Hadith 3169
أَخْبَرَنَا سَعِيدٌ، نا جَرِيرُ بْنُ عَبْدِ الْحَمِيدِ، عَنِ الْأَعْمَشِ، عَنِ الْمُسَيِّبِ بْنِ رَافِعٍ، عَنْ قَبِيصَةَ بْنِ جَابِرٍ الْأَسَدِيِّ، قَالَ: قَالَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ: «لَا أَجِدُ مُحِلًّا وَلَا مُحَلَّلًا لَهُ إِلَّا رَجَمْتُهُ»
Sayyiduna Umar bin Khattab (may Allah be pleased with him) said: "Whoever performs Halalah or has it performed, I will stone him."
Hadith 3170
أَخْبَرَنَا سَعِيدٌ، نا أَبُو مُعَاوِيَةَ، نا الْأَعْمَشُ، عَنِ الْمُسَيِّبِ بْنِ رَافِعٍ، عَنْ قَبِيصَةَ بْنِ جَابِرٍ، قَالَ: قَالَ عُمَرُ: «لَا أَجِدُ مُحِلًّا وَلَا مُحَلَّلًا لَهُ إِلَّا رَجَمْتُهُمَا»
Sayyiduna Umar (may Allah be pleased with him) said: "If a man or a woman performs halalah, I will have both of them stoned."
Hadith 3171
حَدَّثَنَا سَعِيدٌ، نا جَرِيرٌ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، قَالَ: إِذَا كَانَ نِيَّةُ إِحْدَى الثَّلَاثَةِ: الزَّوْجِ الْأَوَّلِ أَوِ الزَّوْجِ الْآخَرِ أَوِ الْمَرْأَةِ أَنَّهُ مُحَلِّلٌ، فَنِكَاحُ هَذَا الْأَخِيرِ بَاطِلٌ، وَلَا تَحِلُّ لِلْأَوَّلِ "
Ibrahim (may Allah have mercy on him) said: "If any one of the three intends halalah, that is, the first husband, the second husband, or the woman, then the second marriage is invalid and the woman is not lawful for the first husband."
Hadith 3172
أَخْبَرَنَا سَعِيدٌ نا هُشَيْمٌ، نا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ: إِذَا هَمَّ أَحَدُ الثَّلَاثَةِ بِالتَّحْلِيلِ فَقَدْ أُفْسِدَ.
Hasan al-Basri, may Allah have mercy on him, said: "If any one of the three has the intention of halalah, then the marriage becomes invalid."
Hadith 3173
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، أَنَّهُ كَانَ يَقُولُ ذَلِكَ
There is a similar narration from Ibrahim (may Allah have mercy on him).
Hadith 3174
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا خَالِدٌ الْحَذَّاءُ، نا رَجُلٌ، عَنِ ابْنِ عُمَرَ، أَنَّهُ قَالَ: «لُعِنَ الْحَالُّ، وَالْمُحَلَّلُ لَهُ، وَالْمُحَلَّلَةُ»
Sayyiduna Ibn Umar (may Allah be pleased with them both) said: “Curse is upon the one who performs Halalah, the one for whom it is performed, and the woman for whom Halalah is done.”
Hadith 3175
أَخْبَرَنَا سَعِيدٌ، نا مُحَمَّدُ بْنُ بَسِيطٍ الْبَصْرِيُّ، قَالَ: سَأَلْتُ بَكْرَ بْنَ عَبْدِ اللَّهِ الْمُزَنِيَّ عَنْ رَجُلٍ يُطَلِّقُ امْرَأَتَهُ الْبَتَّةَ قَالَ: «لُعِنَ الْحَالُّ، وَالْمُحَلَّلُ لَهُ، أُولَئِكَ كَانُوا يُسَمَّوْنَ فِي الْجَاهِلِيَّةِ التَّيْسَ الْمُسْتَعَارَ»
Hazrat Bakr bin Abdullah Muzani (may Allah have mercy on him) said: "Curse is upon the one who performs Halalah and the one for whom it is performed; in the days of ignorance, they used to be called a borrowed goat."
