Hadith 2905
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا حَجَّاجُ بْنُ أَرْطَاةَ، عَنْ مَيْمُونِ بْنِ مِهْرَانَ، أَنَّ ابْنَ عُمَرَ، سُئِلَ عَنْ رَجُلٍ لَهُ أَمَتَانِ وَهُمَا أُخْتَانِ، فَوَطِئَ إِحْدَاهُمَا، وَأَرَادَ أَنْ يَطَأَ الْأُخْرَى، فَقَالَ: «لَيْسَ ذَاكَ لَهُ» . قِيلَ: فَإِنْ قَرِبَهَا؟ قَالَ: «لَا، حَتَّى تَخْرُجَ الَّتِي وَطِئَ مِنْ مِلْكِهِ» .
Sayyiduna Ibn Umar (may Allah be pleased with them both) said: "If a person has two slave girls and they are sisters, and he has had intercourse with one of them, then it is not permissible to have intercourse with the other until he frees the first."
Hadith 2906
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، وَعُبَيْدَةَ، عَنْ إِبْرَاهِيمَ، مِثْلَ ذَلِكَ
Hasan (may Allah have mercy on him) and Ibrahim (may Allah have mercy on him) also gave the same verdict.
Hadith 2907
حَدَّثَنَا سَعِيدٌ قَالَ: نا شَرِيكُ بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ الْكَرِيمِ الْجَزَرِيُّ، وَابْنُ أَبِي لَيْلَى، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، قَالَ: «كَانَتْ لَهُ مَمْلُوكَتَانِ أُخْتَانِ، فَوَطِئَ إِحْدَاهُمَا، ثُمَّ أَرَادَ أَنْ يَطَأَ الْأُخْرَى، فَأَخْرَجَهَا مِنْ مِلْكِهِ»
It is narrated regarding Sayyiduna Ibn Umar (may Allah be pleased with them both) that he had two slave girls; when he had intercourse with one, he set the other free.
Hadith 2908
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ فِي الرَّجُلِ يَطَأُ أَمَتَهُ، أَوْ أَمَةَ غَيْرِهِ، وَهِيَ أُخْتُ امْرَأَتِهِ مِنَ الرَّضَاعَةِ، قَالَ: «يَعْتَزِلُ امْرَأَتَهُ حَتَّى يَسْتَبْرِئَ رَحِمُ الْأَمَةِ» .
Hasan (may Allah have mercy on him) said: "If someone has intercourse with his slave woman or with someone else's slave woman, and she is the milk-sister of his wife, then he should keep away from his wife until the womb of the slave woman becomes pure."
Hadith 2909
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، مِثْلَهُ
Ibrahim (may Allah have mercy on him) also gave this same verdict.
Hadith 2910
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ، قَالَ: أنا سَلَمَةُ بْنُ عَلْقَمَةَ، عَنْ مُحَمَّدِ بْنِ سِيرِينَ، قَالَ: كَانَ عَبْدُ اللَّهِ بْنُ عُتْبَةَ جَالِسًا فِي الْمَسْجِدِ - أَوْ قَالَ: فِي الْمَجْلِسِ - فَدَعَا رَجُلًا، فَجَاءَ حَتَّى جَلَسَ بَيْنَ يَدَيْهِ، فَكَلَّمَهُ بِشَيْءٍ لَا أَفْهَمُهُ، فَلَمَّا قَامَ رَفَعَ صَوْتَهُ، فَظَنَنْتُ أَنَّهُ يُرِيدُ أَنْ يُسْمِعَنِي، فَقَالَ: لَوْ شِئْتَ لَاعْتَرَفْتَ، أَلَا تَسْمَعُوا إِلَى قَوْلِهِ: إِنِّي حَرَّمْتُ إِحْدَاهُمَا، إِنَّهُمْ لَمْ يَزَالُوا بِعَبْدِ اللَّهِ بْنِ مَسْعُودٍ حَتَّى أَغْضَبُوهُ، فَقَالَ: «إِنَّ جَمَلَكَ مِمَّا مَلَكَتْ يَمِينُكَ» . فَسَأَلْتُ بَعْضَهُمْ فَزَعَمُوا أَنَّ عِنْدَهُ أُخْتَيْنِ مَمْلُوكَتَيْنِ يَطَؤُهُمَا "
Muhammad bin Sirin (may Allah have mercy on him) narrated: A man said that he had made one of his slave girls unlawful for himself. Abdullah bin Mas'ud (may Allah be pleased with him) said: "Your camel is also a possession of your hand."
Hadith 2911
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ، عَنْ أَبِيهِ، قَالَ: سُئِلَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ عَنْ جَمْعٍ بَيْنَ الْأُمِّ وَابْنَتِهَا، قَالَ: " مَا أُحِبُّ أَنْ أُجِيزَهُمَا جَمِيعًا. قَالَ أَبِي: فَرَدَدْتُ أَنَّ عُمَرَ كَانَ أَشَدَّ فِي ذَلِكَ مِمَّا هُوَ "
Sayyiduna Umar bin Khattab (may Allah be pleased with him) was asked whether a mother and her daughter can be kept together. He replied: "I do not like to declare this permissible."
