Hadith 1182

حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى النَّيْسَابُورِيُّ، حَدَّثَنَا أَبُو عَاصِمٍ، عَنْ ابْنِ جُرَيْجٍ، قَالَ : حَدَّثَنِي مُظَاهِرُ بْنُ أَسْلَمَ، قَالَ : حَدَّثَنِي الْقَاسِمُ، عَنْ عَائِشَةَ، أَنَّ ّرَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " طَلَاقُ الْأَمَةِ تَطْلِيقَتَانِ وَعِدَّتُهَا حَيْضَتَانِ " . قَالَ مُحَمَّدُ بْنُ يَحْيَى : وحَدَّثَنَا أَبُو عَاصِمٍ، أَنْبَأَنَا مُظَاهِرٌ بِهَذَا ، قَالَ : وَفِي الْبَاب ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ . قَالَ أَبُو عِيسَى : حَدِيثُ عَائِشَةَ ، حَدِيثٌ غَرِيبٌ ، لَا نَعْرِفُهُ مَرْفُوعًا إِلَّا مِنْ حَدِيثِ مُظَاهِرِ بْنِ أَسْلَمَ ، وَمُظَاهِرٌ لَا نَعْرِفُ لَهُ فِي الْعِلْمِ غَيْرَ هَذَا الْحَدِيثِ ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ ، مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ، وَهُوَ قَوْلُ : سُفْيَانَ الثَّوْرِيِّ ، وَالشَّافِعِيِّ ، وَأَحْمَدَ ، وَإِسْحَاق .
´Muzahir bin Aslam narrated that Al-Qasim narrated from Aishah that:` The Messenger of Allah said: "The divorce for a slave woman is two divorces, and her Iddah is two menstruations."

Benefits and Issues:
Imam Malik has mentioned in the Muwatta the legal verdicts (fatawa) of Hazrat Uthman, Hazrat Zayd bin Thabit, and Hazrat Abdullah bin Umar (radi Allahu anhum) that a slave (ghulam) can issue two divorces (talaq), and the waiting period (‘iddah) for a slave-woman (bondwoman) is two menstrual cycles. That is, in the matter of divorce, the status of the husband—whether he is free or a slave—will be considered, and in the matter of ‘iddah, the status of the woman will be considered. Meaning, the waiting period for a free woman is three menstrual cycles, and for a slave-woman, it is two menstrual cycles. In any case, both of the aforementioned hadiths are weak; however, from the reports of the Companions (athar al-sahabah), it is established that if a slave divorces his wife—whether the wife is free or a slave—then for him, two divorces will be equivalent to three divorces.

And after issuing them at different times, he cannot take her back (ruju‘) until that divorced woman marries someone else in a proper marriage.
