Hadith 1036

حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ، عَنْ ابْنِ شِهَابٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ كَعْبِ بْنِ مَالِكٍ، أَنَّ جَابِرَ بْنَ عَبْدِ اللَّهِ أَخْبَرَهُ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ يَجْمَعُ بَيْنَ الرَّجُلَيْنِ مِنْ قَتْلَى أُحُدٍ فِي الثَّوْبِ الْوَاحِدِ ، ثُمَّ يَقُولُ : " أَيُّهُمَا أَكْثَرُ أَخْذًا لِلْقُرْآنِ " ، فَإِذَا أُشِيرَ لَهُ إِلَى أَحَدِهِمَا قَدَّمَهُ فِي اللَّحْدِ ، وَقَالَ : " أَنَا شَهِيدٌ عَلَى هَؤُلَاءِ يَوْمَ الْقِيَامَةِ ، وَأَمَرَ بِدَفْنِهِمْ فِي دِمَائِهِمْ ، وَلَمْ يُصَلِّ عَلَيْهِمْ وَلَمْ يُغَسَّلُوا " . قَالَ : وَفِي الْبَاب ، عَنْ أَنَسِ بْنِ مَالِكٍ . قَالَ أَبُو عِيسَى : حَدِيثُ جَابِرٍ حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَقَدْ رُوِيَ هَذَا الْحَدِيثُ عَنْ الزُّهْرِيِّ، عَنْ أَنَسٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَرُوِيَ عَنْ الزُّهْرِيِّ، عَنْ عَبْدِ اللَّهِ بْنِ ثَعْلَبَةَ بْنِ أَبِي صُعَيْرٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَمِنْهُمْ مَنْ ذَكَرَهُ عَنْ جَابِرٍ ، وَقَدِ اخْتَلَفَ أَهْلُ الْعِلْمِ فِي الصَّلَاةِ عَلَى الشَّهِيدِ ، فَقَالَ بَعْضُهُمْ : لَا يُصَلَّى عَلَى الشَّهِيدِ ، وَهُوَ قَوْلُ : أَهْلِ الْمَدِينَةِ ، وَبِهِ يَقُولُ : الشَّافِعِيُّ ، وَأَحْمَدُ ، وقَالَ بَعْضُهُمْ : يُصَلَّى عَلَى الشَّهِيدِ ، وَاحْتَجُّوا بِحَدِيثِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ صَلَّى عَلَى حَمْزَةَ ، وَهُوَ قَوْلُ : الثَّوْرِيِّ ، وَأَهْلِ الْكُوفَةِ ، وَبِهِ يَقُولُ : إِسْحَاق .
´Abdur-Rahman bin Ka'b bin Malik narrated that:` Jabir bin Abdullah informed him that the Prophet had put two men together in one cloth from those who were killed at (the battle of) Uhud, then he said: "Which of them memorized the more of the Qur'an?" When one of them was indicated to him, he put him in the Lahd (first) and said: "I am a witness for those people on the Day of Judgment." And he ordered that they be buried in their blood, and that they not be prayed over, nor washed.

After writing a detailed discussion on this subject, the author of Tuhfat al-Ahwadhi states:

In my view, the apparent ruling is that the funeral prayer (salat al-janazah) is not obligatory upon a martyr (shahid). However, if it is performed, it is permissible.

And al-Mawardi has transmitted this statement from Imam Ahmad: that performing the funeral prayer over a martyr is preferable, and if the funeral prayer is not performed over him, then (his) martyrdom will suffice for him.

Explanation:
1:
To cut off the nose, ears, and private parts, etc., is called "muthlah" (mutilation).

2:
Those who hold the view that the funeral prayer (salat al-janazah) is not to be performed over a martyr (shahid) derive their evidence from this very hadith. And those who say that the funeral prayer should be performed over a martyr interpret it to mean that you (sallallahu alayhi wa sallam) did not perform the prayer over any of them in the same manner as you performed it multiple times over Hamzah radi Allahu anhu.

3:
In all the manuscripts, it is written as "Jabir bin Abdullah bin Zayd," whereas no mention of a companion (sahabi) by this name is found in any source. And in the biographical works, all have listed among the teachers of "Abdur Rahman bin Ka'b bin Malik" the well-known companion "Jabir bin Abdullah bin Amr bin Haram." Furthermore, among the students of "Jabir bin Abdullah bin Amr," the name "Abdur Rahman bin Ka'b bin Malik" is mentioned.
