Hadith 2882
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا شُعْبَةُ، عَنْ قَتَادَةَ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، عَنِ ابْنِ عَبَّاسٍ، قَالَ فِي الْحَرَامِ: «هِيَ يَمِينٌ»
Ibn Abbas (may Allah be pleased with them both) said: "Declaring something as forbidden is an oath."
Hadith 2883
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، وَعُبَيْدَةُ، عَنْ إِبْرَاهِيمَ، أَنَّهُمَا قَالَا فِي رَجُلٍ قَالَ لِأَمَتِهِ: هِيَ عَلَيَّ حَرَامٌ، قَالَا: «يَمِينٌ يُكَفِّرُهَا»
Hasan (may Allah have mercy on him) and ‘Ubaidah (may Allah have mercy on him) said: “Whoever says to his slave woman, ‘You are forbidden to me,’ then this is an oath for which expiation must be given.”
Hadith 2884
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا دَاوُدُ بْنُ أَبِي هِنْدَ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، قَالَ: «يَطَؤُهَا وَلَا شَيْءَ عَلَيْهِ»
Hazrat Masruq (may Allah have mercy on him) said: "He may have intercourse with his slave woman and nothing is obligatory upon him."
Hadith 2885
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا عُبَيْدَةُ، عَنْ إِبْرَاهِيمَ، وَجُوَيْبِرٌ، عَنِ الضَّحَّاكِ، أَنَّ حَفْصَةَ أُمَّ الْمُؤْمِنِينَ، زَارَتْ أَبَاهَا ذَاتَ يَوْمٍ وَكَانَ يَوْمَهَا، فَلَمَّا جَاءَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَلَمْ يَرَهَا فِي الْمَنْزِلِ، أَرْسَلَ إِلَى أَمَتِهِ مَارِيَةَ الْقِبْطِيَّةِ، فَأَصَابَ مِنْهَا فِي بَيْتِ حَفْصَةَ، وَجَاءَتْ حَفْصَةُ عَلَى تِلْكَ الْحَالِ، فَقَالَتْ: يَا رَسُولَ اللَّهِ، أَتَفْعَلُ هَذَا فِي بَيْتِي وَفِي يَوْمِي؟ قَالَ: «فَإِنَّهَا عَلَيَّ حَرَامٌ، وَلَا تُخْبِرِي بِذَاكَ أَحَدًا» . فَانْطَلَقَتْ إِلَى عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا فَأَخْبَرَتْهَا بِذَلِكَ، فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ: {يَا أَيُّهَا النَّبِيُّ لِمَ تُحَرِّمُ مَا أَحَلَّ اللَّهُ لَكَ} [التحريم: 1] إِلَى قَوْلِهِ: {وَصَالِحُ الْمُؤْمِنِينَ} [التحريم: 4]، فَأُمِرَ أَنْ يُكَفِّرَ عَنْ يَمِينِهِ، وَيُرَاجِعَ أَمَتَهُ "
The Messenger of Allah (peace and blessings be upon him) had intercourse with Lady Mariyah al-Qibtiyyah (may Allah be pleased with her) in the house of Lady Hafsah (may Allah be pleased with her) in her absence. When Lady Hafsah (may Allah be pleased with her) returned and expressed her displeasure, he (peace and blessings be upon him) said: "I have made her unlawful for myself, and do not tell anyone about this." Lady Hafsah (may Allah be pleased with her) informed Lady Aisha (may Allah be pleased with her), so Allah the Exalted revealed the verse: «يَا أَيُّهَا النَّبِيُّ لِمَ تُحَرِّمُ مَا أَحَلَّ اللَّهُ لَكَ». He (peace and blessings be upon him) was commanded to offer expiation and to return to his bondwoman.
Hadith 2886
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا دَاوُدُ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ حَلَفَ لِحَفْصَةَ أَنْ لَا يَقْرَبَ أَمَتَهُ قَالَ: «هِيَ عَلَيَّ حَرَامٌ»، فَنَزَلَتِ الْكَفَّارَةُ لِيَمِينِهِ، وَأُمِرَ أَنْ لَا يُحَرِّمَ مَا أَحَلَّ اللَّهُ لَهُ ".
Hazrat Masruq (may Allah have mercy on him) said: The Messenger of Allah (peace and blessings be upon him) swore an oath to Sayyida Hafsa (may Allah be pleased with her) that he would not have relations with his slave woman and said: "She is forbidden to me." Then the command of expiation was revealed and it was ordered that you should not make unlawful what Allah has made lawful.
Hadith 2887
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ زَكَرِيَّا بْنِ أَبِي زَائِدَةَ، عَنْ أَبِيهِ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدَ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، بِهَذَا الْحَدِيثِ
This same hadith is also narrated from Sayyiduna Masruq (may Allah have mercy on him) through another chain of transmission.
