Hadith 2940
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مَنْصُورٌ، عَنِ ابْنِ سِيرِينَ، أَنَّ الْحَسَنَ بْنَ عَلِيٍّ طَلَّقَ امْرَأَةً لَهُ وَبَعَثَ إِلَيْهَا بِعَشَرَةِ آلَافٍ مُتْعَةً لَهَا، فَقَالَتْ: «مَتَاعٌ قَلِيلٌ مِنْ حَبِيبٍ مُفَارِقٍ» فَبَلَغَهُ قَوْلُهَا فَرَاجَعَهَا
Sayyiduna Hasan bin Ali (may Allah be pleased with them both) divorced his wife and sent ten thousand dirhams as parting gift. The wife said: "The beloved is parting, and the gift is little." When this reached him, he took her back.
Hadith 2941
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، أَنَّ الْأَسْوَدَ بْنَ يَزِيدَ، «طَلَّقَ امْرَأَتَهُ فَمَتَّعَهَا بِثَلَثِمِائَةِ دِرْهَمٍ»
Sayyiduna Aswad bin Yazid (may Allah have mercy on him) divorced his wife and gave three hundred dirhams as provision.
Hadith 2942
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، عَنِ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، عَنِ الْأَسْوَدِ، «أَنَّهُ طَلَّقَ امْرَأَتَهُ فَمَتَّعَهَا بِثَلَثِمِائَةِ دِرْهَمٍ»
Sayyiduna Aswad bin Yazid (may Allah have mercy on him) divorced his wife and gave three hundred dirhams as provision.
Hadith 2943
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، أنا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، عَنِ الْأَسْوَدِ، مِثْلَ ذَلِكَ
This same narration has also come from Sayyiduna Aswad bin Yazid (may Allah have mercy on him) through another chain of transmission.
Hadith 2944
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، نا يُونُسُ بْنُ عُبَيْدٍ، أَنَّ أَنَسَ بْنَ مَالِكٍ «طَلَّقَ امْرَأَتَهُ فَمَتَّعَهَا بِثَلَاثِمِائَةِ دِرْهَمٍ»
Sayyiduna Anas bin Malik (may Allah be pleased with him) divorced his wife and gave her three hundred dirhams as provision.
Hadith 2945
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُحَمَّدُ بْنُ إِسْحَاقَ، عَنْ سَعْدِ بْنِ إِبْرَاهِيمَ، عَنْ أَبِيهِ، عَنْ جَدِّهِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ، «أَنَّهُ طَلَّقَ امْرَأَتَهُ فَمَتَّعَهَا بِجَارِيَةٍ سَوْدَاءَ حَمَّمَهَا»
Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) divorced his wife and gave a black slave woman as provision (mut‘ah).
Hadith 2946
حَدَّثَنَا سَعِيدٌ قَالَ: نا عَبْدُ الرَّحْمَنِ، قَالَ: نا شُعْبَةُ، عَنْ سَعْدِ بْنِ إِبْرَاهِيمَ، قَالَ: سَمِعْتُ حُمَيْدَ بْنَ عَبْدِ الرَّحْمَنِ، يُحَدِّثُ عَنْ أُمِّهِ، أَنَّهَا قَالَتْ: «كَأَنِّي أَنْظُرُ إِلَى جَارِيَةٍ سَوْدَاءَ حَمَّمَهَا عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ امْرَأَتَهُ أُمَّ أَبِي سَلَمَةَ حِينَ طَلَّقَهَا فِي مَرَضِهِ»
Lady Umm Salamah (may Allah be pleased with her) said: "I saw that when Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) gave divorce during illness, a slave girl was given as provision."
Hadith 2947
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: نا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، قَالَ: «الْعَرَبُ تُسَمِّي الْمُتْعَةَ التَّحْمِيمَ»
Sayyiduna Ibrahim (may Allah have mercy on him) said: "The Arabs used to call goods 'tahmeem'."
