بَابُ الْمَرْأَةِ تَلِدُ لِسِتَّةِ أَشْهُرٍ

Hadith 3251
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يُونُسُ، عَنِ الْحَسَنِ أَنَّ امْرَأَةً وَلَدَتْ لِسِتَّةِ أَشْهُرٍ، فَأُتِيَ بِهَا عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ فَهَمَّ بِرَجْمِهَا، فَقَالَ لَهُ عَلِيٌّ: لَيْسَ ذَاكَ لَكَ: إِنَّ اللَّهَ عَزَّ وَجَلَّ يَقُولُ فِي كِتَابِهِ: {وَحَمْلُهُ وَفِصَالُهُ ثَلَاثُونَ شَهْرًا} [الأحقاف: 15]، فَقَدْ يَكُونُ فِي الْبَطْنِ سِتَّةَ أَشْهُرٍ، وَالرَّضَاعُ أَرْبَعَةً وَعِشْرِينَ شَهْرًا، فَذَلِكَ تَمَامُ مَا قَالَ اللَّهُ: ثَلَاثُونَ شَهْرًا، فَخَلَّى عَنْهَا عُمَرُ
A woman gave birth to a child in six months. Umar (may Allah be pleased with him) intended to stone her, but Ali (may Allah be pleased with him) saved her by reasoning from the verse that the total period of pregnancy and breastfeeding is thirty months.
Hadith 3252
أَخْبَرَنَا سَعِيدٌ، نا أَبُو مُعَاوِيَةَ، نا الْأَعْمَشُ، عَنْ مُسْلِمِ بْنِ صُبَيْحٍ، عَنْ قَائِدِ ابْنِ عَبَّاسٍ، قَالَ: " أُتِيَ عُثْمَانُ فِي امْرَأَةٍ وَلَدَتْ فِي سِتَّةِ أَشْهُرٍ فَأَمَرَ بِرَجْمِهَا، فَقَالَ ابْنُ عَبَّاسٍ: أَدْنُونِي مِنْهُ فَأَدْنَوْهُ، فَقَالَ: إِنَّهَا تُخَاصِمَكَ بِكِتَابِ اللَّهِ يَقُولُ اللَّهُ عَزَّ وَجَلَّ: {وَالْوَالِدَاتُ يُرْضِعْنَ أَوْلَادَهُنَّ حَوْلَيْنِ كَامِلَيْنِ} [البقرة: 233]، وَيَقُولُ فِي آيَةٍ أُخْرَى: {وَحَمْلُهُ وَفِصَالُهُ ثَلَاثُونَ شَهْرًا} [الأحقاف: 15] فَرَدَّهَا عُثْمَانُ وَخَلَّى سَبِيلَهَا "
A woman who had given birth to a child in six months was brought before Hazrat Uthman (may Allah be pleased with him). He ordered her to be stoned, but Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) saved her by reasoning from the Book of Allah.
Hadith 3253
أَخْبَرَنَا سَعِيدٌ، نا أَبُو مُعَاوِيَةَ، نا الْأَعْمَشُ، عَنْ أَبِي سُفْيَانَ، قَالَ: نا أَشْيَاخُنَا أَنَّ رَجُلًا خَرَجَ فِي زَمَنِ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ فَغَابَ عَنِ امْرَأَتِهِ سَنَتَيْنِ، فَجَاءَ وَهِيَ حُبْلَى فَرَفَعَهَا إِلَى عُمَرَ بْنِ الْخَطَّابِ فَأَمَرَ بِرَجْمِهَا، فَقَالَ لَهُ مُعَاذٌ: «إِنْ يَكُ عَلَيْهَا سَبِيلٌ، فَلَا سَبِيلَ لَكَ عَلَى مَا فِي بَطْنِهَا»، فَحَبَسَهَا عُمَرُ حَتَّى وَلَدَتْ فَوَضَعَتْ غُلَامًا لَهُ ثِنْيَتَانِ، فَلَمَّا رَآهُ الرَّجُلُ قَالَ: ابْنِي ابْنِي، فَبَلَغَ ذَلِكَ عُمَرَ، فَقَالَ: «عَجَزَتِ النِّسَاءُ أَنْ تَلِدَ مِثْلَ مُعَاذٍ، لَوْلَا مُعَاذٌ هَلَكَ عُمَرُ»
A man was absent for two years, and when he returned, his wife was pregnant. Sayyiduna Umar (may Allah be pleased with him) ordered her to be stoned, but Hazrat Mu'adh (may Allah be pleased with him) argued that the prescribed punishment cannot be carried out on a pregnant woman, and when the child was born, the father accepted the child as his own.
Hadith 3254
أَخْبَرَنَا سَعِيدٌ، نا دَاوُدُ بْنُ عَبْدِ الرَّحْمَنِ، عَنِ ابْنِ جُرَيْجٍ، عَنْ جَمِيلَةَ بِنْتِ سَعْدٍ، عَنْ عَائِشَةَ، قَالَتْ: «مَا تَزِيدُ الْمَرْأَةُ فِي الْحَمْلِ عَلَى سَنَتَيْنِ، وَلَا قَدْرِ مَا يَتَحَوَّلُ ظِلُّ عُودِ هَذَا الْمِغْزَلِ»
Lady Aisha (may Allah be pleased with her) said: "A woman's pregnancy cannot exceed two years, not even by as much as the movement of the shadow of a spindle."
