سَمُرَةَ , قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " جَارُ الدَّارِ أَحَقُّ بِالدَّارِ " . قَالَ : وَفِي الْبَاب , عَنْ الشَّرِيدِ , وَأَبِي رَافِعٍ , وَأَنَسٍ . قَالَ أَبُو عِيسَى : حَدِيثُ سَمُرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ , وَرَوَى

قَتَادَةَ , عَنْ
أَنَسٍ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِثْلَهُ , وَرُوِيَ عَنْ سَعِيدٍ , عَنْ قَتَادَةَ , عَنْ الْحَسَنِ , عَنْ سَمُرَةَ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَالصَّحِيحُ عِنْدَ أَهْلِ الْعِلْمِ حَدِيثُ الْحَسَنِ , عَنْ سَمُرَةَ , وَلَا نَعْرِفُ حَدِيثَ قَتَادَةَ , عَنْ أَنَسٍ , إِلَّا مِنْ حَدِيثِ عِيسَى بْنِ يُونُسَ , وَحَدِيثُ عَبْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ الطَّائِفِيِّ , عَنْ عَمْرِو بْنِ الشَّرِيدِ , عَنْ أَبِيهِ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي هَذَا الْبَابِ , هُوَ حَدِيثٌ حَسَنٌ , وَرَوَى إِبْرَاهِيمُ بْنُ مَيْسَرَةَ , عَنْ عَمْرِو بْنِ الشَّرِيدِ , عَنْ أَبِي رَافِعٍ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : سَمِعْتُ مُحَمَّدًا يَقُولُ : كِلَا الْحَدِيثَيْنِ عِنْدِي صَحِيحٌ .
´Narrated Samurah:` that the Messenger of Allah (ﷺ) said: "The neighbor of a home has more right to the home."

1؎: «شفعہ» refers to that entitlement by which a partner (co-owner) can, by paying the price, acquire from another partner the share that has passed into someone else’s ownership.
2؎: From this hadith, those who affirm the right of pre-emption (shuf‘ah) for neighbors have argued for the establishment of shuf‘ah. The response given is that here, by “neighbor” is meant “partner,” not an actual neighbor, because in this hadith and in the hadith «إذا وقعت الحدود وصرفت الطريق فلا شفعة»—that is, “When boundaries have been demarcated and the paths have been separated, then there is no shuf‘ah,” which is coming ahead—the only way to reconcile the two is to take this meaning.

Because in this hadith, and in the hadith “When boundaries are demarcated and the paths are separated, then there is no shuf‘ah” (i.e., when the boundaries are set and the paths are separated, then there is no shuf‘ah), which is coming ahead, it is necessary to interpret the meaning in this way to reconcile the two narrations.
