Hadith 3303
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، قَالَ: «مَنِ ادَّعَى وَلَدًا مِنْ زِنًا لَمْ يُصَدَّقْ، وَلَمْ يُلْحَقْ بِهِ، وَلَمْ يَرِثْهُ»
Ibrahim (may Allah have mercy on him) said: "The claim of one who asserts paternity of a child from adultery will not be accepted, nor will the child be attributed to him, nor will he inherit."
Hadith 3304
أَخْبَرَنَا سَعِيدٌ، نا سَلَمَةُ بْنُ هَزَّالٍ، قَالَ: رَكَعْتُ بِمَكَّةَ رَكْعَتَيْنِ عِنْدَ الْمَقَامِ، فَإِذَا طَاوُسٌ عَنْ يَمِينِي، فَسَأَلَهُ خَيَّاطٌ عَنْ رَجُلٍ أَصَابَ امْرَأَةً حَرَامًا فَوَلَدَتْ مِنْهُ، ثُمَّ تَزَوَّجَهَا، فَوَلَدَتْ مِنْهُ، مَنْ يَرِثُ مِنْهُمَا، قَالَ: «يَرِثُهُ وَلَدُهُ لِرِشْدَةٍ، وَلَا يَرِثُ الْآخَرُ مِنْهُ شَيْئًا»
Sayyiduna Tawus (may Allah have mercy on him) said: "The man who fathers a child after marriage, that child will be his heir; the child born from previous adultery will not be an heir."
Hadith 3305
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا عَبْدُ الْمَلِكِ بْنُ أَبِي سُلَيْمَانَ، نا عَمْرُو بْنُ شُعَيْبٍ، أَنَّ رَجُلًا سَأَلَ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَوْمَ فَتْحِ مَكَّةَ، فَقَالَ: إِنَّ لَهُ وَلَدًا مِنْ أُمِّ فُلَانٍ مِنْ زِنًا، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «وَيْحَكَ إِنَّهُ لَا عَهْرَ فِي الْإِسْلَامِ، الْوَلَدُ لِلْفِرَاشِ، وَلِلْعَاهِرِ الْأَثْلَبُ»
The Messenger of Allah, peace and blessings be upon him, said: "There is no child from adultery; the child belongs to the owner of the bed, and the adulterer gets the stone."
Hadith 3306
أَخْبَرَنَا سَعِيدٌ، نا سُفْيَانُ، عَنْ عُبَيْدِ اللَّهِ بْنِ أَبِي يَزِيدَ، عَنْ أَبِيهِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ أَرْسَلَ إِلَى شَيْخٍ فِي دَارِهِمْ قَالَ: فَانْطَلَقْتُ مَعَهُ فَسَأَلَهُ عَنْ وِلَادٍ مِنْ وِلَادِ الْجَاهِلِيَّةِ , فَقَالَ: أَمَا النُّطْفَةُ لِفُلَانٍ، وَأَمَّا الْفِرَاشُ فَلِفُلَانٍ، فَقَالَ عُمَرُ: صَدَقْتَ، وَلَكِنْ قَضَى رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بِالْفِرَاشِ "
Sayyiduna Umar (may Allah be pleased with him) asked a sheikh: "How was judgment passed regarding birth in the time of ignorance?" He replied: "The sperm belonged to one person and the bed to another." Umar said: "The Messenger of Allah (peace and blessings be upon him) judged in favor of the bed."
Hadith 3307
أَخْبَرَنَا سَعِيدٌ، نا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، قَالَتِ: اخْتَصَمَ سَعْدُ بْنُ أَبِي وَقَّاصٍ وَعَبْدُ بْنُ زَمْعَةَ فِي ابْنِ أَمَةِ زَمْعَةَ، فَقَالَ سَعْدٌ: أَوْصَانِي أَخِي عُتْبَةُ: إِذَا قَدِمْتُ مَكَّةَ أَنْ آخُذَ ابْنَ أَمَةِ زَمْعَةَ، فَإِنَّهُ ابْنُهُ، وَقَالَ عَبْدُ بْنُ زَمْعَةَ: أَخِي، ابْنُ أَمَةِ أَبِي، وُلِدَ عَلَى فِرَاشِ أَبِي، فَرَأَى رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ شَبَهًا بَيِّنًا بِعُتْبَةَ فَقَالَ: «الْوَلَدُ لِلْفِرَاشِ، وَاحْتَجِبِي مِنْهُ يَا سَوْدَةُ»
Lady Aisha (may Allah be pleased with her) said: "Sa’d bin Abi Waqqas and ‘Abd bin Zam’ah disputed over a slave. The Prophet (peace be upon him) said: 'The child belongs to the (owner of the) bed. O Sawdah, observe veiling from him.'"
Hadith 3308
أَخْبَرَنَا سَعِيدٌ، نا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، عَنْ أَبِي هُرَيْرَةَ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ»
It is narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him): The Messenger of Allah (peace and blessings be upon him) said: "The child belongs to the (owner of the) bed, and for the adulterer is the stone."
Hadith 3309
أَخْبَرَنَا سَعِيدٌ، نا جَرِيرُ بْنُ عَبْدِ الْحَمِيدِ، عَنْ مُغِيرَةَ، عَنْ أَبِي وَائِلٍ، عَنْ عَبْدِ اللَّهِ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «الْوَلَدُ لِلْفِرَاشِ وَبِفِي الْعَاهِرِ الْحَجَرُ»
It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him): The Messenger of Allah (peace and blessings be upon him) said: "The child belongs to the owner of the bed, and the adulterer gets the stone."
