Hadith 3048
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، وَأنا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، قَالَ: «كُلُّ يَمِينٍ مَنَعَتْ جِمَاعًا فَهِيَ إِيلَاءٌ» . حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَشْعَثُ، عَنِ الشَّعْبِيِّ، أَنَّهُ كَانَ يَقُولُ ذَلِكَ أَيْضًا
Ibrahim (may Allah have mercy on him) said: "Every oath that prevents intercourse is Ilaa." Al-Sha'bi (may Allah have mercy on him) said the same.
Hadith 3049
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، أنا مُغِيرَةُ، قَالَ: سَأَلْتُ إِبْرَاهِيمَ عَنْ رَجُلٍ رَفَعَ امْرَأَتَهُ إِلَى قَوْمٍ فَظَاءَرَتْ لَهُمْ فَاسْتَحْلَفُوا زَوْجَهَا، فَقَالُوا: امْرَأَتُكَ طَالِقٌ إِنْ وَطِئْتَهَا حَتَّى تَفْطِمَ صَبِيَّنَا، أَفَلَيْسَ إِنْ تَرَكَهَا أَرْبَعَةَ أَشْهُرٍ بَانَتْ بِالْإِيلَاءِ، وَإِنْ قَرَبَهَا قَبْلَ أَنْ تَفْطِمَ الصَّبِيَّ فَهِيَ طَالِقٌ ثَلَاثًا؟ قَالَ: «نَعَمْ»
Ibrahim (may Allah have mercy on him) said: "If it is said to the husband that he should not approach his wife until the child is weaned, and if he stays away for four months, then separation will occur through ila'; if he approaches her before that, three divorces will take place."
Hadith 3050
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُطَرِّفٌ، عَنِ الشَّعْبِيِّ، أَنَّهُ سُمِعَ يَقُولَ ذَلِكَ
Hazrat Sha'bi (may Allah have mercy on him) also stated this same ruling.
Hadith 3051
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا دَاوُدُ بْنُ أَبِي هِنْدَ، عَنْ سِمَاكِ بْنِ حَرْبٍ، عَنْ أَبِي عَطِيَّةَ الْأَسَدِيِّ أَنَّهُ سَأَلَ عَلِيًّا رَضِيَ اللَّهُ عَنْهُ أَنَّهُ تَزَوَّجَ امْرَأَةَ أَخِيهِ، وَهِيَ تُرْضِعُ ابْنَ أَخِيهِ، فَقَالَ: هِيَ طَالِقٌ إِنْ قَرَبَهَا حَتَّى تَفْطِمَهُ فَقَالَ عَلِيٌّ: «إِنَّمَا أَرَدْتَ لَكَ وَلِابْنِ أَخِيكَ فَلَا إِيلَاءَ عَلَيْكَ، إِنَّمَا الْإِيلَاءُ مَا كَانَ فِي الْغَضَبِ»
Sayyiduna Ali (may Allah be pleased with him) was asked: He married his brother’s wife while she was breastfeeding his son. He replied: “There is no ila (oath of abstinence) upon you; ila only occurs at the time of anger.”
Hadith 3052
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ مِثْلَ ذَلِكَ
Hasan (may Allah have mercy on him) also said the same.
Hadith 3053
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو وَكِيعٍ , عَنْ أَبِي فَزَارَةَ , عَنِ ابْنِ عَبَّاسٍ أَنَّهُ قَالَ: «إِنَّمَا الْإِيلَاءُ فِي الْغَضَبِ»
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: "Ila' (oath of abstention) only occurs in a state of anger."
Hadith 3054
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا الْقَعْقَاعُ بْنُ يَزِيدَ الضَّبِّيُّ، قَالَ: سَأَلْتُ الْحَسَنَ عَنِ الْإِيلَاءِ، فَقَالَ: «إِنَّمَا الْإِيلَاءُ مَا كَانَ فِي الْغَضَبِ» قَالَ: وَسَأَلْتُ ابْنَ سِيرِينَ فَقَالَ: " مَا أَدْرِي مَا يَقُولُونَ، وَمَا يَجِيئُونَ بِهِ، قَالَ اللَّهُ عَزَّ وَجَلَّ {لِلَّذِينَ يُؤْلُونَ مِنْ نِسَائِهِمْ تَرَبُّصُ أَرْبَعَةِ أَشْهُرٍ فَإِنْ فَاءُوا فَإِنَّ اللَّهَ غَفُورٌ رَحِيمٌ وَإِنْ عَزَمُوا الطَّلَاقَ فَإِنَّ اللَّهَ سَمِيعٌ عَلِيمٌ}
Hasan (may Allah have mercy on him) said: "Ilaa (oath of abstinence) happens in anger." Ibn Sirin (may Allah have mercy on him) said: "I do not know what these people are saying, Allah the Exalted said: «لِلَّذِينَ يُؤْلُونَ مِنْ نِسَائِهِمْ تَرَبُّصُ أَرْبَعَةِ أَشْهُرٍ»."
