Hadith 3927
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، قَالَ: حَدَّثَنِي أُسَيْدُ بْنُ عَبْدِ الرَّحْمَنِ، عَنْ مُقْبِلِ بْنِ عَبْدِ اللَّهِ، عَنْ هَانِئِ بْنِ كُلْثُومٍ، أَنَّ صَاحِبَ جَيْشِ الشَّامِ كَتَبَ إِلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ: إِنَّا فَتَحْنَا أَرْضًا كَثِيرَةَ الطَّعَامِ وَالْعَلَفِ، فَكَرِهْتُ أَنْ أَتَقَدَّمَ عَلَى شَيْءٍ مِنْ ذَلِكَ إِلَّا بِأَمْرِكَ، فَكَتَبَ إِلَيْهِ عُمَرُ: «أَنْ دَعِ النَّاسَ يَأْكُلُوا وَيَعْلِفُوا، فَمَنْ بَاعَ شَيْئًا مِنْ ذَلِكَ بِذَهَبٍ أَوْ فِضَّةٍ فَلْيَرُدَّهُ إِلَى غَنَائِمِ الْمُسْلِمِينَ، فَقَدْ وَجَبَ فِيهِ خُمْسُ اللَّهِ وَسِهَامُ الْمُسْلِمِينَ»
Sayyiduna Umar (may Allah be pleased with him) wrote to the army in Syria: "Eat the food and fodder there, and whatever you sell, return it to the spoils of war because there is a fifth and the right of the Muslims in it."
Hadith 3928
حَدَّثَنَا سَعِيدٌ قَالَ: نا ابْنُ عَيَّاشٍ، عَنْ مُوسَى بْنِ يَسَارٍ، عَنْ مَكْحُولٍ، قَالَ: «دَخَلَ الْقَسْمُ فِي كُلِّ شَيْءٍ يُصِيبُهُ الْمُسْلِمُونَ فِي أَرْضِ عَدُوِّهِمْ إِلَّا مَا كَانَ مِنْ مَطْعَمٍ أَوْ مَشْرَبٍ، وَمَنْ بَاعَ شَيْئًا مِنْ ذَلِكَ بِذَهَبٍ أَوْ فِضَّةٍ، فَلْيُؤَدِّهِ إِلَى غَنَائِمِ الْمُسْلِمِينَ»
Makhul (may Allah have mercy on him) said: "Whatever Muslims find in the enemy's land will be distributed, except for food and drink items, and whoever sells any of these things for gold or silver must deposit it into the Muslims' spoils of war."
Hadith 3929
حَدَّثَنَا سَعِيدٌ قَالَ: نا جَرِيرٌ، عَنْ لَيْثٍ، قَالَ: قُلْتُ لِمُجَاهِدٍ: نَكُونُ فِي أَرْضِ الْعَدُوِّ فَنُصِيبُ الْغَنَائِمَ، فَتَكْثُرُ عَلَيْنَا حَتَّى لَا يَسْتَطِيعَ الْأَمِيرُ وَالنَّاسُ، وَيَعْجِزُونَ عَنْ حَمْلِهِ، فَيَقُولُ الْأَمِيرُ: مَنْ أَخَذَ شَيْئًا فَهُوَ لَهُ، فَقَالَ: «وَلَا مِخْيَطًا»
Laith (may Allah have mercy on him) says: I asked Mujahid (may Allah have mercy on him) that we are in the enemy's land and a lot of spoils of war are collected, so the commander says: "Whatever you take is yours." So he said: "Not even a needle!"
Hadith 3930
حَدَّثَنَا سَعِيدٌ قَالَ: نا ابْنُ عَيَّاشٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ يَزِيدَ بْنِ جَابِرٍ، قَالَ: سَمِعْتُ مَكْحُولًا، يَقُولُ: «مَا قَطَعْتَ مِنْ شَجَرَةٍ فِي أَرْضِ الْعَدُوِّ، وَعَمِلْتَ مِنْهُ قَدَحًا، أَوْ هِرَاوَةً، أَوْ وَتِدًا، أَوْ مِرْزَبَّةً فَلَا بَأْسَ بِهِ، وَمَا وَجَدْتَهُ فِي ذَلِكَ مَعْمُولًا فَأَدِّهِ إِلَى الْمَغْنَمِ»
Makhul (may Allah have mercy on him) said: "If you make a vessel, stick, nail, or hammer from a tree in the enemy's land, there is no harm in it, and whatever is found already made should be included in the spoils of war."