Hadith 2912
حَدَّثَنَا سَعِيدٌ قَالَ: نا حُدَيْجُ بْنُ مُعَاوِيَةَ، عَنْ أَبِي إِسْحَاقَ، عَنْ رَجُلٍ، أَنَّهُ كَانَتْ لَهُ جَارِيَتَانِ امْرَأَةٌ وَابْنَتُهَا، فَوَلَدَتَا مِنْهُ جَمِيعًا، فَسَأَلَ عَلِيًّا رَضِيَ اللَّهُ عَنْهُ عَنْ ذَلِكَ، فَقَالَ: آيَتَانِ: إِحْدَاهُمَا تُحَرِّمُ عَلَيْكَ، وَالْأُخْرَى تُحِلُّ لَكَ مَا مَلَكَتْ يَمِينُكَ، وَلَسْتُ أَفْعَلُهُ أَنَا وَلَا أَهْلِي "
A man had a slave woman and her daughter, and he had children from both of them. He asked Sayyiduna Ali (may Allah be pleased with him), so he replied: "One verse makes it unlawful and one verse makes it lawful, but neither I nor my family do such a thing."
Hadith 2913
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: ذَكَرُوا عِنْدَ ابْنِ عَبَّاسٍ قَوْلَ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ: أَحَلَّتْهُمَا آيَةٌ وَحَرَّمَتْهُمَا آيَةٌ. فَقَالَ ابْنُ عَبَّاسٍ: «أَحَلَّتْهُمَا آيَةٌ وَحَرَّمَتْهُمَا أُخْرَى، إِنَّمَا يُحَرِّمُ عَلَيَّ قَرَابَتِي مِنْهُنَّ، وَلَا تُحَرِّمُ عَلَيَّ قَرَابَةُ بَعْضِهِنَّ مِنْ بَعْضٍ»
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: "One verse makes lawful and one verse makes unlawful, but kinship makes unlawful; their mutual kinship does not make unlawful."
Hadith 2914
حَدَّثَنَا سَعِيدٌ قَالَ: نا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَيُّوبَ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي مُلَيْكَةَ، أَنَّ رَجُلًا سَأَلَ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، قَالَ لَهَا: إِنَّ قِنَّةً قَدْ كَبِرَتْ - أَمَةٌ لَهُ كَانَ يَطَؤُهَا - وَلَهَا ابْنَةٌ، أَيَحِلُّ لِي أَنْ أَغْشَاهَا؟ قَالَتْ: «أَنْهَاكَ عَنْهَا وَمَنْ أَطَاعَنِي» قَالَ سَعِيدٌ: وَسَأَلْتُ سُفْيَانَ عَنْ حَدِيثِ مُطَرِّفٍ، عَنْ عَمَّارٍ، قَالَ: «يَحْرُمَ مِنَ الْإِمَاءِ مَا يَحْرُمُ مِنَ الْحَرَائِرِ إِلَّا الْعَدَدَ» . فَقَالَ مُطَرِّفٌ عَنْ أَبِي فُلَانٍ. فَقُلْتُ لَهُ: عَنْ أَبِي الْجَهْمِ، عَنْ أَبِي الْأَخْضَرِ، عَنْ عَمَّارٍ؟ . قَالَ: نَعَمْ
Sayyida Aisha (may Allah be pleased with her) was asked: A slave woman has grown old, she has a daughter, is it permissible to have relations with her? She replied: "I, and whoever follows my opinion, forbid it."
Hadith 2915
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَبْدِ الرَّحْمَنِ عَبْدُ اللَّهِ بْنُ يَزِيدَ، عَنْ مُوسَى بْنِ أَيُّوبَ الْغَافِقِيِّ، عَنْ عَمِّهِ، عَنْ عَلِيٍّ، رَضِيَ اللَّهُ عَنْهُ قَالَ: «يَحْرُمُ مِنَ الْإِمَاءِ مَا يَحْرُمُ مِنَ الْحَرَائِرِ إِلَّا الْعَدَدَ»
Sayyiduna Ali (may Allah be pleased with him) said: "The same prohibition applies to slave women as to free women, except in the matter of the waiting period (iddah)."
Hadith 2916
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، أنا مُغِيرَةُ، عَنِ الشَّعْبِيِّ، أَنَّ ابْنَ عَبَّاسٍ، سُئِلَ عَنِ الْأُخْتَيْنِ مِمَّا مَلَكَتِ الْيَمِينُ، فَقَالَ: «لَا أُحِلُّهُمَا وَلَا أُحَرِّمُهُمَا، أَحَلَّتْهُمَا آيَةٌ وَحَرَّمَتْهُمَا أُخْرَى» . فَبَلَغَ ابْنَ مَسْعُودٍ، فَقَالَ: «لَا تَجْمَعْهُمَا»
It was asked from Sayyiduna Ibn Abbas (may Allah be pleased with them both) about two sisters among slave women, so he said: "I do not declare them lawful nor unlawful; one verse made it lawful, another made it unlawful." When this news reached Ibn Mas'ud (may Allah be pleased with him), he said: "Do not combine them together."
Hadith 2917
حَدَّثَنَا سَعِيدٌ قَالَ: نَا الْأَحْوَصُ (1)، عَنْ طَارِقِ بْنِ عَبْدِ الرَّحْمَنِ الْبَجَلِيِّ، عَنْ قَيْسِ بْنِ أَبِي عَاصِمٍ (2)، قَالَ: قُلْتُ لِابْنِ عَبَّاسٍ: أَيَقَعُ الرَّجُلُ عَلَى الْجَارِيَةِ وَابْنَتِهَا تَكُونَانِ لَهُ مَمْلُوكَتَيْنِ ؟ قَالَ: « حَرَّمَتْهُمَا آيَةٌ وَأَحَلَّتْهُمَا آيَةٌ أُخْرَى، وَلَمْ أَكُنْ لِأَفْعَلَهُ » .
It was asked from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that if someone has a slave woman and her daughter, is it permissible to have intercourse with both? He replied: "One verse has made it forbidden, one verse has made it permissible, but I do not do so."