Hadith 2948
حَدَّثَنَا سَعِيدٌ قَالَ: ثنا هُشَيْمٌ، قَالَ: أنا سَيَّارٌ، عَنِ الشَّعْبِيِّ، أَنَّ شُرَيْحًا طَلَّقَ امْرَأَةً يُقَالُ لَهَا كُبَيْشَةُ، فَمَتَّعَهَا مَتَاعًا لَمْ يُسَمِّهِ، وَكَتَمَهَا طَلَاقَهَا حَتَّى انْقَضَتْ عِدَّتُهَا، فَلَمَّا أَخْبَرَهَا أَمَرَتْ بِثِيَابِهَا أَنْ تُنْقَلَ، وَخَرَجَتْ، فَقَالَ شُرَيْحٌ: «لِذَلِكَ كَتَمْتُهَا، إِنِّي كَرِهْتُ أَنْ تَعْصِيَ اللَّهَ عَزَّ وَجَلَّ»
Sayyiduna Shurayh (may Allah have mercy on him) divorced his wife Kabishah, gave her provision, and concealed the divorce until the waiting period ended so that she would not disobey Allah.
Hadith 2949
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا دَاوُدُ، قَالَ: وَأنا مُغِيرَةُ، عَنِ الشَّعْبِيِّ، أَنَّ شُرَيْحًا، طَلَّقَ امْرَأَتَهُ وَمَتَّعَهَا بِخَمْسِ مِائَةِ دِرْهَمٍ "
Sayyiduna Shurayh (may Allah have mercy on him) divorced his wife and gave five hundred dirhams as a gift.
Hadith 2950
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا ابْنُ أَبِي لَيْلَى، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، قَالَ: «لِكُلِّ مُطْلَقَةٍ مَتَاعٌ إِلَّا الَّتِي طَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا، وَقَدْ كَانَ فَرَضَ لَهَا، فَلَهَا نِصْفُ الصَّدَاقِ»
Sayyiduna Ibn Umar (may Allah be pleased with them both) said: "Every divorced woman is entitled to maintenance, except for the one who was divorced before consummation and a dowry was specified for her; in that case, she will receive half of the dowry."
Hadith 2951
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، قَالَ: «لِكُلِّ مُطْلَقَةٍ مَتَاعٌ»
Sayyiduna Hasan (may Allah have mercy on him) said: "Every divorced woman is entitled to provision (mut‘ah)."
Hadith 2952
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا عَبْدُ الْمَلِكِ، عَنْ عَطَاءٍ، أَنَّهُ قَالَ: «لِكُلِّ مُطْلَقَةٍ مَتَاعٌ إِلَّا الَّتِي طَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا، وَقَدْ فَرَضَ لَهَا، فَلَهَا نِصْفَ الصَّدَاقِ»
Sayyiduna Ata (may Allah have mercy on him) said: "Every divorced woman is entitled to provision, except for the one who was divorced before consummation and a dowry was specified for her, then she will receive half of the dowry."
Hadith 2953
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا دَاوُدُ، عَنِ الشَّعْبِيِّ، أَنَّهُ قَالَ فِي الْمَتَاعِ: «دِرْعٌ، وَخِمَارٌ، وَمِلْحَفَةٌ، وَجِلْبَابٌ»
Hazrat Sha'bi (may Allah have mercy on him) said: "In the belongings, one shirt, one scarf, one sheet, and one jilbab should be given."
Hadith 2954
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، وَمُحَمَّدِ بْنِ سَالِمٍ، عَنِ الشَّعْبِيِّ، أَنَّهُمَا قَالَا: «لِكُلِّ مُطْلَقَةٍ مَتَاعٌ إِلَّا الَّتِي طَلَّقَهَا، وَقَدْ فَرَضَ لَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا، فَلَهَا نِصْفُ الصَّدَاقِ»
Ibrahim and Sha'bi, may Allah have mercy on them, said: "Every divorced woman is entitled to provision (mut‘ah) except for the one who was divorced before consummation and for whom a dowry had been specified."
