Hadith 3992
حَدَّثَنَا سَعِيدٌ قَالَ: نا جَرِيرٌ، عَنْ مُغِيرَةَ، عَنْ حَمَّادٍ، عَنْ إِبْرَاهِيمَ، قَالَ: «إِذَا سُبِيَتِ الْمَجُوسِيَّاتُ، وَعَبَدَةُ الْأَوْثَانِ أُجْبِرْنَ عَلَى الْإِسْلَامِ، فَإِنْ أَسْلَمْنَ وُطِئْنَ، وَاسْتُخْدِمْنَ، وَإِنْ لَمْ يُسْلِمْنَ اسْتُخْدِمْنَ وَلَمْ يُوطَأْنَ، وَإِذَا سُبِيَتِ الْيَهُودِيَّاتُ وَالنَّصْرَانِيَّاتُ أُجْبِرْنَ عَلَى الْإِسْلَامِ، فَإِنْ أَسْلَمْنَ، أَوْ لَمْ يُسْلِمْنَ وُطِئْنَ وَاسْتُخْدِمْنَ»
Ibrahim (may Allah have mercy on him) said: "If Magian and idol-worshipping women are captured, they should be compelled to accept Islam; if they accept Islam, then intercourse with them is permissible, otherwise only service may be taken from them. As for Jewish and Christian women, whether they accept Islam or not, both intercourse and service are permissible with them."
Hadith 3993
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، وَجَرِيرٌ، عَنْ مُوسَى بْنِ أَبِي عَائِشَةَ، قَالَ: سَأَلْتُ مُرَّةَ الْهَمْدَانِيَّ عَنِ الْأَمَةِ الْمَجُوسِيَّةِ، أَيَطَؤُهَا الرَّجُلُ؟ قَالَ: «لَا» وَسَأَلْتُ سَعِيدَ بْنَ جُبَيْرٍ، فَقَالَ: مَا هُمْ بِخَيْرٍ مِنْهُنَّ إِذَا فَعَلُوا ذَلِكَ، وَكَانَ أَشَدَّهُمَا قَوْلًا
Musa bin Abi Aisha (may Allah have mercy on him) said: I asked Murrah al-Hamdani whether it is permissible to have intercourse with a Magian slave woman. He said: "No." Then I asked Sayyiduna Sa'id bin Jubair (may Allah have mercy on him), and he strictly forbade it.
Hadith 3994
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَيَّاشٍ، عَنْ عَبْدِ الْعَزِيزِ بْنِ عُبَيْدِ اللَّهِ، عَنْ مُحَمَّدِ بْنِ عَلِيٍّ، وَالشَّعْبِيِّ أَنَّ «السِّبَاءَ، يَهْدِمُ نِكَاحَ الزَّوْجَيْنِ»
Muhammad bin Ali and Sha'bi, may Allah have mercy on them, said: "Imprisonment terminates the marriage between husband and wife."
