْحِجَارَةِ , فَلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ فَرَّ يَشْتَدُّ , حَتَّى مَرَّ بِرَجُلٍ مَعَهُ لَحْيُ جَمَلٍ فَضَرَبَهُ بِهِ , وَضَرَبَهُ النَّاسُ حَتَّى مَاتَ , فَذَكَرُوا ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ , أَنَّهُ فَرَّ حِينَ وَجَدَ مَسَّ الْحِجَارَةِ وَمَسَّ الْمَوْتِ , فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " هَلَّا تَرَكْتُمُوهُ " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ , وَقَدْ رُوِيَ مِنْ غَيْرِ وَجْهٍ , عَنْ أَبِي هُرَيْرَةَ , وَرُوِيَ هَذَا الْحَدِيثُ عَنْ
الزُّهْرِيِّ , عَنْ
أَبِي سَلَمَةَ , عَنْ
جَابِرِ بْنِ عَبْدِ اللَّهِ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْوَ هَذَا .
´Narrated Abu Hurairah:` "Ma'iz Al-Aslamu came to the Messenger of Allah (ﷺ) and said that he had committed adultery, so he (ﷺ) turned away from him. Then he approached from his other side and said: '[O Messenger of Allah!] I have committed adultery.' So he turned away from him. The he came from his other side and said: 'O Messenger of Allah! I have committed adultery.' So he gave the order (for stoning) upon the fourth time. He was taken to Al-Harrah and stoned with rocks, he ran swiftly until he passed a man with a camel whip who beat him with it, and the people beat him until he died. They mentioned to the Messenger of Allah (ﷺ), that he ran upon feeling the rocks at the time of death. So the Messenger of Allah (ﷺ) said: 'Why didn't you leave him?'"

The wording of one narration is as follows:
«هلاَّ تركْتموهُ،
لعلهُ أن يتوبَ فيتوبُ اللهُ عليهِ؟» That is, why did you not leave him alone?
It is possible that he might have retracted his confession and repented,
then Allah would have accepted his repentance.

➊ Many rulings are derived from this hadith.
Among them is also this: that the punishment of stoning (rajm) for a married person guilty of fornication was pronounced by none other than the Messenger of Allah (sallallahu alayhi wa sallam) himself.
➋ In the ahadith, this detail is also present: that the noble Companions (radi Allahu anhum), acting upon the stoning punishment pronounced by the Messenger of Allah (sallallahu alayhi wa sallam), stoned that person to death.

➌ From this hadith, it is also understood that for the implementation of the punishment of stoning (rajm) upon the adulterer, the testimony of four witnesses is not an essential condition; rather, if the person himself confesses to adultery, then he will also be stoned, and the enforcement of the punishment is the responsibility of the Islamic government alone.
➍ Some individuals have deduced from this hadith that, for the implementation of the hadd punishment for adultery, it is a condition that the crime of adultery be confessed four times. However, in this hadith, it is only mentioned that he confessed to the crime four times—where is it established that confessing four times is a condition? Rather, the context indicates that the Prophet (sallallahu alayhi wa sallam) turned away from him only due to doubt regarding this confession, or he did so in order that the person might turn back and repent from that matter which, until then, was only between Allah, the Exalted, and himself. For this reason, even his four confessions were not deemed sufficient; rather, subsequently, several questions were put to him, relating to different aspects, and several doubts were highlighted, and he was instructed in several words that could assist and support him in turning back. Or, perhaps, this confession was so that the matter would become absolutely certain and no kind of doubt or uncertainty would remain. Therefore, to make four confessions a condition for the admission of the crime, based on this hadith, is questionable.
