Hadith 2831
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مَنْصُورٌ، عَنِ الْحَسَنِ، عَنْ زَيْدِ بْنِ ثَابِتٍ، أَنَّهُ قَالَ: «إِنِ اخْتَارَتْ نَفْسَهَا فَثَلَاثٌ، وَإِنِ اخْتَارَتْ زَوْجَهَا فَوَاحِدَةٌ وَهُوَ أَحَقُّ بِهَا»
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: "If a woman is given the choice regarding herself, then it is three divorces, and if she gives the choice to her husband, then it is one divorce and the husband has more right."
Hadith 2832
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، أَنَّهُ كَانَ يَقُولُ: «أَمْرُكِ بِيَدِكِ، وَاخْتَارِي هُمَا سَوَاءٌ، إِنِ اخْتَارَتْ نَفْسَهَا فَوَاحِدَةٌ وَهُوَ أَحَقُّ بِهَا، وَإِنِ اخْتَارَتْ زَوْجَهَا فَلَا شَيْءَ» .
Ibrahim (may Allah have mercy on him) said: "«امرك بيدك» (Your matter is in your own hand)" and "«اختاري» (Choose)" are both the same; if the woman chooses herself, then it is one divorce and the husband has more right, and if she chooses the husband, then nothing happens.
Hadith 2833
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا دَاوُدُ بْنُ أَبِي هِنْدَ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، أَنَّهُ كَانَ يَقُولُ ذَلِكَ أَيْضًا
A similar narration is also reported from Hazrat Masruq (may Allah have mercy on him).
Hadith 2834
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا ابْنُ أَبِي لَيْلَى، عَنِ الْحَكَمِ، أَنَّ عَلِيًّا، رَضِيَ اللَّهُ عَنْهُ كَانَ يَقُولُ: «إِذَا جَعَلَ الْأَمْرَ بِيَدِهَا، فَهُوَ بِيَدِهَا، فَمَا قَضَتْ فَهُوَ جَائِزٌ»
Sayyiduna Ali (may Allah be pleased with him) said: "When a man gives the matter into the woman's hand, then it is in her hand, and whatever decision she makes is permissible."
Hadith 2835
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، وَمَنْصُورٌ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ: «إِذَا جَعَلَ الرَّجُلُ أَمْرَ امْرَأَتِهِ بِيَدِهَا فَقَدْ بَانَتْ بِثَلَاثٍ»
Hasan (may Allah have mercy on him) said: "When a man gives his wife the matter (of divorce) into her own hands, then she is separated (divorced) with three divorces."
Hadith 2836
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو شِهَابٍ، عَنِ الْحَجَّاجِ بْنِ أَرْطَاةَ، عَنْ أَبِي جَعْفَرٍ، أَنَّهُ سُئِلَ عَنِ الْمُخَيَّرَةِ، قَالَ: «إِنِ اخْتَارَتْ زَوْجَهَا فَلَا شَيْءَ»
It is narrated from Hazrat Abu Ja'far (may Allah have mercy on him) that he was asked about the mukhayyara (a woman who is given the right of choice), so he said: "If the woman chooses her husband, then there is nothing (i.e., no effect)."
Hadith 2837
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّ رَجُلًا خَرَجَ مِنْ عِنْدِ أَهْلِهِ، وَهُوَ لَا يُنْكِرُ مِنْهُمْ شَيْئًا، فَوَجَدَ امْرَأَتَهُ فَقَالَتْ: لَوْ أَنَّ الَّذِي بِيَدِكَ مِنْ أَمْرِي بِيَدِي لَعَلِمْتُ كَيْفَ أَصْنَعُ، فَقَالَ الرَّجُلُ: فَنَعَمْ، فَنَعَمْ، فَارْتَفَعُوا إِلَى أَبِي مُوسَى الْأَشْعَرِيِّ فَأَخْبَرُوهُ بِقِصَّتِهِمْ، فَقَالَ أَبُو مُوسَى: ذَاكَ بِكَ، ذَاكَ بِكَ "
Hasan (may Allah have mercy on him) said: A man went to his wife and found no fault, so his wife said: "If the matter were in my hands, I would know what to do." The man said: "Yes." Then they went to Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him), and he said: "This matter has happened with you."