Hadith 3255
أَخْبَرَنَا سَعِيدٌ، نا أَبُو مُعَاوِيَةَ، نا الْأَعْمَشُ، عَنْ أَبِي ظَبْيَانَ، قَالَ: أُتِيَ عُمَرُ بْنُ الْخَطَّابِ بِمَجْنُونَةٍ فَأَمَرَ بِرَجْمِهَا، فَمُرَّ بِهَا عَلَى عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ يَتْبَعُهَا الصِّبْيَانُ، فَقَالَ: مَا هَذِهِ؟ قَالُوا: مَجْنُونَةٌ فَجَرَتْ، فَأَمَرَ عُمَرُ بِرَجْمِهَا، فَقَالَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ: كَمَا أَنْتُمْ، لَا تَعْجَلُوا، فَأَتَى عُمَرَ، فَقَالَ: " يَا أَمِيرَ الْمُؤْمِنِينَ، أَمَا عَلِمْتَ أَنَّ الْقَلَمَ رُفِعَ عَنْ ثَلَاثَةٍ: عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ، وَالْمَجْنُونِ حَتَّى يَبْرُؤَ، وَعَنِ الصَّغِيرِ حَتَّى يُدْرِكَ " فَقَالَ عُمَرُ: كَذَلِكَ، فَقَالَ عَلِيٌّ لِعُمَرَ: «فَرُدَّهَا، وَخَلِّ سَبِيلَهَا»
A mad woman committed adultery, so Sayyiduna Umar (may Allah be pleased with him) ordered stoning. Hazrat Ali (may Allah be pleased with him) said: "There is no hadd (legal punishment) upon the insane." Thus, she was released.
Hadith 3256
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، أَنَّهُ كَانَ يَقُولُ: " رُفِعَ الْقَلَمُ عَنْ أَرْبَعَةٍ: عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ، وَعَنِ الصَّغِيرِ حَتَّى يَبْلُغَ، وَعَنِ الْمَجْنُونِ حَتَّى يُكْشَفَ عَنْهُ، وَعَنِ الْكَبِيرِ الَّذِي لَا يَعْقِلُ "
Ibrahim Nakha'i (may Allah have mercy on him) said: "There is no accountability for four: the one who is asleep, the minor child, the insane, and the elderly who have lost their minds."
Hadith 3257
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا الْعَوَّامُ، عَنْ إِبْرَاهِيمَ التَّيْمِيِّ، قَالَ: أُتِيَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ بِامْرَأَةٍ مُصَابَةٍ قَدْ فَجَرَتْ، فَهَمَّ أَنْ يَضْرِبَهَا فَقَالَ عَلِيٌّ: لَيْسَ ذَاكَ لَكَ، سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ، عَنِ الصَّغِيرِ حَتَّى يَبْلُغَ، وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ، وَعَنِ الْمَجْنُونِ حَتَّى يُكْشَفَ عَنْهُ» فَخَلَّى عَنْهَا عُمَرُ
A woman who was insane was brought to Sayyiduna Umar (may Allah be pleased with him) and she had committed adultery. Sayyiduna Ali (may Allah be pleased with him) argued using the hadith of the Prophet (peace and blessings be upon him) and saved her from the prescribed punishment.
Hadith 3258
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، خَالِدٌ عَنْ أَبِي الضُّحَى، عَنْ عَلِيٍّ، بِنَحْوِ ذَلِكَ.
It is also narrated in the same manner from Sayyiduna Ali (may Allah be pleased with him).
Hadith 3259
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يُونُسُ، عَنِ الْحَسَنِ، عَنْ عُمَرَ، وَعَلِيٍّ، بِنَحْوِ ذَلِكَ
It is also narrated in the same manner from Sayyiduna Umar and Ali (may Allah be pleased with them both).
