بَابُ كَفَّارَةِ الْعَبْدِ فِي الظِّهَارِ

Hadith 3036
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، وَمُغِيرَةَ، عَنْ إِبْرَاهِيمَ، وَمُحَمَّدِ بْنِ سَالِمٍ، عَنِ الشَّعْبِيِّ، " أَنَّهُمْ قَالُوا فِي الْعَبْدِ إِذَا ظَاهَرَ مِنِ امْرَأَتِهِ: يَصُومُ شَهْرَيْنِ مُتَتَابِعَيْنِ "
Hazrat Hasan, Ibrahim, and Hazrat Sha'bi (may Allah have mercy on them) said: "If a slave performs zihar with his wife, he should fast for two consecutive months."
Hadith 3037
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ يَقُولُ: «إِذَا أَذِنَ لَهُ مَوْلَاهُ فِي الْعِتْقِ، فَلْيَعْتِقْ وَإِنْ لَمْ يَأْذَنْ لَهُ فَلْيَصُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ»
Hasan (may Allah have mercy on him) said: "If a master gives permission to a slave to emancipate (another), then the slave should set him free; if he does not give permission, then he should fast for two consecutive months."
Hadith 3038
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، قَالَ: سَأَلْتُ ابْنَ طَاوُسٍ مَا كَانَ أَبُوكَ يَقُولُ فِي ظِهَارِ الْعَبْدِ؟ قَالَ: كَانَ يَقُولُ: «عَلَيْهِ مِثْلُ كَفَّارَةِ الْحُرِّ»
Ibn Tawus was asked: "What did your father say about the zihar of a slave?" He replied: "The same expiation is obligatory on him as the expiation for a free man."
Hadith 3039
حَدَّثَنَا سَعِيدٌ قَالَ: نا الْحَكَمُ بْنُ ظُهَيْرٍ، عَنِ السُّدِّيِّ، عَنْ مُرَّةَ، قَالَ: «الظِّهَارُ مِنَ الْأَمَةِ كَالظِّهَارِ مِنَ الْحُرَّةِ، وَفِيهَا الْكَفَّارَةُ»
Hazrat Marrah (may Allah have mercy on him) said: "Zihar with a slave woman is like that with a free woman, and expiation is also obligatory for it."
