Hadith 2724
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يُونُسُ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عُمَرَ، «أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَرَدَّ ذَلِكَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ حَتَّى طَلَّقَهَا وَهِيَ طَاهِرٌ»
Sayyiduna Ibn Umar (may Allah be pleased with them both) divorced his wife while she was in her menstrual period. The Messenger of Allah (peace and blessings be upon him) rejected it, until he divorced her in a state of purity.
Hadith 2725
حَدَّثَنَا هُشَيْمٌ، أنا عُبَيْدَةُ، عَنْ إِبْرَاهِيمَ، قَالَ: «لَا تَعْتَدُّ تِلْكَ الْحَيْضَةَ»
Ibrahim (may Allah have mercy on him) said: This menstruation should not be counted in the waiting period (iddah).
Hadith 2726
حَدَّثَنَا هُشَيْمٌ، أنا يُونُسُ، عَنِ الْحَسَنِ، قَالَ: «إِنْ طَلَّقَهَا طَلْقَةً فَهُوَ أَحَقُّ بِرَجْعَتِهَا لَمْ تَعْتَدَّ بِهَا، وَإِنْ طَلَّقَهَا طَلَاقًا بَائِنًا اعْتَدَّتْ بِهَا»
Hasan (may Allah have mercy on him) said: If a revocable divorce is given, then there is the right of return and there is no waiting period (‘iddah); if an irrevocable divorce is given, then the waiting period (‘iddah) will be counted.
Hadith 2727
حَدَّثَنَا هُشَيْمٌ، أنا خَالِدٌ، عَنِ ابْنِ سِيرِينَ، أَنَّ ابْنَ عُمَرَ، طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً وَهِيَ حَائِضٌ فَذَكَرَ عُمَرُ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «مُرْهُ فَلْيُرَاجِعْهَا يَنْتَظِرُ بِهَا الطُّهْرَ» قَالَ: فَرَاجَعَهَا ابْنُ عُمَرَ لَيْسَ لَهُ فِيهَا حَاجَةٌ فَقُلْتُ لِابْنِ عُمَرَ: اعْتَدَدْتَ بِتِلْكَ التَّطْلِيقَةِ؟ قَالَ: فَمَهْ أَرَأَيْتَ إِنْ كُنْتُ عَجَزْتُ وَاسْتَحْمَقْتُ.
Hazrat Ibn Sirin (may Allah have mercy on him) narrates that Sayyiduna Ibn Umar (may Allah be pleased with them both) divorced his wife while she was in her menstrual period. Sayyiduna Umar (may Allah be pleased with him) informed the Prophet (peace and blessings be upon him), so he said: "Tell him to take her back, and when she becomes pure, then divorce her." Ibn Umar took her back. I asked: Was this divorce counted? He said: What if I made a mistake?
Hadith 2728
حَدَّثَنَا هُشَيْمٌ، أنا يُونُسُ، عَنِ ابْنِ سِيرِينَ، بِنَحْو مِمَّا ذَكَرَ خَالِدٌ إِلَّا أَنَّ أَحَدَهُمَا، زَعَمَ أَنَّ الَّذِي سَأَلَهُ: اعْتَدَدْتَ بِتِلْكَ التَّطْلِيقَةِ هُوَ يُونُسُ بْنُ جُبَيْرٍ
This narration is also reported on the authority of Yunus bin Jubair, may Allah have mercy on him.
Hadith 2729
حَدَّثَنَا هُشَيْمٌ، أنا لَيْثٌ، عَنِ الشَّعْبِيِّ، أَنَّ رَجُلًا جَاءَ إِلَى شُرَيْحٍ فَقَالَ: إِنَّهُ طَلَّقَ امْرَأَتَهُ ثَلَاثًا وَهِيَ حَائِضٌ، فَقَالَ شُرَيْحٌ: «أَخَلَطْتَ حَلَالًا بِحَرَامٍ وَخَبِيثًا بِطَيِّبٍ؟ أَمْهِلْهَا حَتَّى تَطْهُرَ ثُمَّ تَأْتَنِفَ حَيْضًا ثُمَّ لَا تَحِلُّ يَعْنِي لَكَ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ»
Hazrat Sha'bi (may Allah have mercy on him) narrates that a man came before Shurayh and said that he had given his wife three divorces during her menstrual period. Shurayh said: Have you mixed the lawful with the unlawful and the pure with the impure? Now let her become pure, then let her menstruate again, then she will not be lawful for you until she marries another husband.
Hadith 2730
حَدَّثَنَا حُدَيْجُ بْنُ مُعَاوِيَةَ، نا أَبُو إِسْحَاقَ، عَنْ عَبْدِ اللَّهِ بْنِ مَالِكٍ، عَنِ ابْنِ عُمَرَ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ، فَانْطَلَقَ عُمَرُ إِلَى رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: إِنَّ عَبْدَ اللَّهِ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «لَيْسَ ذَلِكَ بِشَيْءٍ»
Sayyiduna Ibn Umar (may Allah be pleased with them both) divorced his wife while she was in her menstrual period. Sayyiduna Umar (may Allah be pleased with him) mentioned this to the Prophet (peace and blessings be upon him), and he said: "This is not a divorce."
Hadith 2731
حَدَّثَنَا أَبُو مُعَاوِيَةَ، نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، قَالَ: «إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ وَهِيَ طَاهِرٌ اعْتَدَّتْ ثَلَاثَ حِيَضٍ سِوَى الْحَيْضَةِ الَّتِي طَهُرَتْ مِنْهَا»
Ibrahim (may Allah have mercy on him) said: If a woman is divorced in a state of purity, she will observe the waiting period of three menstrual cycles, and she will not count the menstruation from which she became pure.