Hadith 2955
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ سُئِلَ عَنِ الْمُتْعَةِ، فَقَالَ: «كَانَ مِنْهُمْ مَنْ مَتَّعَ بِالْخَادِمِ وَالنَّفَقَةِ، وَمَنْ كَانَ دُونَ ذَلِكَ مَتَّعَ بِالنَّفَقَةِ وَالْكِسْوَةِ، وَمَنْ كَانَ دُونَ ذَلِكَ مَتَّعَ بِمِلْحَفَةٍ، وَدِرْعٍ، وَجِلْبَابٍ، وَمَنْ كَانَ دُونَ ذَلِكَ مَتَّعَ بِثَوْبٍ وَاحِدٍ»
Hasan (may Allah have mercy on him) said: "A wealthy person should give a servant and spend, a person of moderate means should spend and give clothing, a weak person should give a sheet, a shirt, or a jilbab, and a poor person should give a single garment."
Hadith 2956
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مَنْصُورٌ، وَيُونُسُ، وَهِشَامٌ، عَنِ ابْنِ سِيرِينَ، عَنْ شُرَيْحٍ، أَنَّ امْرَأَةً خَاصَمَتْ زَوْجَهَا إِلَى شُرَيْحٍ فِي الْمُتْعَةِ، فَقَالَ شُرَيْحٌ: «لَا تَأْبَ أَنْ تَكُونَ مِنَ الْمُحْسِنِينَ، لَا تَأْبَ أَنْ تَكُونَ مِنَ الْمُتَّقِينَ» وَلَمْ يُجْبِرْهُ
A woman came to Hazrat Shurayh (may Allah have mercy on him) with a case regarding property, so he said to the husband: "Be among the doers of good and the God-fearing." But he did not compel him.
Hadith 2957
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا جُوبَيْرٌ، عَنْ الضَّحَّاكِ، أَنَّهُ قَالَ: «لِكُلِّ مُطَلَّقَةٍ مَتَاعٌ حَتَّى الْمُخْتَلِعَةِ»
Hazrat Dhahhak (may Allah have mercy on him) said: "Every divorced woman is entitled to provision, even the one who has obtained khula."
Hadith 2958
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، قَالَ: طَلَّقَ ابْنُ عُمَرَ امْرَأَةً لَهُ، فَقَالَتْ لَهُ: هَلْ رَأَيْتَ مِنِّيَ شَيْئًا تَكْرَهُهُ؟ قَالَ: «لَا» قَالَتْ: فَفِيمَ تُطَلَّقُ الْعَفِيفَةُ الْمُسْلِمَةُ؟ قَالَ: فَارْتَجَعَهَا
Sayyiduna Ibn Umar (may Allah be pleased with them both) divorced his wife. She said: "Did you see anything undesirable in me?" He replied: "No." She said: "Then for what reason is a chaste Muslim woman divorced?" So he took her back.
Hadith 2959
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: «إِذَا فُوِّضَ إِلَى الرَّجُلِ فَطَلَّقَ قَبْلَ أَنْ يَمَسَّ وَيَفْرِضَ فَلَيْسَ لَهَا إِلَّا الْمَتَاعُ»
Ibn Abbas (may Allah be pleased with them both) said: "When a man has the authority to contract marriage, then divorces (the woman) without consummation and without specifying a dowry, the woman is entitled only to a gift."
Hadith 2960
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ، قَالَ: سَأَلْتُ ابْنَ أَبِي نَجِيحٍ سُئِلَ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ قَبْلَ أَنْ يَدْخُلَ بِهَا، وَقَدْ فَرَضَ لَهَا هَلْ لَهَا مَتَاعٌ؟ فَقَالَ: كَانَ عَطَاءٌ يَقُولُ: «لَا مَتَاعَ لَهَا»
Hazrat Ata (may Allah have mercy on him) said: "If the dowry is fixed and consummation has not taken place, then there is no gift for the woman."
Hadith 2961
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ، قَالَ: أنا أَيُّوبُ، قَالَ: سَمِعْتُ سَعِيدَ بْنَ جُبَيْرٍ، يَقُولُ: «لِكُلِّ مُطَلَّقَةٍ مَتَاعٌ»
Hazrat Sa'id bin Jubair (may Allah have mercy on him) said: "Every divorced woman is entitled to provision (mut'ah)."
