بَابٌ أُمُّ الْوَلَدِ يَكُونُ لَهَا مِنْ سَيِّدِهَا أَوْلَادٌ فَيَمُوتُ عَنْهَا فَتُزَوَّجُ فَتَلِدُ مِنْهُ أَوْلَادًا، ثُمَّ يَمُوتُ بَعْضُ وَلَدِهَا مِنَ السَّيِّدِ
Chapter: Umm al-Walad who has children from her master, then he dies, then she marries and bears children from him, then some of her children from the master die

Hadith 3132
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَشْعَثُ بْنُ سَوَّارٍ، قَالَ: نا الشَّعْبِيُّ، أَنَّ رَجُلًا مِنْ بَنِي هَاشِمٍ كَانَتْ لَهُ أُمُّ وَلَدٍ وَلَدَتْ مِنْهُ، وَمَاتَ الْهَاشِمِيُّ فَتَزَوَّجَتْ أُمُّ وَلَدِهِ رَجُلًا فَدَخَلَ بِهَا، فَوَلَدَتْ مِنْهُ أَوْلَادًا، فَمَاتَ ابْنُ الْهَاشِمِيِّ مِنْهَا، فَشَهِدَهُ الْحَسَنُ بْنُ عَلِيٍّ، فَلَمَّا فَرَغَ مِنْ دَفْنِهِ قَالَ لِزَوْجِ أَمَتِهِ: «إِنَّكَ رَاشِدٌ، إِنَّ هَذَا الْغُلَامَ قَدْ مَاتَ، وَإِنَّهُ لَيْسَ لَكَ أَنْ تَسْتَلْحِقَ سَهْمًا لَيْسَ لَكَ، وَإِنِّي آمُرُكَ أَنْ تَعْتَزِلَ امْرَأَتَكَ»
Hasan bin Ali (may Allah be pleased with them both) said to a man: "When his slave-girl's son died, he said to him: 'Separate from your slave-girl, so that you do not become an heir to something that is not rightfully yours.'"
Hadith 3133
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، فِي عَبْدٍ مَمْلُوكٍ تَحْتَهُ امْرَأَةٌ حُرَّةٌ، وَلَهُ أَخٌ حُرٌّ، فَمَاتَ أَخُوهُ وَلَمْ يَدَعْ وَارِثًا قَالَ: «يُمْسِكُ الْعَبْدُ عَنِ امْرَأَتِهِ حَتَّى يَعْلَمَ أَبِهَا حَمْلٌ أَوْ لَيْسَ بِهَا؟ فَإِنْ كَانَ بِهَا حَمْلٌ وَرِثَ وَلَدُهَا عَمَّهُ» وَكَانَ يَقُولُ فِي رَجُلٍ عِنْدَهُ امْرَأَةٌ لَهَا وَلَدٌ مِنْ غَيْرِهِ فَمَاتَ وَلَدُهَا ذَاكَ، قَالَ: «يُمْسِكُ الرَّجُلُ عَنِ امْرَأَتِهِ حَتَّى يَعْلَمَ أَبِهَا حَمْلٌ أَمْ لَا؟»
Hasan (may Allah have mercy on him) said: "When a slave marries a free woman and her free brother dies, then the slave should refrain from his wife until it is known whether she is pregnant or not. If she is pregnant, then the child will be the heir of his uncle."
Hadith 3134
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، عَنِ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، قَالَ: «إِذَا كَانَ لِامْرَأَةِ الرَّجُلِ وَلَدٌ مِنْ غَيْرِهِ فَمَاتَ فَلْيُمْسِكْ مِنْ جِمَاعِهَا حَتَّى تَحِيضَ»
Ibrahim (may Allah have mercy on him) said: "If a man's wife has a child from someone else and that child dies, then the man should not have intercourse with his wife until she becomes pure from menstruation."