Hadith 3176
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، نا يُونُسُ بْنُ عُبَيْدٍ، عَنِ ابْنِ سِيرِينَ أَنَّ رَجُلًا مِنْ أَهْلِ الْمَدِينَةِ طَلَّقَ امْرَأَتَهُ ثَلَاثًا، وَنَدِمَ وَبَلَغَ ذَلِكَ مِنْهُ مَا شَاءَ اللَّهُ، فَقِيلَ لَهُ: انْظُرْ رَجُلًا يُحِلُّهَا لَكَ، وَكَانَ فِي الْمَدِينَةِ رَجُلٌ مِنْ أَهْلِ الْبَادِيَةِ لَهُ حَسَبٌ أُقْحِمَ إِلَى الْمَدِينَةِ، وَكَانَ مُحْتَاجًا لَيْسَ لَهُ شَيْءٌ يَتَوَارَى بِهِ إِلَّا رُقْعَتَيْنِ , رُقْعَةٌ يُوَارِي بِهَا فَرْجَهُ، وَرُقْعَةٌ يُوَارِي بِهَا دُبُرَهُ، فَأَرْسَلُوا إِلَيْهِ، فَقَالُوا لَهُ: هَلْ لَكَ أَنْ نُزَوِّجَكَ امْرَأَةً فَتَدْخُلَ عَلَيْهَا، فَتَكْشِفَ عَنْهَا خِمَارَهَا ثُمَّ تُطَلِّقَهَا وَنَجْعَلَ لَكَ عَلَى ذَلِكَ جُعْلًا، قَالَ: نَعَمْ: فَزَوَّجُوهُ فَدَخَلَ عَلَيْهَا، وَهُوَ شَابٌّ صَحِيحُ الْحَسَبِ، فَلَمَّا دَخَلَ عَلَى الْمَرْأَةِ فَأَصَابَهَا فَأَعْجَبَهَا، فَقَالَتْ لَهُ: أَعِنْدَكَ خَبَرٌ؟ قَالَ: نَعَمْ، هُوَ حَيْثُ تُحِبِّينَ، جَعَلَهُ اللَّهُ فِدَاءَهَا، قَالَتْ: فَانْظُرْ لَا تُطَلِّقْنِي بِشَيْءٍ، فَإِنَّ عُمَرَ لَنْ يُكْرِهَكَ عَلَى طَلَاقِي: فَلَمَّا أَصْبَحَ لَمْ يَكَدْ أَنْ يَفْتَحَ الْبَابَ حَتَّى كَادُوا أَنْ يَكْسِرُوهُ، فَلَمَّا دَخَلُوا عَلَيْهِ، قَالُوا: طَلِّقْ، قَالَ: الْأَمْرُ إِلَى فُلَانَةَ، قَالَ: فَقَالُوا لَهَا: قُولِي لَهُ أَنْ يُطَلِّقَكِ، قَالَتْ: إِنِّي أَكْرَهُ أَنْ لَا يَزَالَ يَدْخُلُ عَلَيَّ، فَارْتَفَعُوا إِلَى عُمَرَ بْنِ الْخَطَّابِ فَأَخْبَرُوهُ، فَقَالَ لَهُ: «إِنْ طَلَّقْتَهَا لَأَفْعَلَنَّ بِكَ» وَرَفَعَ يَدَيْهِ وَقَالَ: «اللَّهُمَّ أَنْتَ رَزَقْتَ ذَا الرُّقْعَتَيْنِ إِذْ بَخِلَ عَلَيْهِ عُمَرُ»
It is narrated from Hazrat Ibn Sirin (may Allah have mercy on him) that a man from Madinah gave his wife three divorces and became very remorseful. People said: Find someone to perform halalah. So, a poor young villager was married to her, but when he saw the woman, he liked her and refused to divorce her. The woman was also pleased. When people complained to Sayyiduna Umar (may Allah be pleased with him), he said: "If he divorces her, then nothing (can be said), and if he does not, then Allah has provided sustenance to the poor man which Umar tried to prevent."
Hadith 3177
أَخْبَرَنَا سَعِيدٌ، نا جَرِيرٌ، عَنْ مُغِيرَةَ، قَالَ: قُلْتُ لِإِبْرَاهِيمَ هَلْ كَانَ ابْنُ الْخَطَّابِ حَلَّلَ بَيْنَ الرَّجُلِ وَامْرَأَتِهِ؟ فَقَالَ: لَا، إِنَّمَا كَانَتْ لِرَجُلٍ امْرَأَةٌ ذَاتُ حَسَبٍ وَمَالٍ، فَطَلَّقَهَا زَوْجُهَا تَطْلِيقَةً أَوْ ثِنْتَيْنِ، فَبَانَتْ مِنْهُ، ثُمَّ إِنَّ عُمَرَ تَزَوَّجَهَا فَهُنِّئَ بِهَا، وَقَالُوا: لَوْلَا أَنَّهَا امْرَأَةٌ لَيْسَ بِهَا وَلَدٌ، فَقَالَ عُمَرُ: «وَمَا بَرَكَتُهُنَّ إِلَّا لِأَوْلَادِهِنَّ» فَطَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا، فَتَزَوَّجَهَا زَوْجُهَا الْأَوَّلُ.