Hadith 3055
حَدَّثَنَا سَعِيدٌ قَالَ: نا الْوَلِيدُ بْنُ أَبِي ثَوْرٍ الْهَمْدَانِيُّ، قَالَ: حَدَّثَنِي أَبُو يَعْفُورَ الْعَبْدِيُّ، عَنْ عَطِيَّةَ بْنِ جُبَيْرٍ، عَنْ أَبِيهِ جُبَيْرٍ أَنَّهُ حَلَفَ أَنْ لَا يَأْتِيَ امْرَأَتَهُ سَنَتَيْنِ حَتَّى تَفْطِمَ وَلَدَهَا، فَقِيلَ لَهُ: مَا صَنَعْتَ فَأَتَى عَلِيَّ بْنَ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ فَذَكَرَ ذَلِكَ لَهُ، فَقَالَ لَهُ: «إِنْ كُنْتَ فِي غَضِبٍ فَقَدْ بَانَتْ مِنْكَ، وَإِلَّا فَهِيَ امْرَأَتُكَ»
Atiyyah bin Jubair narrated from his father: He swore that he would not go to his wife until the child was weaned. Sayyiduna Ali (may Allah be pleased with him) said: "If he was angry, then the wife is separated; otherwise, the marriage remains."
Hadith 3056
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، قَالَ: أَتَى رَجُلٌ عَلِيًّا رَضِيَ اللَّهُ عَنْهُ فَقَالَ: حَلَفْتُ أَنْ لَا آتِيَ امْرَأَتِي سَنَتَيْنِ، فَقَالَ: «مَا أَرَى إِلَّا قَدْ دَخَلَ عَلَيْكَ إِيلَاءٌ» قَالَ: إِنَّمَا قُلْتُ ذَلِكَ مِنْ أَجْلِ أَنَّهَا تُرْضِعُ وَلَدِي قَالَ: «فَلَا إِذَنْ»
It is narrated from Sa'id bin Jubair (may Allah have mercy on him): A man said to Sayyiduna Ali (may Allah be pleased with him): "I have sworn an oath not to go to my wife for two years." He (Ali) said: "This is Ila (an oath of abstinence)." The man said: "I said it for the sake of breastfeeding the child." He (Ali) said: "Then it is not (Ila)."
Hadith 3057
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ أَبِي يَحْيَى، مَوْلَى مُعَاذِ بْنِ عَفْرَاءَ، عَنِ ابْنِ عَبَّاسٍ، أَنَّهُ قَالَ: «إِنَّمَا الْإِيلَاءُ أَنْ يَحْلِفَ الرَّجُلُ لَا يَأْتِي امْرَأَتَهُ أَبَدًا»
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: "Ila is only when a man swears that he will never go to his wife."
Hadith 3058
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، أَنَّهُ سَأَلَ سَعِيدَ بْنَ الْمُسَيِّبِ عَنِ الْإِيلَاءِ، قَالَ: «لَيْسَ بِشَيْءٍ»
Hazrat Saeed bin Musayyib (may Allah have mercy on him) was asked about Ilaa, he said: "This is nothing."
Hadith 3059
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، قَالَ: أنا دَاوُدُ بْنُ أَبِي هِنْدَ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، قَالَ: «إِذَا آلَى الرَّجُلُ مِنِ امْرَأَتِهِ فَمَضَتْ أَرْبَعَةُ أَشْهُرٍ، فَلَا يَكُونُ إِيلَاءً حَتَّى يُطَلِّقَ» فَقُلْتُ لَهُ: إِنَّ الْحَسَنَ يَقُولُ: إِذَا مَضَتْ أَرْبَعَةُ أَشْهُرٍ فَهِيَ تَطْلِيقَةٌ بَائِنَةٌ، قَالَ: «فَإِذَا لَقِيتَ الْحَسَنَ فَأَقْرِئْهُ السَّلَامَ، وَأَخْبِرْهُ أَنْ بِئْسَ مَا قَالَ»
Hazrat Sa'id bin al-Musayyib (may Allah have mercy on him) said: "If a man makes an oath of abstinence (ila') from his wife and four months pass, the ila' does not take effect until he gives divorce." I said: "Hasan (may Allah have mercy on him) says that after four months, one irrevocable divorce (bainah) takes place." He said: "When you meet Hasan, convey my greetings and tell him that he has said something very wrong."
