Hadith 3298
أَخْبَرَنَا سَعِيدٌ، أنا مُطَرِّفٌ، عَنِ الشَّعْبِيِّ، أَنَّهُ قَالَ فِي امْرَأَةٍ يَشْهَدُ عَلَيْهَا أَرْبَعَةٌ بِالزِّنَا، فَنَظَرَ إِلَيْهَا، فَإِذَا هِيَ بِكْرٌ، فَقَالَ الشَّعْبِيُّ: «مَا كُنْتُ لِأُقِيمَ حَدًّا عَلَى امْرَأَةٍ عَلَيْهَا مِنَ اللَّهِ خَاتَمٌ»
Hazrat Sha'bi (may Allah have mercy on him) said: "If four men bear witness to the adultery of a woman and she turns out to be a virgin, then I would not enforce the hadd (punishment) upon her, for she has the dowry from Allah."
Hadith 3299
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا إِسْمَاعِيلُ بْنُ إِسْمَاعِيلَ، قَالَ: سَمِعْتُ الشَّعْبِيَّ، يَقُولُ: «يُقَامُ عَلَيْهَا الْحَدُّ، وَلَا يُلْتَفَتُ إِلَى ذَلِكَ مِنْهَا» قَالَ هُشَيْمٌ: وَهُوَ الْقَوْلُ
Hazrat Sha'bi (may Allah have mercy on him) said: "The hadd punishment will be carried out on the woman and her virginity will not be considered." Hisham said: "This is the correct opinion."
Hadith 3300
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُطَرِّفٌ، عَنِ الشَّعْبِيِّ، قَالَ: «لَيْسَ عَلَى تَائِبٍ حَدٌّ»
Hazrat Sha'bi (may Allah have mercy on him) said: "There is no hadd (prescribed punishment) upon the one who repents."
Hadith 3301
أَخْبَرَنَا سَعِيدٌ، نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ بَيَانٍ، عَنْ عَامِرٍ الشَّعْبِيِّ، قَالَ: سَمِعْتُهُ يَقُولُ: «إِذَا تَزَوَّجَ الرَّجُلُ الْبِكْرَ، فَقَذَفَهَا زَوْجُهَا قَبْلَ أَنْ يَدْخُلَ بِهَا فَنَظَرَ إِلَيْهَا النِّسَاءُ، فَوَجَدُوهَا بِكْرًا، فَإِنَّهُ يُجْلَدُ؛ لِأَنَّهُ اسْتَبَانَ أَنَّهُ كَذَبَ عَلَيْهَا»
Hazrat Sha'bi (may Allah have mercy on him) said: "If a husband accuses his wife before consummation, and the woman turns out to be a virgin, then the prescribed punishment (hadd) will be carried out on the husband because his lie has been proven."
Hadith 3302
أَخْبَرَنَا سَعِيدٌ، نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ سَعِيدِ بْنِ يُوسُفَ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ، قَالَ: قَضَى عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ فِي امْرَأَةٍ عَذْرَاءَ تَزَوَّجَهَا شَيْخٌ كَبِيرٌ فَحَمَلَتْ، فَزَعَمَ الشَّيْخُ أَنَّهُ لَمْ يُجَامِعْهَا، وَسُئِلَتْ هَلِ افْتَضَّكِ؟ قَالَتْ: لَا، فَأَمَرَ النِّسَاءَ أَنْ يَنْظُرْنَ إِلَيْهَا، فَزَعَمْنَ أَنَّهَا عَذْرَاءُ، فَقَالَ: " إِنَّ لِلْمَرْأَةِ سَمَّيْنِ: سَمُّ الْحَيْضِ، وَسَمُّ الْبَوْلِ، فَلَعَلَّ الرَّجُلَ كَانَ يُنْزِلُ فِي قُبُلِهَا فِي سَمِّ الْمَحِيضِ، فَحَمَلَتْ " فَسُئِلَ الرَّجُلُ، فَقَالَ؟ كُنْتُ أُنْزِلُ الْمَاءَ فِي قُبُلِهَا، فَقِيلَ لِلشَّيْخِ: إِنَّهَا لَمْ تَزَلْ بِكْرًا، وَإِنَّمَا الْحَمْلُ لَكَ، وَلَكَ وَلَدُهُ
Sayyiduna Ali (may Allah be pleased with him) gave a verdict regarding a woman who was a virgin and had married an old man. The woman became pregnant. The old man claimed, "I did not have intercourse with her." The woman was asked, "Has your virginity been lost?" The woman replied, "No." Sayyiduna Ali (may Allah be pleased with him) ordered women to examine her. They reported that she was indeed a virgin. Then Sayyiduna Ali (may Allah be pleased with him) said, "There are two passages in a woman's body: the passage of menstruation and the passage of urine. It is possible that the man ejaculated at the place of menstruation (i.e., at the entrance of the vagina) and the woman became pregnant." Then the old man was asked, and he said, "I used to ejaculate semen on her vagina." Thus, Sayyiduna Ali (may Allah be pleased with him) ruled: "The woman remains a virgin, and the pregnancy is from your (the old man's) semen, and this child will be yours."
