Hadith 2962
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، وَمَنْصُورٌ، عَنِ الْحَسَنِ، فِي رَجُلٍ تَزَوَّجَ أَمَةً فَوَلَدَتْ مِنْهُ أَوْلَادًا، ثُمَّ اشْتَرَاهَا، قَالَ: «هِيَ أُمُّ وَلَدٍ وَلَا يَبِيعُهَا»
Hasan (may Allah have mercy on him) said: "Whoever married a slave woman and had children from her, then bought her, she becomes an umm walad and he cannot sell her."
Hadith 2963
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ يُونُسَ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ: «هِيَ أُمُّ وَلَدٍ»
Hasan (may Allah have mercy on him) said: "She is an Umm Walad (a slave woman who has borne her master's child)."
Hadith 2964
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدٌ، عَنْ مُغِيرَةَ، عَنْ حَمَّادٍ، عَنْ إِبْرَاهِيمَ، قَالَ: «لَا تَكُونُ أُمَّ وَلَدٍ حَتَّى تُحْدِثَ عَنْهُ وَلَدًا آخَرَ»
Ibrahim (may Allah have mercy on him) said: "She will not become an umm walad until she bears a second free child from him."
Hadith 2965
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ أَصْحَابِهِ، عَنْ إِبْرَاهِيمَ، مِثْلَهُ. قَالَ هُشَيْمٌ: وَهُوَ الْقَوْلُ
It is narrated from Ibrahim, may Allah have mercy on him, in a similar manner.
Hadith 2966
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا فُضَيْلُ أَبُو مُعَاذٍ، عَنْ أَبِي حَرِيزٍ، قَالَ: نا الشَّعْبِيُّ، أَنَّ رَجُلًا كَانَتْ لَهُ امْرَأَةٌ حُرَّةٌ، وَأَمَةٌ تَزَوَّجَهَا فَوُلِدَ لَهُ مِنْهَا، فَكَانَ كُلَّمَا وُلِدَ لَهُ مِنَ الْأَمَةِ وَلَدٌ أَعْتَقَ، فَاشْتَرَاهَا بَعْدَ ذَلِكَ، وَمَاتَ قَبْلَ أَنْ تَلِدَ مِنْهُ، فَخَاصَمَ وَلَدُهَا وَلَدَ الْحُرَّةِ إِلَى شُرَيْحٍ، فَأَرْسَلَهُمْ شُرَيْحٌ إِلَى عَبِيْدَةَ، فَقَالَ عَبِيْدَةُ: «هِيَ أَمَةٌ، وَإِنَّمَا تَعْتِقُ لَوْ أَنَّهَا وَلَدَتْ أَوْلَادًا أَحْرَارًا، وَإِنَّمَا وَلَدَتْهُمْ وَهُمْ مَمْلُوكُونَ، فَهِيَ أَمَةٌ» فَأَعْتَقُوهَا مِنْ نَصِيبِ أَوْلَادِهَا
Hazrat Sha'bi (may Allah have mercy on him) said: "If a man has one free woman and one slave woman as wives, and he has children from the slave woman, then he buys her, and he dies, the slave woman will not become free, because the children were slaves at the time of their birth."
