Hadith 1403

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ , حَدَّثَنَا مَعْدِيُّ بْنُ سُلَيْمَانَ هُوَ الْبَصْرِيُّ , عَنْ ابْنِ عَجْلَانَ , عَنْ أَبِيهِ , عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " أَلَا مَنْ قَتَلَ نَفْسًا مُعَاهِدًا لَهُ ذِمَّةُ اللَّهِ وَذِمَّةُ رَسُولِهِ فَقَدْ أَخْفَرَ بِذِمَّةِ اللَّهِ فَلَا يُرَحْ رَائِحَةَ الْجَنَّةِ , وَإِنَّ رِيحَهَا لَيُوجَدُ مِنْ مَسِيرَةِ سَبْعِينَ خَرِيفًا " . قَالَ : وَفِي الْبَاب , عَنْ أَبِي بَكْرَةَ . قَالَ أَبُو عِيسَى : حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ , وَقَدْ رُوِيَ مِنْ غَيْرِ وَجْهٍ , عَنْ أَبِي هُرَيْرَةَ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ .
´Narrated Abu Hurairah:` that the Prophet (ﷺ) said: "Indeed, whoever kills a Mu'ahid that has a covenant from Allah and a covenant from His Messenger (ﷺ), then he has violated the covenant with Allah and the covenant of His Messenger, so he shall not smell the fragrance of Paradise; even though its fragrance can be sensed from the distance of seventy autumns."

1:
Such a disbeliever who is residing in an Islamic state according to a covenant or agreement made with the Muslims—whether he is living there by paying jizyah (tax) after making a treaty, or has come to the abode of Islam (dar al-Islam) from the abode of war (dar al-harb) on the basis of a treaty or guarantee of safety (aman)—he will continue to enjoy the protection of the Muslims as long as he also abides by his agreement, or until he returns to his homeland, the abode of war (dar al-harb).

Benefits and Issues:


Non-Muslim residents of a Muslim country are called “dhimmi” because the Islamic government assumes responsibility for the protection of their rights.


These rights are granted to them by the command of Allah and in the light of the instructions of the Messenger of Allah (sallallahu alayhi wa sallam). Therefore, it is as if their protection has been undertaken by Allah and His Messenger (sallallahu alayhi wa sallam). Thus, it is not permissible for any Muslim to interfere in the fulfillment of the responsibility undertaken by Allah and His Messenger.


The meaning of “not smelling the fragrance of Paradise” is that such a person will be thousands of miles away from Paradise. In the Hereafter, there are only the abodes of Paradise and Hell; therefore, this warning means that such a person will go to Hell.
