Hadith 3151
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنِ الشَّيْبَانِيِّ، عَنِ السَّفَّاحِ، عَنْ دَاوُدَ بْنِ كُرْدُوسٍ، أَنَّ امْرَأَةً مِنْ بَنِي تَمِيمٍ كَانَتْ تَحْتَ رَجُلٍ مِنْ بَنِي تَغْلِبَ فَأَسْلَمَتْ، فَقَالَ عُمَرُ: «إِمَّا أَنْ تُسْلِمَ، وَإِمَّا أَنْ نَنْزِعَهَا عَنْكَ» فَقَالَ: لَا تُحَدِّثُ الْعَرَبُ أَنِّي أَسْلَمْتُ لِبُضْعِ امْرَأَةٍ، فَنَزَعَهَا مِنْهُ
It is narrated from Hazrat Dawood bin Kurdus, may Allah have mercy on him, that Sayyiduna Umar, may Allah be pleased with him, said: "A woman who becomes Muslim and her husband is Christian, she will be separated from him."
Hadith 3152
حَدَّثَنَا سَعِيدٌ، نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ خَالِدٍ الْحَذَّاءِ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، فِي نَصْرَانِيٍّ تَحْتَهُ نَصْرَانِيَّةٌ، فَأَسْلَمَتْ، قَالَ: " يُفَرَّقُ بَيْنَهُمَا، لَا يَمْلِكُ نِسَاءَنَا غَيْرُنَا، نَحْنُ عَلَى النَّاسِ، وَالنَّاسُ لَيْسَ عَلَيْنَا؛ وَذَلِكَ لِأَنَّ اللَّهَ عَزَّ وَجَلَّ يَقُولُ: {لِيُظْهِرَهُ عَلَى الدِّينِ كُلِّهِ} [التوبة: 33] "
Sayyiduna Ibn Abbas (may Allah be pleased with them) said that if the wife of a Christian man, who is a Christian woman, accepts Islam, then separation will occur between them because Allah Almighty has said: «لِيُظْهِرَهُ عَلَى الدِّينِ كُلِّهِ».
Hadith 3153
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يُونُسُ، وَمَنْصُورٌ، عَنِ الْحَسَنِ، قَالَ: «يُفَرَّقُ بَيْنَهُمَا»
Hasan al-Basri, may Allah have mercy on him, says: "Separation should be made between the two."
Hadith 3154
حَدَّثَنَا سَعِيدٌ، أنا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ، عَنْ أَيُّوبَ، عَنِ ابْنِ سِيرِينَ، قَالَ: قَالَ عُمَرُ «تُخَيَّرُ»
According to Hazrat Ibn Sirin (may Allah have mercy on him), Sayyiduna Umar (may Allah be pleased with him) said: "The woman should be given the choice."
Hadith 3155
حَدَّثَنَا سَعِيدٌ، أَنَا هُشَيْمٌ، أَنَا مُطَرِّفٌ، وَعُثْمَانُ الْبَتِّيُّ، عَنِ الشَّعْبِيِّ، عَنْ عَلِيٍّ، رَضِيَ اللهُ عَنْهُ أَنَّهُ كَانَ يَقُولُ: « هُوَ أَحَقُّ بِهَا مَا لَمْ يُخْرِجْهَا مِنْ دَارِ الْهِجْرَةِ » .
Sayyiduna Ali (may Allah be pleased with him) used to say: "The husband has more right over his wife as long as he does not take her out of the abode of migration."
Hadith 3157
حَدَّثَنَا سَعِيدٌ، أنا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ مُطَرِّفٍ، عَنِ الشَّعْبِيِّ، قَالَ: «تَقَرُّ عِنْدَهُ؛ لِأَنَّ لَهُ عَهْدًا» قَالَ سَعِيدٌ: بِئْسَمَا قَالَ
Hazrat Sha'bi (may Allah have mercy on him) says: "She will remain with her husband because she has a contract with him." Then Sa'id says: "This statement is not well said."
Hadith 3158
حَدَّثَنَا سَعِيدٌ، ثنا خَالِدٌ، ثنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، وَالشَّعْبِيِّ، مِثْلَهُ
It is narrated from Ibrahim and Hazrat Amir Sha'bi, may Allah have mercy on them both, that both said: "This is what was said."
Hadith 3159
حَدَّثَنَا سَعِيدٌ، أنا أَبُو عَوَانَةَ، عَنْ حَسَنِ بْنِ عِمْرَانَ، عَنْ رَجُلٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبْزَى، أَنَّ هَانِئَ بْنَ قَبِيصَةَ، أَسْلَمَتِ امْرَأَتُهُ قَبْلَهُ، فَخَشِيَ أَنْ يُفَرَّقَ بَيْنَهُمَا، فَلَقِيَ أَبَا سُفْيَانَ بْنَ حَرْبٍ فَكَلَّمَهُ أَنْ يُكَلِّمَ لَهُ عُمَرَ، فَقَالَ أَبُو سُفْيَانَ: «هُنَيُّ ذَهَبَ الزَّمَانُ الَّذِي عَهِدْتَنَا عَلَيْهِ، وَاللَّهِ لَوْ بَلَغَنِي أَنَّ لِيَ ابْنًا بِالْعِرَاقِ دَرَجَ عَلَى أَهْلِهِ طَرَفًا مَا يَمْنَعُنِي أَنْ أَدَّعِيَهُ إِلَّا فَرَقًا مِنْ عُمَرَ، وَمَا يُكَلَّمُ فِي ذَاتِ اللَّهِ»
It is narrated from Hazrat Abdur Rahman bin Abzi (may Allah be pleased with him) that Hani bin Qabeesah's wife accepted Islam before him, and he feared that separation might be made between them. So he went to Sayyiduna Abu Sufyan bin Harb (may Allah be pleased with him) so that he might speak to Sayyiduna Umar (may Allah be pleased with him). Sayyiduna Abu Sufyan said: "Hani, that time has passed which we were upon. By Allah, if I even knew that I had a son in Iraq who was growing up among the people of Iraq, I would have acknowledged him as my son except for the fear of Umar. There is no intercession in the matter of Allah."
Hadith 3160
حَدَّثَنَا سَعِيدٌ، نا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ، أنا ابْنُ أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ " النَّصْرَانِيَّةُ تُسْلِمُ تَحْتَ النَّصْرَانِيِّ؟ قَالَ: «إِنْ أَسْلَمَ زَوْجُهَا وَهِيَ فِي الْعِدَّةِ فَهُوَ أَحَقُّ بِهَا»
It is narrated from Hazrat Mujahid (may Allah have mercy on him), if a Christian woman becomes Muslim and her husband remains Christian, he said: "If she becomes Muslim during the waiting period ('iddah), then her husband has more right to his wife."