Hadith 3060
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا دَاوُدُ، قَالَ: سَمِعْتُ سَعِيدَ بْنَ الْمُسَيِّبِ، يَقُولُ: «إِنَّ الْإِيلَاءَ لَيْسَ بِطَلَاقٍ، وَلَكِنَّهُ مَعْصِيَةٌ، وَلَا تُوجِبُ الْمَعْصِيَةُ عَلَيْهِ طَلَاقًا، وَلَكِنَّهُ يُوقَفُ عِنْدَ الْأَرْبَعَةِ أَشْهُرٍ، فَإِمَّا أَنْ يَفِيءَ، وَإِمَّا أَنْ يُطَلِّقَ»
Hazrat Saeed bin Musayyib (may Allah have mercy on him) said: "Ila is not divorce, rather it is a sin, and divorce does not become necessary due to a sin. Yes, after four months the man will be stopped, either he should return (to his wife) or give divorce."
Hadith 3061
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو قُدَامَةَ الْحَرْثُ بْنُ عُبَيْدٍ الْإِيَادِيُّ، قَالَ: نا عَامِرٌ الْأَحْوَلُ، عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: «كَانَ إِيلَاءُ أَهْلِ الْجَاهِلِيَّةِ السَّنَةَ وَالسَّنَتَيْنِ، وَأَكْثَرَ مِنْ ذَلِكَ، فَوَقَّتَ اللَّهُ عَزَّ وَجَلَّ أَرْبَعَةَ أَشْهُرٍ، فَمَنْ كَانَ إِيلَاؤُهُ أَقَلَّ مِنْ أَرْبَعَةِ أَشْهُرٍ فَلَيْسَ بِإِيلَاءٍ»
Ibn Abbas (may Allah be pleased with them both) said: "In the days of ignorance, people used to do ila’ (oath of abstinence from wives) for a year, two years, or even longer. Then Allah the Exalted fixed the period at four months. Now, any ila’ that is less than four months is not considered ila’."
Hadith 3062
حَدَّثَنَا سَعِيدٌ قَالَ: نا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ، عَنْ سَعِيدِ بْنِ أَبِي عَرُوبَةَ، عَنْ عَامِرٍ الْأَحْوَلِ، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: «مَنْ حَلَفَ أَنْ لَا يَقْرَبَ امْرَأَتَهُ شَهْرًا، فَتَرَكَهَا أَرْبَعَةَ أَشْهُرٍ، فَلَيْسَ بِإِيلَاءٍ»
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: "Whoever swears an oath not to approach his wife for one month and then leaves her for four months, this is not Ilaa (oath of abstention)."
Hadith 3063
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنْ عَبْدِ اللَّهِ، أَنَّهُ قَالَ فِي الْإِيلَاءِ: «إِذَا مَضَتْ أَرْبَعَةُ أَشْهُرٍ فَهِيَ وَاحِدَةٌ بَائِنَةٌ»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "After four months, a bainah (irrevocable) divorce takes place."
Hadith 3064
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، أَنَّهُ كَانَ يَقُولُ مِثْلَ ذَلِكَ
This is also the statement of Ibrahim (may Allah have mercy on him).
Hadith 3065
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا حُصَيْنٌ، عَنْ إِبْرَاهِيمَ، عَنْ عَبْدِ اللَّهِ، وَأنا دَاوُدُ، عَنِ الشَّعْبِيِّ، عَنْ عَبْدِ اللَّهِ، أَنَّهُ كَانَ يَقُولُ: «إِذَا آلَى الرَّجُلُ مِنِ امْرَأَتِهِ فَمَضَتْ أَرْبَعَةُ أَشْهُرٍ قَبْلَ أَنْ يَقْرَبَهَا بَانَتْ مِنْهُ بِتَطْلِيقَةٍ، وَتَعْتَدُّ ثَلَاثَ حِيَضٍ، وَيَخْطُبُهَا فِيهِنَّ إِنْ شَاءَ وَشَاءَتْ»
It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him): "If a man makes an oath of abstinence (ila) from his wife and does not approach her before four months, then one irrevocable divorce (talaq bain) will take place. Then the woman will observe the waiting period ('iddah) for three menstrual cycles. And during the 'iddah, if they wish, they can remarry."
