Hadith 3973
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ أَيُّوبَ، عَنْ نَافِعٍ، أَنَّ ابْنَ عُمَرَ، أَبَقَ غُلَامٌ لَهُ، فَأَتَى الْعَدُوَّ، فَفَتَحَ اللَّهُ عَلَى الْمُسْلِمِينَ، فَرُدَّ عَلَيْهِ، وَاقْتَحَمَ بِهِ فَرَسُهُ فِي جَرْفٍ، فَأَتَى الْعَدُوَّ، فَفَتَحَ اللَّهُ عَلَى الْمُسْلِمِينَ فَرُدَّ عَلَيْهِ "
The slave of Sayyiduna Ibn Umar (may Allah be pleased with them both) fled and took refuge with the enemy. Then the Muslims prevailed, and that slave was returned, and along with him, a horse fell into a pit, yet it was also returned.
Hadith 3974
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، أَنَّهُ كَانَ يَقُولُ فِي السِّلَاحِ، أَوِ الْعَبْدِ، أَوِ الْمَتَاعِ يُصِيبُهُ الْعَدُوُّ مِنَ الْمُسْلِمِينَ، ثُمَّ يُفِيئُهُ اللَّهُ عَلَى الْمُسْلِمِينَ، فَيُقِيمُ الرَّجُلُ الْبَيِّنَةَ عَلَى الشَّيْءِ قَالَ: «إِنْ أَدْرَكَهُ قَبْلَ أَنْ يُقْسَمَ فَهُوَ رَدٌّ عَلَيْهِ، وَإِنْ قُسِمَ فَلَا شَيْءَ لَهُ وَصَارَ فِي غَنِيمَةِ الْمُسْلِمِينَ»
Ata (may Allah have mercy on him) said: "If the enemy takes away the weapons, slaves, or wealth of the Muslims, then Allah grants victory to the Muslims, and a man gives testimony regarding his property, then if it is found before distribution, it should be returned to him. If it has already been distributed, then it becomes part of the spoils of war."
Hadith 3975
حَدَّثَنَا سَعِيدٌ قَالَ: نا حَمَّادُ بْنُ زَيْدٍ، عَنْ مَطَرٍ الْوَرَّاقِ، عَنْ رَجَاءِ بْنِ حَيْوَةَ، أَنَّ أَبَا عُبَيْدَةَ بْنَ الْجَرَّاحِ، كَتَبَ إِلَى عُمَرَ بْنِ الْخَطَّابِ فِيمَا أَحْرَزَ الْمُشْرِكُونَ، ثُمَّ ظَهَرَ الْمُسْلِمُونَ عَلَيْهِمْ بَعْدُ قَالَ: «وَمَنْ وَجَدَ مَالَهُ بِعَيْنِهِ فَهُوَ أَحَقُّ بِهِ مَا لَمْ يُقْسَمْ»
Raja bin Haywah (may Allah have mercy on him) said: Sayyiduna Abu Ubaidah bin Jarrah (may Allah be pleased with him) wrote to Umar (may Allah be pleased with him), that if a polytheist has taken possession of a Muslim's property, and then the Muslims become dominant, then whoever finds his property in its original form, he is entitled to it as long as the property has not been distributed.
Hadith 3976
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنِ الْحَجَّاجِ، عَنْ أَبِي إِسْحَاقَ، عَنْ سَلْمَانَ بْنِ رَبِيعَةَ، قَالَ: إِذَا أَصَابَ الْمُشْرِكُونَ شَيْئًا لِأَحَدٍ مِنَ الْمُسْلِمِينَ، ثُمَّ ظُهِرَ عَلَيْهِمْ، فَهُوَ لِصَاحِبِهِ مَا لَمْ يُقْسَمْ، فَإِذَا قُسِمَ فَلَا حَقَّ لَهُ فِيهِ "
Salman bin Rabee’ah (may Allah have mercy on him) said: “When the polytheists take any property from the Muslims, then the Muslims prevail, if the property is found before distribution, it belongs to the owner, and if it is distributed, then he has no right to it.”
Hadith 3977
حَدَّثَنَا سَعِيدٌ قَالَ: نا ابْنُ عَيَّاشٍ، عَنِ الْحَجَّاجِ، عَنِ الْحَكَمِ، عَنْ إِبْرَاهِيمَ، مِثْلَهُ
Ibrahim (may Allah have mercy on him) said: "If an enemy has taken the wealth of a Muslim, and then the Muslims become victorious, if the wealth is found before distribution, it is returned to its owner."
