بَابُ الْمَرْأَةِ تُطَلَّقُ ثَلَاثًا فَتَزَوَّجَتْ غَيْرَهُ فَيُطَلِّقُهَا قَبْلَ أَنْ يَمَسَّهَا هَلْ تَرْجِعُ إِلَى الْأَوَّلِ

Hadith 3161
حَدَّثَنَا سَعِيدُ بْنُ مَنْصُورٍ، ثنا هُشَيْمٌ، أَخْبَرَنِي يَحْيَى بْنُ أَبِي إِسْحَاقَ الْحَضْرَمِيُّ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، عَنْ عَبْدِ اللَّهِ بْنِ عَبَّاسٍ، أَنَّ الرُّمَيْصَاءَ أَوِ الرُّمَيْضَاءَ أَتَتْ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ تَشْكُو زَوْجَهَا، وَتَزْعُمُ أَنَّهُ لَا يَصِلُ إِلَيْهَا، فَلَمْ يَلْبَثْ أَنْ جَاءَ زَوْجُهَا فَقَالَ: إِنَّهَا كَاذِبَةٌ، إِنَّهْ يَصِلُ إِلَيْهَا، وَلَكِنَّهَا تُرِيدُ أَنْ تَرْجِعَ إِلَى زَوْجِهَا الْأَوَّلِ، فَقَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «لَيْسَ ذَاكَ لَهَا حَتَّى تَذُوقَ عُسَيْلَتَهُ»
It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them) that Sayyida Rumaisa or Rumaida came to the Prophet (peace and blessings of Allah be upon him) and complained about her husband that he does not come to her. After a short while, the husband also arrived and said that she is lying; she wants to return to her first husband. The Prophet (peace and blessings of Allah be upon him) said: "It is not permissible for her until the second husband has relations with her."
Hadith 3162
حَدَّثَنَا سَعِيدٌ، نا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ عَائِشَةَ، أَنَّ امْرَأَةَ رِفَاعَةَ الْقُرَظِيِّ أَتَتْ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَتْ: يَا رَسُولَ اللَّهِ إِنِّي كُنْتُ عِنْدَ رِفَاعَةَ فَطَلَّقَنِي وَبَتَّ طَلَاقِي، فَتَزَوَّجَنِي ابْنُ الزُّبَيْرِ، وَمَا مَعَهُ إِلَّا مِثْلُ هُدْبَةِ الثَّوْبِ، فَتَبَسَّمَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «أَتُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ؟ لَا، حَتَّى تَذُوقِي عُسَيْلَتَهُ وَيَذُوقَ عُسَيْلَتَكِ» فَنَادَى خَالِدُ بْنُ سَعِيدٍ وَهُوَ بِالْبَابِ: أَلَا تَسْمَعُ يَا أَبَا بَكْرٍ مَا تَجْهَرُ هَذِهِ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ؟
It is narrated from Sayyidah Aisha (may Allah be pleased with her) that the wife of Rifa'ah al-Qurazi came to the Noble Prophet (peace and blessings be upon him) and said: "I was married to Rifa'ah, he divorced me with three divorces and separated from me. Then I married Ibn Zubair, but there has been no relation with him." The Noble Prophet (peace and blessings be upon him) smiled and said: "Do you want to go back to Rifa'ah? No, not until the second husband establishes relations with you and you with him."
Hadith 3163
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، عَنْ عَلِيٍّ، أَنَّهُ قَالَ فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثًا، فَتَزَوَّجَتْ رَجُلًا بَعْدَهُ، فَطَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا، قَالَ عَلِيٌّ: «لَا تَرْجِعُ إِلَى الْأَوَّلِ حَتَّى يَقْرَبَهَا الْآخَرُ»
Sayyiduna Ali (may Allah be pleased with him) said: "If a man gives his wife three divorces and she marries another man, if the second husband divorces her before having relations with her, it is not permissible for her to return to the first husband until the second husband has had relations with her."
Hadith 3164
حَدَّثَنَا سَعِيدٌ، نا ذَوَّادُ بْنُ عُلْبَةَ، عَنْ مُطَرِّفٍ، عَنِ الشَّعْبِيِّ، قَالَ: رَأَيْتُ عَلِيًّا، وَسَمِعْتُ مِنْهُ حَدِيثًا سَمِعْتُهُ سُئِلَ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ، فَتَزَوَّجَهَا رَجُلٌ بَعْدَهُ، فَطَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا، فَأَخْرَجَ ذِرَاعَهُ، وَبِهَا رَقَطٌ قَالَ: «لَا، حَتَّى يَهُزَّهَا»
It is narrated from Hazrat Aamir Sha'bi (may Allah have mercy on him) that Sayyiduna Ali (may Allah be pleased with him) was asked, and he gestured with his arm and said: "No, not until the second husband establishes marital relations with her."
Hadith 3165
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، عَنْ عَائِشَةَ، أَنَّهَا قَالَتْ: «حَتَّى يَذُوقَ عُسَيْلَتَهَا وَتَذُوقَ عُسَيْلَتَهُ»
Lady Aisha (may Allah be pleased with her) said: "Until he establishes relations with her and she with him."
Hadith 3166
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا دَاوُدُ بْنُ أَبِي هِنْدَ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، قَالَ: " أَمَّا النَّاسُ فَيَقُولُونَ حَتَّى يُجَامِعَهَا، وَأَمَّا أَنَا فَإِنِّي أَقُولُ: إِذَا تَزَوَّجَهَا تَزْوِيجًا صَحِيحًا لَا يُرِيدُ بِذَلِكَ إِحْلَالًا لَهَا، فَلَا بَأْسَ أَنْ يَتَزَوَّجَهَا الْأَوَّلُ "
Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) said: "The common people say that when the second husband establishes marital relations, but I say that if the second marriage is conducted properly, without any intention of halalah, then it is permissible for the first husband to marry (her) again."
Hadith 3167
حَدَّثَنَا سَعِيدٌ، أنا هُشَيْمٌ، أنا حُصَيْنٌ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، أَنَّهُ قَالَ: «لَيْسَ لِلْأَوَّلِ أَنْ يَتَزَوَّجَهَا حَتَّى يُجَامِعَهَا الْأَخِيرُ»
Hazrat Masruq (may Allah have mercy on him) said: "It is not permissible for the first husband to marry (her) until the second husband has established marital relations with her."
Hadith 3168
حَدَّثَنَا سَعِيدٌ، نا أَبُو شِهَابٍ، نا يَحْيَى بْنُ سَعِيدٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثًا فَأَصَابَ مِنْهَا كُلَّ شَيْءٍ غَيْرَ أَنَّهُ لَمْ يَمَسَّهَا فَقَالَ ابْنُ عُمَرَ: «لَا، حَتَّى يَمَسَّهَا» فَأَعَادَ عَلَيْهِ الْحَدِيثَ، فَقَالَ: «لَا حَتَّى يَمَسَّهَا» فَأَعَادَ عَلَيْهِ الْحَدِيثَ، فَقَالَ: «لَا، حَتَّى يَأْخُذَ بِرِجْلِهَا»
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that a man gave his wife three divorces and permitted everything except intercourse. Sayyiduna Ibn Umar (may Allah be pleased with them both) said: "No, not until he establishes relations with her."
