Hadith 3210
أَخْبَرَنَا سَعِيدٌ، نا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، أَخْبَرَنِي عُمَيْرُ بْنُ نُمَيْرٍ الْهَمْدَانِيُّ، قَالَ: سَمِعْتُ ابْنَ عُمَرَ، سُئِلَ عَنْ أَمَةٍ بَيْنَ رَجُلَيْنِ وَطِئَهَا أَحَدُهُمَا، قَالَ: «هُوَ خَائِنٌ لَا حَدَّ عَلَيْهِ»
It was asked to Sayyiduna Ibn Umar (may Allah be pleased with them both) that if a slave girl is between two men and one of them has intercourse with her, he said: "He is a betrayer, but there is no hadd (prescribed punishment)."
Hadith 3211
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، نا دَاوُدُ بْنُ أَبِي هِنْدَ، قَالَ: سَمِعْتُ سَعِيدَ بْنَ الْمُسَيِّبِ، يَقُولُ: «لَا حَدَّ عَلَيْهِ، وَيُضْرَبُ مِائَةَ سَوْطٍ وَتُقَوَّمُ عَلَيْهِ»
Hazrat Saeed bin Musayyib (may Allah have mercy on him) said: "There is no hadd (fixed punishment) for this, but one hundred lashes will be given and the price of the slave-girl will also be paid."
Hadith 3212
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يُونُسُ، عَنِ الْحَسَنِ، وَمُغِيرَةَ، عَنْ إِبْرَاهِيمَ، أَنَّهُمَا قَالَا: «لَا حَدَّ عَلَيْهِ وَتُقَوَّمُ عَلَيْهِ إِنْ حَبِلَتْ»
Hasan al-Basri and Ibrahim al-Nakha'i, may Allah have mercy on them, said: "There is no hadd; if pregnancy occurs, then compensation will also be obligatory."
Hadith 3213
نا هُشَيْمٌ، أنا مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ، قَالَ: «إِنْ حَبِلَتْ قُوِّمَتْ عَلَيْهِ، وَإِنْ لَمْ تَحْبِلْ كَانَ عَلَيْهِ نِصْفُ عُقْرِهَا، وَكَانَتْ أَمَتَهُ عَلَى حَالِهَا»
Hazrat Sha'bi (may Allah have mercy on him) said: "If the slave-girl becomes pregnant, then the full price will be obligatory, otherwise half the price should be paid and the slave-girl will remain in her condition."
Hadith 3214
أَخْبَرَنَا سَعِيدٌ، نا يَزِيدُ بْنُ هَارُونَ، عَنِ الْحَجَّاجِ، عَنْ أَبِي مَعْبَدٍ، خَتَنِ الْحَكَمِ أَنَّ شُرَيْحًا «اخْتُصِمَ إِلَيْهِ فِي رَجُلَيْنِ بَيْنَهُمَا جَارِيَةٌ فَوَطِئَهَا أَحَدُهُمَا فَضَمَّنَهُ نِصْفَ الثَّمَنِ وَنِصْفَ الْعُقْرِ»
Qadi Shurayh (may Allah have mercy on him) gave a verdict between two men regarding a slave girl that the one who had intercourse with her is liable for half of her price and half of the compensation.
