بَابُ مَا جَاءَ فِي الرَّجُلِ إِذَا لَمْ يَجِدْ مَا يُنْفِقُ عَلَى امْرَأَتِهِ

Hadith 3199
أَخْبَرَنَا سَعِيدٌ، نا سُفْيَانُ، عَنْ أَبِي الزِّنَادِ، قَالَ: سَأَلْتُ سَعِيدَ بْنَ الْمُسَيِّبِ عَنِ الرَّجُلِ، لَا يَجِدُ مَا يُنْفِقُ عَلَى امْرَأَتِهِ أَيُفَرَّقُ بَيْنَهُمَا؟ قَالَ: «نَعَمْ» قُلْتُ: سُنَّةٌ؟ قَالَ: «سُنَّةٌ»
Hazrat Saeed bin Musayyib (may Allah have mercy on him) said: "If a man is unable to bear the expenses of his wife, then separation will be made between them; this is Sunnah."
Hadith 3200
أَخْبَرَنَا سَعِيدٌ، نا سُفْيَانُ، نا هُشَيْمٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، فِي الرَّجُلِ يَعْجِزُ عَنْ نَفَقَةِ امْرَأَتِهِ، قَالَ: «يُنْفِقُ عَلَيْهَا أَوْ يُفَرَّقُ بَيْنَهُمَا»
Hazrat Sa'id bin al-Musayyib (may Allah have mercy on him) said: "The man should provide maintenance or separation should be made between the two."
Hadith 3201
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، عَنْ مُطَرِّفٍ، عَنِ الشَّعْبِيِّ، قَالَ: «إِنْ وَجَدَ أَنْفَقَ، وَإِنْ لَمْ يَجِدْ لَمْ يُكَلَّفْ إِلَّا مَا يُطِيقُ»
Hazrat Sha'bi (may Allah have mercy on him) said: "If a man has (wealth), he should spend; if he does not have, then spending as much as possible is still obligatory."
Hadith 3202
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا أَشْعَثُ، عَنِ الشَّعْبِيِّ، أَنَّهُ قَالَ: يُنْفِقُ عَلَيْهَا أَوْ يُطَلِّقُهَا
Hazrat Sha'bi (may Allah have mercy on him) said: "The man should either spend (on her) or divorce (her)."
Hadith 3203
حَدَّثَنَا هُشَيْمٌ، أنا يُونُسُ، عَنِ الْحَسَنِ، قَالَ: يُنْفِقُ عَلَيْهَا أَوْ يُطَلِّقُهَا
Hasan al-Basri (may Allah have mercy on him) said: "A man should spend or divorce."
Hadith 3204
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، عَنِ ابْنِ شُبْرُمَةَ، قَالَ: إِنْ وَجَدَ أَنْفَقَ، وَإِنْ لَمْ يَجِدْ لَمْ يُكَلَّفْ مَا لَا يُطِيقُ
Hazrat Ibn Shubrumah (may Allah have mercy on him) said: "If the man has (means), he should spend; if he does not have, then he should not be burdened beyond his capacity."
Hadith 3205
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أَنَّ الْأَعْمَشَ، عَنِ الْمِنْهَالِ بْنِ عَمْرٍو، أَنَّ نُعَيْمَ بْنَ دَجَاجَةَ الْأَسَدِيَّ، طَلَّقَ امْرَأَتَهُ تَطْلِيقَتَيْنِ، ثُمَّ قَالَ لَهَا: هِيَ عَلَيْهِ حَرَجٌ فَكَتَبَ فِي ذَلِكَ إِلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ فَقَالَ: «أَمَا إِنَّهَا لَيْسَتْ بِأَهْوَنِهِنَّ»
Sayyiduna Umar (may Allah be pleased with him) said: "After a woman is called 'haraj' (a term of separation), divorce does not become easy."
Hadith 3206
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مَنْصُورٌ، عَنِ الْحَكَمِ بْنِ عُتَيْبَةَ، أَنَّ نُعَيْمًا طَلَّقَ امْرَأَتَهُ تَطْلِيقَتَيْنِ ثُمَّ قَالَ: هِيَ عَلَيْهِ حَرَجٌ، فَكَتَبَ فِي ذَلِكَ إِلَى عُمَرَ بْنِ الْخَطَّابِ، فَكَتَبَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ: «أَيَظُنُّ فُلَانٌ أَنَّ قَوْلَهُ هِيَ عَلَيْهِ حَرَجٌ أَهْوَنُ مِنْ تَطْلِيقَتَيْنِ؟ إِذَا أَتَاكُمْ كِتَابِي هَذَا فَفَرِّقُوا بَيْنَهُمَا»
Sayyiduna Umar (may Allah be pleased with him) wrote: "Saying 'Haraj' does not nullify the effect of two divorces; when my letter reaches you, separate the two."
Hadith 3207
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يُونُسُ بْنُ عُبَيْدٍ، عَنِ الْحَسَنِ، وَأنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، وَأنا مُطَرِّفٌ، عَنِ الشَّعْبِيِّ، قَالَ: «إِذَا طَلَّقَ الْعَجَمِيُّ بِلِسَانِهِ فَهُوَ جَائِزٌ»
Hasan al-Basri, Ibrahim al-Nakha'i, and al-Shu'bi, may Allah have mercy on them, said: "If a non-Arab pronounces divorce in his own language, it is valid."
Hadith 3208
أَخْبَرَنَا سَعِيدٌ، نا خَالِدٌ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، مِثْلَهُ وَزَادَ فِيهِ: طَلَاقُ كُلِّ قَوْمٍ بِلِسَانِهِمْ جَائِزٌ
Ibrahim Nakha'i (may Allah have mercy on him) further said: "Divorce given in the language of any nation is valid."
Hadith 3209
أَخْبَرَنَا سَعِيدٌ، نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ مُطَرِّفٍ، عَنِ الشَّعْبِيِّ، فِي الرَّجُلِ قَالَ لِامْرَأَتِهِ: بَهَشْتَمْ قَالَ: «هِيَ طَالِقٌ»
Hazrat Sha'bi (may Allah have mercy on him) said: "If a person says 'bahishtam' (you are in paradise) to his wife, then divorce will take place."