Hadith 2838
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو وَكِيعٍ، عَنِ الْهَزْهَازِ بْنِ مَيْزَنٍ، أَنَّ عَدِيَّ بْنَ فَرَسٍ خَيَّرَ امْرَأَتَهُ ثَلَاثًا كُلَّ ذَلِكَ تَخْتَارُهُ، فَرُفِعَ إِلَى عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ «فَفَرَّقَ بَيْنَهُمَا» . قَالَ سَعِيدٌ: فَرَسٌ جَدُّ وَكِيعٍ
It is narrated that 'Adi bin Firas gave his wife the option three times, and each time she chose the option. The matter was taken to Sayyiduna Ali (may Allah be pleased with him), so he separated the two.
Hadith 2839
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْحَجَّاجُ، عَنْ أَبِي جَعْفَرٍ، أَنَّ ابْنَ أَبِي عَتِيقٍ جَعَلَ أَمْرَ امْرَأَتِهِ بِيَدِهَا، فَطَلَّقَتْ نَفْسَهَا طَلَاقًا كَثِيرًا، فَسَأَلَ زَيْدَ بْنَ ثَابِتٍ فَقَالَ: «هِيَ وَاحِدَةٌ وَهُوَ أَحَقُّ بِهَا»
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: "This is one divorce and the husband has more right to take her back."
Hadith 2840
حَدَّثَنَا سَعِيدٌ قَالَ: نا يَحْيَى بْنُ سَعِيدٍ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ، عَنْ عَائِشَةَ، رَضِيَ اللَّهُ عَنْهَا أَنَّهَا زَوَّجَتْ بِنْتًا لِعَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرٍ يُقَالُ لَهَا: قُرَيْبَةُ فَزَوَّجَتْهَا مِنَ الْمُنْذِرِ بْنِ الزُّبَيْرِ فَقَدِمَ عَبْدُ الرَّحْمَنِ مِنْ غَيْبَتِهِ، فَوَجَدَ مِنْ ذَلِكَ وَقَالَ: «أَمْثِلِي يُفْتَاتُ عَلَيْهِ فِي بَنَاتِهِ؟» فَقَالَتْ عَائِشَةُ: أَعَنِ الْمُنْذِرِ بْنِ الزُّبَيْرِ تَرْغَبُ؟ لَنَجْعَلَنَّ أَمْرَهَا بِيَدِهِ، فَجَعَلَ الْمُنْذِرُ أَمْرَ بِنْتِ عَبْدِ الرَّحْمَنِ بِيَدِهِ فَلَمْ يَقُلْ عَبْدُ الرَّحْمَنِ فِي ذَلِكَ شَيْئًا، وَلَمْ يَرَوْا ذَلِكَ شَيْئًا "
Lady Aisha (may Allah be pleased with her) said: I arranged the marriage of Qareebah bint Abdur Rahman bin Abi Bakr to Mundhir bin Zubair. When Abdur Rahman returned, he was displeased. Lady Aisha (may Allah be pleased with her) said: Are you upset with Mundhir? We will leave the matter to him. Then the matter was handed over to Mundhir.
Hadith 2841
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ سَعِيدِ بْنِ يُوسُفَ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ، قَالَ: سُئِلَ الْقَاسِمُ بْنُ مُحَمَّدٍ عَنْ رَجُلٍ قَالَ لِامْرَأَتِهِ: أَمُرِكِ بِيَدِكِ، فَقَالَتْ: قَدْ حُرِّمْتُ عَلَيْكَ ثَلَاثَ مَرَّاتٍ قَالَ: «هِيَ تَطْلِيقَةٌ وَاحِدَةٌ»
Qasim bin Muhammad (may Allah have mercy on him) said: If a man gives his wife the choice, and she says, "You are forbidden to me three times," then one divorce will take place.
