Hadith 3988
حَدَّثَنَا سَعِيدٌ قَالَ: نا ابْنُ الْمُبَارَكِ، عَنْ زَكَرِيَّا بْنِ أَبِي زَائِدَةَ، عَنِ الشَّعْبِيِّ أَنَّهُ سُئِلَ عَنْ رَجُلٍ اشْتَرَى جَارِيَةً مِنَ السَّبْيِ مَعَهَا ذَهَبٌ وَفِضَّةٌ قَالَ: «يَجْعَلُهُ فِي بَيْتِ الْمَالِ»
Shu'bi (may Allah have mercy on him) said: "Whoever buys a captive woman and finds gold or silver with her, he should deposit it in the treasury (Bayt al-Mal)."
Hadith 3989
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو الْأَحْوَصِ، عَنْ أَبِي إِسْحَاقَ، عَنْ مُحَمَّدِ بْنِ زَيْدٍ، قَالَ: " اشْتَرَيْتُ جَارِيَةً مِنْ خُمْسِ قَسْمٍ، فَوَجَدْتُ مَعَهَا خَمْسَةَ عَشَرَ دِينَارًا، فَأَتَيْتُ عَبْدَ الرَّحْمَنِ بْنَ خَالِدِ بْنِ الْوَلِيدِ، فَذَكَرْتُ ذَلِكَ لَهُ، فَقَالَ: هِيَ لَكَ "
Muhammad bin Zaid (may Allah have mercy on him) said: I bought a slave girl from the fifth of the spoils of war, and with her were found fifteen dinars. I mentioned this to Abdur Rahman bin Khalid bin Walid (may Allah be pleased with him), so he said: "They are yours."
Hadith 3990
حَدَّثَنَا سَعِيدٌ قَالَ: نَا ابْنُ عَيَّاشٍ، عَنْ مُحَمَّدِ بْنِ عَبْدِ اللهِ الْبَصْرِيِّ (1)، عَنْ مَكْحُولٍ، وَحَرَامِ بْنِ حَكِيمٍ، وَيَزِيدَ بْنِ أَبِي مَالِكٍ، وَالْمُتَوَكِّلِ، قَالُوا فِي الْجَارِيَةِ يَبْتَاعُهَا الرَّجُلُ مِنَ الْمَغْنَمِ، فَيَجِدُ مَعَهَا حُلِيًّا أَوْ مَالًا قَالَ: « هُوَ مَغْنَمٌ، فَلْيَرُدَّهُ إِلَى مَغَانِمِ الْمُسْلِمِينَ » .
Makhul, Haram bin Hakeem, Yazid bin Abi Malik, and Mutawakkil (may Allah have mercy on them) said: "Whoever buys a slave girl from the spoils of war and finds jewelry or wealth with her, he should return that wealth to the spoils of war."
Hadith 3991
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ يَزِيدَ بْنِ يَزِيدَ بْنِ جَابِرٍ، عَنْ مَكْحُولٍ أَنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ «نَهَى أَنْ تُوطَأَ الْحَبَالَى حَتَّى يَضَعْنَ، وَعَنْ بَيْعِ الْمَغَانِمِ حَتَّى يُقْسَمَ، وَعَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ، وَعَنْ كُلِّ ذِي نَابٍ مِنَ السَّبُعِ»
Makhul (may Allah have mercy on him) said: The Messenger of Allah (peace and blessings be upon him) forbade intercourse with pregnant slave women until they give birth, and he forbade selling (them) before the distribution of war booty, and he forbade the meat of domestic donkeys and the meat of every predatory animal.