Hadith 3978
حَدَّثَنَا سَعِيدٌ قَالَ: نا جَرِيرٌ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، قَالَ: " إِذَا أَسَرَ الْعَدُوُّ مَمْلُوكًا مِنَ الْمُسْلِمِينَ فَظَفِرَ الْمُسْلِمُونَ، فَأَصَابُوا الْمَمْلُوكَ قَالَ: إِنْ وَجَدَهُ مَوْلَاهُ قَبْلَ أَنْ يَقَعَ فِي الْقَسْمِ فَمَوْلَاهُ أَحَقُّ بِهِ "
Ibrahim (may Allah have mercy on him) said: "If the enemy captures a Muslim's slave, then the Muslims prevail, and if the owner comes before the distribution, then the slave is his right."
Hadith 3979
حَدَّثَنَا سَعِيدٌ قَالَ: نا عُثْمَانُ بْنُ مَطَرٍ الشَّيْبَانِيُّ، قَالَ: نا أَبُو حَرِيزٍ، عَنِ الشَّعْبِيِّ، قَالَ: أَعَانَ أَهْلُ مَاهَ أَهْلَ جَلُولَاءَ عَلَى الْعَرَبِ، وَأَصَابُوا سَبَايَا مِنْ سَبَايَا الْعَرَبِ، وَرَقِيقًا، وَمَتَاعًا، ثُمَّ إِنَّ السَّائِبَ بْنَ الْأَقْرَعِ عَامِلَ عُمَرَ بْنِ الْخَطَّابِ غَزَاهُمْ، فَفَتَحَ مَاهَ، فَكَتَبَ إِلَى عُمَرَ فِي سَبَايَا الْمُسْلِمِينَ وَرَقِيقِهِمْ، وَمَتَاعِهِمْ قَدِ اشْتَرَاهُ التُّجَّارُ مِنْ أَهْلِ مَاهَ، وَفِي رَجُلٍ أَصَابَ كَنْزًا بِأَرْضٍ بَيْضَاءَ، فَكَتَبَ عُمَرُ: «أَنَّ الْمُسْلِمَ أَخُو الْمُسْلِمِ لَا يَخُونُهُ وَلَا يَخْذُلُهُ، فَأَيُّمَا رَجُلٍ مِنَ الْمُسْلِمِينَ أَصَابَ رَقِيقَهُ وَمَتَاعَهُ بِعَيْنِهِ فَهُوَ أَحَقُّ بِهِ مِنْ غَيْرِهِ، وَإِنْ أَصَابَهُ فِي أَيْدِي التُّجَّارِ بَعْدَمَا اقْتُسِمَ فَلَا سَبِيلَ إِلَيْهِ، وَأَيُّمَا حُرٍّ اشْتَرَاهُ التُّجَّارُ فَإِنَّهُ يُرَدُّ عَلَيْهِمْ رُءُوسُ أَمْوَالِهِمْ، وَأَنَّ الْحُرَّ لَا يُبَاعُ وَلَا يُشْتَرَى، وَأَيُّمَا رَجُلٍ أَصَابَ كَنْزًا عَادِيًا قَبْلَ أَنْ تَضَعَ الْحَرْبُ أَوْزَارَهَا، فَإِنَّهُ يُؤْخَذُ مِنْهُ خُمُسُهُ وَسَائِرُهُ بَيْنَهُمْ، وَهُوَ رَجُلٌ مِنْهُمْ، وَإِنْ أَصَابَهُ بَعْدَ مَا وَضَعَتِ الْحَرْبُ أَوْزَارَهَا فَخُذْ خُمُسَهُ وَسَائِرُهُ لَهُ خَاصَّةً»
Shu'bi (may Allah have mercy on him) said: The people of Mah attacked the Arabs, took their slaves and goods captive, then Sayyiduna Sa'ib bin Al-Aqra' attacked them, and wrote to 'Umar (may Allah be pleased with him). So 'Umar (may Allah be pleased with him) replied: "Whoever among the Muslims finds his property itself, he has more right to it. If it is found with traders after distribution, then there is no right. And if a trader buys a free Muslim, then their money should be returned, because a free man can neither be sold nor bought. And whatever wealth is obtained before the end of the battle, its khums (one-fifth) should be taken out, and the rest of the wealth should be distributed. And whatever wealth is obtained after the battle is over, it will belong to its owner."
