بَابُ مَنْ قَالَ: إِنَّ الْأَمَةَ تَبْرُزُ وَتُصَلِّي بِغَيْرِ قِنَاعٍ

Hadith 3270
أَخْبَرَنَا سَعِيدٌ، نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، سَمِعَ الْحَارِثَ بْنَ عَبْدِ اللَّهِ بْنِ أَبِي رَبِيعَةَ يُخْبِرُ أَبَا الشَّعْثَاءِ، قَالَ: سَأَلَ أَبِي عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ عَنْ حَدِّ الْأَمَةِ، فَقَالَ عُمَرُ: «إِنَّ الْأَمَةَ نَبَذَتْ فَرْوَتَهَا مِنْ وَرَاءِ الدَّارِ» وَقَالَ سُفْيَانُ مَرَّةً أُخْرَى: مِنْ وَرَاءِ الْجِدَارِ
Sayyiduna Umar (may Allah be pleased with him) said: "When a slave-girl throws her shawl behind the wall, then she is no longer like a free woman."
Hadith 3271
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ عَنْ حَجَّاجٍ عَنْ عِكْرِمَةَ بْنِ خَالِدٍ الْمَخْزُومِيِّ قَالَ: قَالَ عُمَرُ بْنُ الْخَطَّابِ «إِنَّ الْأَمَةَ أَلْقَتْ فَرْوَةَ رَأْسِهَا وَرَاءَ الْجِدَارِ»
Sayyiduna Umar (may Allah be pleased with him) said: "The slave girl threw her sheet over the wall."
Hadith 3272
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُجَالِدٌ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، أَنَّهُ سُئِلَ عَنِ الْأَمَةِ كَيْفَ تُصَلِّي؟ قَالَ: «تُصَلِّي فِي هَيْئَتِهَا الَّتِي تَخْرُجُ فِيهَا إِلَى السُّوقِ»
Hazrat Masruq (may Allah have mercy on him) said: "A slave-girl should pray in the same condition in which she goes to the market."
Hadith 3273
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا خَالِدٌ الْحَذَّاءُ، عَنْ أَبِي قِلَابَةَ، قَالَ: كَانَ عُمَرُ لَا يَدَعُ أَمَةً تَقَنَّعُ فِي خِلَافَتِهِ، وَقَالَ: «إِنَّمَا ذَلِكَ لِلْحَرَائِرِ لِكَيْلَا يُؤْذَيْنَ»
During the caliphate of Sayyiduna Umar (may Allah be pleased with him), he would not allow any slave woman to wear a veil, and he used to say: "Veil is for free women so that they are not harmed."
Hadith 3274
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مَنْصُورٌ، عَنْ مُجَاهِدٍ، قَالَ: قُلْتُ لِابْنِ عُمَرَ: الْأَمَةُ الَّتِي قَدْ حَاضَتْ تَخْرُجُ فِي إِزَارٍ؟ قَالَ: «نَعَمْ» قُلْتُ: كَيْفَ ذَلِكَ؟ قَالَ: «كَانَ بِالنَّاسِ إِذْ ذَاكَ حَاجَةٌ» فَقُلْتُ: قَدْ وَسَّعَ اللَّهُ عَلَيْنَا، فَقَالَ: «دَعْنِي مِنْكَ»
It was asked from Sayyiduna Ibn Umar (may Allah be pleased with them both) whether a slave woman in menstruation can go out wearing an izar (lower garment)? He replied: "Yes." And further said: "At that time, people were in need, now Allah has granted ease."
Hadith 3275
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، عَنْ مُغِيرَةَ، عَنْ سِمَاكٍ، عَنْ إِبْرَاهِيمَ، قَالَ: «تُصَلِّي أُمُّ الْوَلَدِ بِغَيْرِ قِنَاعٍ، وَإِنْ كَانَتْ بِنْتَ سِتِّينَ سَنَةً»
Ibrahim al-Nakha'i (may Allah have mercy on him) said: "An umm walad may pray without a veil, even if she is sixty years old."
Hadith 3276
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، نا يُونُسُ، عَنِ الْحَسَنِ «أَنَّهُ كَانَ يُحِبُّ لِلْأَمَةِ إِذَا عَهِدَهَا سَيِّدُهَا أَنْ تُصَلِّيَ مُجْتَمِعَةً»
Hasan al-Basri (may Allah have mercy on him) used to encourage the Umm Walad to perform prayer in congregation.