Hadith 3066
حَدَّثَنَا سَعِيدٌ قَالَ: نا عَبْدُ الرَّحْمَنِ بْنُ زِيَادٍ، قَالَ: نا الْمَسْعُودِيُّ، عَنْ عَلِيِّ بْنِ بَذِيمَةَ، عَنْ أَبِي عُبَيْدَةَ، عَنْ مَسْرُوقٍ، عَنْ عَبْدِ اللَّهِ، أَنَّهُ قَالَ مِثْلَ ذَلِكَ
Hazrat Masruq (may Allah have mercy on him) also narrated this same tradition from Hazrat Abdullah (may Allah be pleased with him).
Hadith 3067
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا خَالِدٌ، عَنْ أَبِي قِلَابَةَ، أَنَّ النُّعْمَانَ بْنَ بَشِيرٍ آلَى مِنِ امْرَأَتِهِ، فَقَالَ لَهُ عَبْدُ اللَّهِ: «إِنْ مَضَتْ عَلَيْكَ أَرْبَعَةُ أَشْهُرٍ قَبْلَ أَنْ تَقْرَبَهَا فَاعْتَرِفْ بِتَطْلِيقَةٍ»
When Sayyiduna Nu'man bin Bashir (may Allah be pleased with him) made an oath of abstinence (ila) from his wife, Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "If four months have passed, then acknowledge the divorce."
Hadith 3068
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا سُلَيْمَانُ الْأَعْمَشُ، عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: «إِذَا آلَى الرَّجُلُ مِنِ امْرَأَتِهِ فَمَضَتِ الْأَرْبَعَةُ أَشْهُرٍ، فَهِيَ تَطْلِيقَةٌ بَائِنَةٌ»
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: "If a man has taken an oath of abstinence (ila') and four months have passed, then this is one irrevocable divorce (talaq bainah)."
Hadith 3069
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، وَابْنِ عُمَرَ، قَالَ: كَانَا يَقُولَانِ: «إِذَا آلَى الرَّجُلُ مِنِ امْرَأَتِهِ فَمَضَتْ أَرْبَعَةُ الْأَشْهُرِ قَبْلَ أَنْ يَفِيءَ فَهِيَ تَطْلِيقَةٌ بَائِنَةٌ»
Sayyiduna Ibn Abbas and Sayyiduna Ibn Umar (may Allah be pleased with them both) both said: "If he does not return within four months, an irrevocable divorce will take place."
Hadith 3070
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا ابْنُ أَبِي لَيْلَى، عَنِ الْحَكَمِ، عَنْ مِقْسَمٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: " عَزِيمَةُ الطَّلَاقِ انْقِضَاءُ الْأَرْبَعَةِ الْأَشْهُرِ، وَالْفَيْءُ: الْجِمَاعُ "
Ibn Abbas (may Allah be pleased with them both) said: "After four months, divorce becomes binding, and reconciliation is through intercourse."
Hadith 3071
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُطَرِّفٌ، عَنِ الشَّعْبِيِّ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: " الْفَيْءُ: الْجِمَاعُ،
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: "Fay’ refers to intercourse."
Hadith 3072
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ مُطَرِّفٍ، عَنِ الشَّعْبِيِّ، عَنِ ابْنِ عَبَّاسٍ، مِثْلَهُ.
This same statement of Sayyiduna Ibn Abbas (may Allah be pleased with them both) was also narrated by Hazrat Sha'bi (may Allah have mercy on him).
Hadith 3073
حَدَّثَنَا سَعِيدٌ قَالَ: نا حُصَيْنٌ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، قَالَ: الْفَيْءُ: الْجِمَاعُ "
Hazrat Masruq (may Allah have mercy on him) said: "Fay’ means intercourse."
Hadith 3074
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، أَنَّهُ كَانَ يَقُولُ فِيمَنْ آلَى مِنِ امْرَأَتِهِ فَلَمْ يَقْدِرْ عَلَيْهَا مِنْ حَيْضٍ، أَوْ نِفَاسٍ، أَوْ أَمْرٍ لَهُ فِيهِ عُذْرٌ: «أَشْهَدُ عَلَى الْفَيْءِ، وَهِيَ امْرَأَتُهُ»
Ibrahim (may Allah have mercy on him) said: "If someone has taken an oath of abstinence (ila) from his wife, and the woman is not able to have intercourse due to menstruation, postnatal bleeding, or any excuse, then the husband should announce his return; she will remain his wife."