Hadith 3260
أَخْبَرَنَا سَعِيدٌ، نا أَبُو عَوَانَةَ، عَنْ أَبِي بِشْرٍ، عَنْ أَبِي الضُّحَى، قَالَ: جَاءَتِ امْرَأَةٌ إِلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ فَقَالَتْ: إِنِّي زَنَيْتُ فَرَدَّدَهَا حَتَّى أَقَرَّتْ أَوْ شَهِدَتْ أَرْبَعَ مَرَّاتٍ، ثُمَّ أَمَرَ بِرَجْمِهَا فَقَالَ لَهُ عَلِيٌّ: «سَلْهَا مَا زِنَاهَا فَلَعَلَّ لَهَا عُذْرًا؟» فَسَأَلَهَا، فَقَالَتْ: إِنِّي خَرَجْتُ فِي إِبِلِ أَهْلِي، وَلَنَا خَلِيطٌ، فَخَرَجَ فِي إِبِلِهِ فَحَمَلْتُ مَعِي مَاءً، وَلَمْ يَكُنْ فِي إِبِلِي لَبَنٌ، وَحَمَلَ خَلِيطِي مَاءً، وَمَعَهُ فِي إِبِلِهِ لَبَنٌ، فَنَفِدَ مَائِي فَاسْتَسْقَيْتُهُ، فَأَبَى أَنْ يَسْقِيَنِي حَتَّى أُمْكِنَهُ مِنْ نَفْسِي، فَأَبَيْتُ، فَلَمَّا كَادَتْ نَفْسِي تَخْرُجُ أَمْكَنْتُهُ، فَقَالَ عَلِيٌّ: " اللَّهُ أَكْبَرُ، أَرَى لَهَا عُذْرًا {فَمَنِ اضْطُرَّ غَيْرَ بَاغٍ وَلَا عَادٍ فَلَا إِثْمَ عَلَيْهِ} [البقرة: 173] " فَخَلَّى سَبِيلَهَا
A woman came to Sayyiduna Umar bin Khattab (may Allah be pleased with him) and confessed to adultery. He sent her back several times, but when she testified four times, he ordered the punishment of stoning. Sayyiduna Ali (may Allah be pleased with him) said: "Find out the reason from her, perhaps there is an excuse." Upon inquiry, she said that she was compelled to commit the sin due to extreme thirst. Sayyiduna Ali (may Allah be pleased with him) said: "Allahu Akbar, she has an excuse, and there is no sin upon her." Thus, she was released.
Hadith 3261
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا حَجَّاجٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، «أَنَّهُ كَانَ لَا يَرَى بَأْسًا أَنْ يَتَسَرَّى الْعَبْدُ إِذَا أَذِنَ لَهُ مَوْلَاهُ»
Sayyiduna Ibn Umar (may Allah be pleased with them both) did not see any harm in a slave establishing relations with a slave woman with the permission of his master.
Hadith 3262
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يُونُسُ، وَمَنْصُورٌ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ لَا يَرَى بِذَلِكَ بَأْسًا
Hasan al-Basri (may Allah have mercy on him) also considered it permissible for a slave to have relations with a slave woman.
Hadith 3263
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا الْحَجَّاجُ، عَنِ الْعَبَّاسِ بْنِ عُبَيْدِ اللَّهِ بْنِ عَبَّاسٍ، عَنْ عَمِّهِ ابْنِ عَبَّاسٍ «أَنَّهُ أَذِنَ لِغُلَامٍ لَهُ أَنْ يَتَسَرَّى، فَاشْتَرَى ثَلَاثَ جِوَارٍ ثَمَنُ أَلْفَيْنِ أَلْفَيْنِ»
Sayyiduna Ibn Abbas (may Allah be pleased with them both) bought three slave women for his servant so that he could have relations with them.
Hadith 3264
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا أَبُو الزُّبَيْرِ، عَنْ أَبِي مَعْبَدٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّهُ قَالَ لِغُلَامٍ لَهُ: «لَكَ فُلَانَةُ - لِأَمَةٍ لَهُ - فَاتَّخِذْهَا»
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said to his servant: "This slave-girl is for you; take her as your wife."
Hadith 3265
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا زَكَرِيَّا بْنُ يُونُسَ، شَكَّ الصَّائِغُ، عَنِ الشَّعْبِيِّ «أَنَّهُ كَانَ لَا يَرَى بِذَلِكَ بَأْسًا أَنْ يَتَسَرَّى الْعَبْدُ بِإِذْنِ مَوْلَاهُ»
Hazrat Sha'bi (may Allah have mercy on him) considered the relationship of a slave with a slave-girl to be permissible with the permission of the master.
Hadith 3266
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا أَبُو بِشْرٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ غُلَامًا لَهُ اشْتَرَى جَارِيَتَيْنِ، فَكَانَ يُصِيبُ مِنْهُمَا، وَعَلِمَ بِذَلِكَ ابْنُ عُمَرَ فَأَقَرَّهُ «
The slave of Sayyiduna Ibn Umar (may Allah be pleased with them both) bought two slave women and had relations with them. When Ibn Umar (may Allah be pleased with them both) came to know of it, he allowed it to continue.
Hadith 3267
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يُونُسُ، عَنِ ابْنِ سِيرِينَ أَنَّهُ» يُحِبُّ أَنْ يَكُونَ تَزْوِيجًا "
Hazrat Ibn Sirin (may Allah have mercy on him) considered marriage preferable for a slave.
Hadith 3268
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، أَنَّهُ كَانَ يَقُولُ ذَلِكَ
Ibrahim Nakha'i (may Allah have mercy on him) also used to say this.
Hadith 3269
أَخْبَرَنَا سَعِيدٌ، نا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَبِي عَبْدِ اللَّهِ الشَّقَرِيِّ، عَنْ إِبْرَاهِيمَ، قَالَ: «يُكْرَهُ لِلْعَبْدِ أَنْ يَتَسَرَّى»
Ibrahim Nakha'i (may Allah have mercy on him) said: "It is disliked for a slave to have relations with a slave woman."
