قُتَيْبَةُ،
وَأَحْمَدُ بْنُ مَنِيعٍ، قَالَا : حَدَّثَنَا
سُفْيَانُ، عَنْ
الزُّهْرِيِّ، عَنْ
سَعِيدِ بْنِ الْمُسَيَّبِ، عَنْ
أَبِي هُرَيْرَةَ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَقَالَ قُتَيْبَةُ : يَبْلُغُ بِهِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لَا تَنَاجَشُوا " . قَالَ : وَفِي الْبَاب ، عَنْ ابْنِ عُمَرَ ، وَأَنَسٍ . قَالَ أَبُو عِيسَى : حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ كَرِهُوا النَّجْشَ . قَالَ أَبُو عِيسَى : وَالنَّجْشُ أَنْ يَأْتِيَ الرَّجُلُ الَّذِي يَفْصِلُ السِّلْعَةَ إِلَى صَاحِبِ السِّلْعَةِ ، فَيَسْتَامُ بِأَكْثَرَ مِمَّا تَسْوَى وَذَلِكَ عِنْدَمَا يَحْضُرُهُ الْمُشْتَرِي ، يُرِيدُ أَنْ يَغْتَرَّ الْمُشْتَرِي بِهِ ، وَلَيْسَ مِنْ رَأْيِهِ الشِّرَاءُ ، إِنَّمَا يُرِيدُ أَنْ يَخْدَعَ الْمُشْتَرِيَ بِمَا يَسْتَامُ ، وَهَذَا ضَرْبٌ مِنَ الْخَدِيعَةِ ، قَالَ الشَّافِعِيُّ : وَإِنْ نَجَشَ رَجَلٌ فَالنَّاجِشُ آثِمٌ فِيمَا يَصْنَعُ ، وَالْبَيْعُ جَائِزٌ لِأَنَّ الْبَائِعَ غَيْرُ النَّاجِشِ .
Abu Hurairah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings of Allah be upon him) said: "Do not practice Najsh (artificially inflating prices)." © Imam Tirmidhi says:
1- The hadith of Abu Hurairah (may Allah be pleased with him) is Hasan Sahih,
2- In this chapter, ahadith have also been narrated from Ibn Umar and Anas (may Allah be pleased with them),
3- And some people of knowledge have acted upon this; they have declared «نجش» to be impermissible,
4- «نجش» is that a person who can distinguish between good and bad goods comes to the seller and bids a price higher than the actual price, and this happens when a buyer is present, and the only purpose is that the buyer is deceived by this, and the one who bids the price has no intention of buying, but only wants the buyer to be deceived by his bidding. This is a kind of deception,
5- Shafi'i says: If a person does «نجش», then because of this action, the one who does «نجش» will be sinful, but the sale will be valid, because the seller is not doing «نجش».

Benefits and Issues:

The meaning of (najsh) is that a person, pretending to be a buyer, offers a higher price among the parties involved in the transaction,
even though he is not a genuine buyer.
And the real buyer, deceived into thinking that others are offering more,
becomes willing to purchase at a higher price.
Sometimes, such people are themselves roaming the market on behalf of the shopkeepers.
This act is against Islamic trustworthiness and honesty.
It is an obstacle to the freedom of market forces and is a deception.
Therefore, it is forbidden (haram).

However, in a general auction (bay‘ man yazid), if genuine buyers outbid each other, then this is permissible.

The meaning of increasing the bid is that a person who does not intend to purchase the item participates in the bidding and offers a price higher than what has already been offered, so that the needy buyer is compelled to pay a higher price.

This act is prohibited because it involves deception and causes harm to the buyer.

It is permissible to sell an item through bidding.