Hadith 3075
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، وَخَالِدٌ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، فِي الرَّجُلِ يُؤْلِي مِنِ امْرَأَتِهِ، ثُمَّ لَمْ يَقْدِرْ عَلَى الْجِمَاعِ مِنْ عُذْرٍ حَتَّى تَمْضِيَ أَرْبَعَةُ أَشْهُرٍ، «فَيَشْهَدُ عَلَى الْفَيْءِ، وَهِيَ امْرَأَتُهُ»
Ibrahim (may Allah have mercy on him) said: "If there is an excuse and intercourse cannot take place, then the husband should announce his intention to take her back, and the marriage will remain in effect for the wife."
Hadith 3076
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنِ الشَّعْبِيِّ، أَنَّهُ كَانَ يَقُولُ: " يَفِيءُ، وَالْفَيْءُ: الْجِمَاعُ "،
Hazrat Sha'bi (may Allah have mercy on him) said: "The meaning of 'ruju' (reconciliation) is intercourse."
Hadith 3077
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدٌ، عَنْ مُغِيرَةَ، عَنِ الشَّعْبِيِّ، مِثْلَهُ
A similar statement is narrated from Hazrat Sha'bi (may Allah have mercy on him).
Hadith 3078
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، أَنَّ رَجُلًا مِنْ مُحَارِبٍ آلَى مِنِ امْرَأَتِهِ، فَلَمَّا كَانَ عِنْدَ الْأَرْبَعَةِ الْأَشْهُرِ أَرَادَ أَنْ يَفِيءَ إِلَيْهَا، فَنَفِسَتِ الْمَرْأَةُ، فَأَتَى عَلْقَمَةَ وَالْأَسْوَدَ فَقَالَا: «أَشْهَدُ عَلَى الْفَيْءِ، وَهِيَ امْرَأَتُكَ»
Ibrahim (may Allah have mercy on him) said: A man from the tribe of Muharib made an oath of abstinence (ila) from his wife. When four months had passed and he intended to return to her, the woman was in postnatal bleeding (nifas). So Sayyiduna Alqama and Sayyiduna Aswad (may Allah have mercy on them both) said: "Announce your return; she is your wife."
Hadith 3079
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، قَالَ: نَزَلَ بِأَبِي الشَّعْثَاءِ ضَيْفٌ، وَآلَى مِنِ امْرَأَتِهِ فَنَفِسَتْ، فَأَرَادَ أَنْ يَفِيءَ فَلَمْ يَسْتَطِعْ مِنْ أَجْلِ نِفَاسِهَا، فَأَتَى عَلْقَمَةَ فَذَكَرَ ذَلِكَ لَهُ، فَقَالَ لَهُ عَلْقَمَةُ، «أَلَيْسَ قَدْ فِئْتَ بِقَلْبِكَ وَرَضِيتَ؟» قَالَ: بَلَى، قَالَ: " قَدْ فِئْتَ قَالَ: فَهِيَ امْرَأَتُكَ "
Ibrahim (may Allah have mercy on him) said: A guest came to Abu Sha’tha, he swore an oath of abstinence from his wife, and his wife entered the state of postnatal bleeding. When he intended to return to her, he was unable to do so. He consulted our master Alqamah (may Allah have mercy on him), who said: “Have you returned to her in your heart?” He said: “Yes.” He said: “Then the return has taken place, she is your wife.”
Hadith 3080
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ إِسْمَاعِيلَ بْنِ سَالِمٍ، عَنْ عَامِرٍ، قَالَ: «كُلُّ يَمِينٍ حَلَفَ عَلَيْهَا الرَّجُلُ يَكُونُ فِي تِلْكَ الْيَمِينِ أَنْ لَا يَقْرَبَ امْرَأَتَهُ أَرْبَعَةَ أَشْهُرٍ فَهُوَ إِيلَاءٌ»
Hazrat Aamir (may Allah have mercy on him) said: "Every oath in which there is a resolve not to go near one's wife for four months is Ilaa (oath of abstention)."
Hadith 3081
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، وَعَوْفٌ، وَأَبُو حُرَّةَ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ: «الْفَيْءُ الْإِشْهَادُ، وَإِذَا كَانَ لَهُ عُذْرٌ مِنْ مَرَضٍ أَوْ حَيْضٍ أَوْ نِفَاسٍ»
Hasan al-Basri (may Allah have mercy on him) said: “The announcement of return (reconciliation) is established by testimony if there is an excuse such as illness, menstruation, or postnatal bleeding.”
Hadith 3082
حَدَّثَنَا سَعِيدٌ قَالَ: نا عَتَّابٌ، قَالَ: أنا خُصَيْفٌ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، قَالَ: " الْفَيْءُ: الْجِمَاعُ "
Hazrat Sa'id bin Jubair (may Allah have mercy on him) said: "Fay’ means intercourse."
