بَابُ الْأَسِيرِ فِي أَيْدِي الْعَدُوِّ وَالْعَمَلِ فِي مِيرَاثِهِ

Hadith 4006
حَدَّثَنَا سَعِيدٌ قَالَ: نا ابْنُ عَيَّاشٍ، عَنْ عَبْدِ الْعَزِيزِ بْنِ عُبَيْدِ اللَّهِ، عَنِ الشَّعْبِيِّ، فِي الْأَسِيرِ الْمُسْلِمِ فِي أَيْدِي الْعَدُوِّ قَالَ: «يَرِثُ وَيُوَرَّثُ مَا كَانَ عَلَى دِينِهِ»
Hazrat Sha'bi (may Allah have mercy on him) said: A Muslim prisoner who is in the custody of the enemy—if he remains firm on his religion—then he becomes an heir and inheritance can also be taken from him.
Hadith 4007
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا دَاوُدُ، عَنِ الشَّعْبِيِّ، أَنَّ شُرَيْحًا، كَانَ يُورِّثُ الْأَسِيرَ وَكَانَ يَقُولُ: «أَحْوَجُ مَا يَكُونُ إِلَى نَصِيبِهِ مِنَ الْمِيرَاثِ إِذَا كَانَ أَسِيرًا فِي أَيْدِي الْعَدُوِّ، فَإِمَّا أَنْ يُفَادُوهُ، وَإِمَّا أَنْ يَعْزِلُوهُ حَتَّى يَجِيءَ مِنْهُ مَا جَاءَ»
Hazrat Shurayh (may Allah have mercy on him) said: A prisoner becomes an heir. Because he is in the possession of the enemy and is most in need of his share. Ransom should be given for him or his share should be set aside.
