Hadith 2774
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، قَالَ: أنا أَبُو حُرَّةَ، وَمَنْصُورٌ، عَنِ الْحَسَنِ، قَالَ: «إِذَا وَهَبَهَا لِأَهْلِهَا، فَقَبِلُوهَا فَهِيَ ثَلَاثٌ، وَإِنْ رَدُّوهَا فَوَاحِدَةٌ، وَهُوَ أَحَقُّ بِهَا»
Hasan (may Allah have mercy on him) said: If a man hands over his wife to her family and they accept her, then three divorces will take place, and if they return her, then one divorce will occur and the man will have more right to her.
Hadith 2775
حَدَّثَنَا هُشَيْمٌ، أنا مُطَرِّفٌ، عَنِ الْحَكَمِ، عَنْ يَحْيَى بْنِ الْجَزَّارِ، عَنْ عَلِيٍّ، رَضِيَ اللَّهُ عَنْهُ أَنَّهُ كَانَ يَقُولُ: «إِنْ قَبِلُوهَا فَهِيَ وَاحِدَةٌ بَائِنَةٌ، وَإِنْ رَدُّوهَا فَهِيَ وَاحِدَةٌ، وَهُوَ أَحَقُّ بِهَا»
Sayyiduna Ali (may Allah be pleased with him) said: If the household accepts, then it is one irrevocable divorce (ba’inah), and if they return it, then it will be one revocable divorce (raj’i), and the husband will have more right to her.
Hadith 2776
حَدَّثَنَا هُشَيْمٌ، أنا أَشْعَثُ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، عَنْ عَبْدِ اللَّهِ، قَالَ: «إِنْ قَبِلُوهَا فَوَاحِدَةٌ، وَإِنْ لَمْ يَقْبَلُوهَا فَلَا شَيْءَ»
It is narrated from Sayyiduna Abdullah (may Allah be pleased with him) that if the wife is accepted by the family members, then one divorce will take place, and if they do not accept her, then nothing will happen.
Hadith 2777
حَدَّثَنَا مُعْتَمِرُ بْنُ سُلَيْمَانَ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، قَالَ: " كَانَ يُقَالُ فِي الْمَوْهُوبَةِ لِأَهْلِهَا: تَطْلِيقَةٌ " قَالَ مَنْصُورٌ: بَلَغَنِي عَنِ ابْنِ مَسْعُودٍ أَنَّهُ كَانَ يَقُولُ: «إِنْ قَبِلُوهَا فَوَاحِدَةٌ، وَإِنْ لَمْ يَقْبَلُوهَا فَلَا شَيْءَ»
Ibrahim (may Allah have mercy on him) said: When the wife is handed over to her family, one divorce takes place. Sayyiduna Ibn Mas'ud (may Allah be pleased with him) said: If they accept, then one divorce; and if they do not accept, then nothing.
Hadith 2778
حَدَّثَنَا سَعِيدٌ، نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُبَيْدٍ الْكَلَاعِيِّ، عَنْ مَكْحُولٍ، قَالَ: «إِنْ قَبِلُوهَا فَهِيَ تَطْلِيقَةٌ، وَهُوَ أَمْلَكُ بِهَا، وَإِنْ لَمْ يَقْبَلُوهَا، فَلَا شَيْءَ» .
Hazrat Mak'hool (may Allah have mercy on him) said: If the household accepts, then one divorce will take place and the husband will have more right to her, and if they do not accept, then nothing will happen.
Hadith 2779
حَدَّثَنَا سَعِيدٌ، نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ عَبْدِ الْعَزِيزِ بْنِ عُبَيْدِ اللَّهِ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، مِثْلَ ذَلِكَ
It is narrated in the same manner from Hazrat Masruq (may Allah have mercy on him).
Hadith 2780
حَدَّثَنَا سَعِيدٌ، نا أَبُو عَوَانَةَ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، فِي الرَّجُلِ يَقُولُ لِامْرَأَتِهِ: قَدْ وَهَبْتُكِ لِأَهْلِكِ قَالَ: " كَانُوا يَقُولُونَ: هِيَ تَطْلِيقَةٌ، وَلَا يَدْرِي أَبَائِنَةٌ أَمْ يَمْلِكُ الرَّجْعَةَ "
It is narrated from Ibrahim (may Allah have mercy on him) that when a man says to his wife: "I have given you to your family," they used to say: This is one divorce, but it is not known whether it is irrevocable (bainah) or revocable (raj‘i).