Ibrahim (may Allah have mercy on him) said: Sayyiduna Umar (may Allah be pleased with him) did not arrange halalah between any husband and wife, rather a man had divorced his wife, Sayyiduna Umar (may Allah be pleased with him) married her, then divorced her without consummation, so her first husband was able to marry her again.
Hadith 3178
أَخْبَرَنَا سَعِيدٌ، نا جَرِيرٌ، عَنْ مُغِيرَةَ، عَنْ أَبِي مَعْشَرٍ، قَالَ: كَانَ زَوْجُهَا الْأَوَّلُ الْحَارِثَ بْنَ أَبِي رَبِيعَةَ
According to Hazrat Abu Ma'shar (may Allah have mercy on him), the first husband of that woman was Harith bin Abi Rabi'ah.
Hadith 3179
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ، فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثًا فَتَزَوَّجَتْ عَبْدًا بِغَيْرِ إِذْنِ مَوَالِيهِ فَدَخَلَ بِهَا، قَالَ: «لَيْسَ بِزَوْجٍ»
It is narrated from Hazrat Sha'bi (may Allah have mercy on him) that if a woman, after being given three divorces, marries a slave without the permission of his masters and consummates the marriage, then that marriage is not valid.
Hadith 3180
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مَنْصُورٌ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ: " لَيْسَ بِزَوْجٍ، قَالَ هُشَيْمٌ: وَهُوَ الْقَوْلُ
Hasan al-Basri (may Allah have mercy on him) used to say that such a marriage is not valid.
Hadith 3181
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الْحَكَمِ، نا مَنْصُورٌ، عَنِ الْحَسَنِ، فِي امْرَأَةٍ طَلَّقَهَا زَوْجُهَا ثَلَاثًا، فَتَزَوَّجَتْ غُلَامًا لَمْ يَحْتَلِمْ فَجَامَعَهَا، ثُمَّ طَلَّقَهَا قَالَ: «لَيْسَ بِزَوْجٍ»
It is narrated from Hasan al-Basri (may Allah have mercy on him) that if a woman marries an underage slave and consummates the marriage, that marriage will not be considered valid.
Hadith 3182
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، نا مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الْحَكَمِ بْنِ عُتَيْبَةَ، أَنَّهُ قَالَ: " هُوَ زَوْجٌ وَتَحِلُّ لِلْأَوَّلِ إِنْ شَاءَ
Hazrat Hakam bin Utaybah (may Allah have mercy on him) used to say that he will be the husband and the woman will become permissible for the first husband if he wishes.
Hadith 3183
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، نا مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ، فِي عَبْدٍ تَزَوَّجَ بِغَيْرِ إِذْنِ مَوْلَاهُ فَطَلَّقَهَا قَالَ: «لَا يَجُوزُ طَلَاقُهُ»
It is narrated from Hazrat Sha'bi (may Allah have mercy on him) that if a slave marries and divorces without the permission of his master, his divorce does not take effect.
Hadith 3184
أَخْبَرَنَا سَعِيدٌ، ثنا هُشَيْمٌ، أنا مَنْصُورٌ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ: لَا يَجُوزُ طَلَاقُهُ
Hasan al-Basri (may Allah have mercy on him) used to say that a divorce given by a slave without permission is not valid.
Hadith 3185
أَخْبَرَنَا سَعِيدٌ، نا أَبُو مُعَاوِيَةَ، نا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ، عَنِ الْحَارِثِ، عَنْ عَلِيٍّ، رَضِيَ اللَّهُ عَنْهُ قَالَ: «لَعَنَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ الْمُحَلِّلَ وَالْمُحَلَّلَ لَهُ»
It is narrated from Sayyiduna Ali (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "The curse of Allah is upon both the muhallil (the one who makes a woman lawful for her former husband by marrying and divorcing her) and the muhallal lahu (the one for whom it is done)."
