Hadith 2717
حَدَّثَنَا سَعِيدٌ نا هُشَيْمٌ، أنا يُونُسُ، عَنِ الْحَسَنِ، فِي الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ ثَلَاثًا ثُمَّ يَجْحَدُ قَالَ: «تُرَافِعُهُ إِلَى السُّلْطَانِ يَسْتَحْلِفُهُ»
Hasan (may Allah have mercy on him) said: If a man denies after giving three divorces, then the woman should go to the Sultan, and he should make him swear an oath.
Hadith 2718
حَدَّثَنَا هُشَيْمٌ، أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، أَنَّهُ قَالَ مِثْلَ ذَلِكَ قَالَ: «فَإِنْ حَلَفَ فَلْتَفْدِي مِنْهُ»
Ibrahim (may Allah have mercy on him) said that if a man swears an oath, then the woman may ransom herself and free herself.
Hadith 2719
حَدَّثَنَا هُشَيْمٌ، أنا دَاوُدُ بْنُ أَبِي هِنْدَ، عَنْ جَابِرِ بْنِ زَيْدٍ أَنَّهُ قَالَ: «هُمَا زَانِيَانِ مَا اصْطَحَبَا»
Hazrat Jabir bin Zaid (may Allah have mercy on him) said: As long as the two remain together, they are adulterers.
Hadith 2720
حَدَّثَنَا هُشَيْمٌ، أنا مُحَمَّدُ بْنُ سَالِمِ، عَنِ الشَّعْبِيِّ، أَنَّهُ سُئِلَ عَنْ رَجُلٍ، طَلَّقَ امْرَأَتَهُ ثَلَاثًا، فَكَانَ يَغْشَاهَا فَشَهِدَتْ عَلَيْهِ الشُّهُودُ أَنَّهُ طَلَّقَهَا وَكَانَ يَغْشَاهَا بَعْدَ الطَّلَاقِ، فَجَحَدَ شَهَادَتَهُمْ، فَقَالَ الشَّعْبِيُّ: «يُدْرَأُ عَنْهُ» يَعْنِي الْحَدَّ «بِجُحُودِهِ وَيُفَرَّقُ بَيْنَهُ وَبَيْنَ امْرَأَتِهِ»
When Imam Sha'bi (may Allah have mercy on him) was asked about a man who gave his wife three divorces and, after the divorce, still maintained relations with her, and witnesses testified against him, but he denied it, he said: The prescribed punishment (hadd) will be dropped from him, but separation from the wife will be enforced.
Hadith 2721
حَدَّثَنَا هُشَيْمٌ، أنا عَبْدُ الْمَلِكِ، عَنْ عَطَاءٍ، أَنَّهُ سُئِلَ عَنْ رَجُلٌ، حَلَفَ بِطَلَاقِ امْرَأَتِهِ أَنَّهُ دَفَعَ إِلَيْهَا دِرْهَمًا فَقَالَتْ: لَمْ تَدْفَعْ إِلَيَّ شَيْئًا قَالَ: «يُصَدَّقُ وَالْقَوْلُ قَوْلُهُ»
Hazrat Ata (may Allah have mercy on him) was asked that if a person swore an oath that if he had given a dirham to his wife, then divorce would take place. The wife denied it. He replied: Her statement will be considered valid; she will be regarded as truthful.
Hadith 2722
حَدَّثَنَا هُشَيْمٌ، أنا أَبُو إِسْحَاقَ الْكُوفِيُّ، عَنِ الشَّعْبِيِّ، أَنَّهُ سُئِلَ عَنْ رَجُلٍ، حَلَفَ لِرَجُلٍ كَانَ يَطْلُبُهُ بِمَالٍ أَنْ لَا تَغِيبَ لَهُ الشَّمْسُ حَتَّى يَدْفَعَ إِلَيْهِ مَالَهُ، فَإِنْ لَمْ يَفْعَلْ فَامْرَأَتُهُ طَالِقٌ ثَلَاثًا، فَغَابَتِ الشَّمْسُ فَزَعَمَ غَرِيمُهُ أَنَّهُ لَمْ يَدْفَعْ إِلَيْهِ شَيْئًا، فَقَالَتِ امْرَأَتُهُ: قَدْ طَلَّقَنِي قَالَ: «يُدَيِّنُ فِي امْرَأَةٍ وَبَيِّنَتُهُ عَلَى غَرِيمِهِ أَنَّهُ قَدْ دَفَعَ إِلَيْهِ حَقَّهُ، وَإِلَّا فَهُوَ ضَامِنٌ لِمَالِهِ حَتَّى يَدْفَعَهُ إِلَيْهِ» قَالَ هُشَيْمٌ: وَهُوَ الْقَوْلُ
Hazrat Sha'bi (may Allah have mercy on him) was asked: A person said to his debtor that if payment is not made before sunset, then his wife is thrice divorced. The sun set and the debtor refused. The wife said that she has been divorced. He replied: The wife's statement will be accepted in this case, but if proof of payment of the debt is provided, then he will be absolved; otherwise, the debt must be paid.
Hadith 2723
حَدَّثَنَا شَرِيكُ بْنُ عَبْدِ اللَّهِ، عَنِ ابْنِ وَبَرَةَ، عَنْ إِبْرَاهِيمَ، أَنَّ رَجُلًا كَانَ يَطْلُبُ رَجُلًا بِثَلَاثَ عَشَرَ دِرْهَمًا، أَوْ عَشَرَةِ دَارِهِمَ أَوْ نَحْوَهَا، فَقَالَ: إِنَّ لَمْ أَجِئْ بِهَا فَامْرَأَتُهُ طَالِقٌ ثَلَاثًا، فَجَاءَ بِهَا، وَفِيهَا دِرْهَمٌ زَيْفٌ، وَسَتَوقٌ فَقَالَ إِبْرَاهِيمُ: «مُرِ امْرَأَتَكَ أَنْ تَعْتَدَّ»
It is narrated from Ibrahim (may Allah have mercy on him) that a man made the divorce of his wife conditional upon the repayment of a debt, but among the payment there turned out to be a counterfeit dirham. He (Ibrahim) said: Instruct the wife to observe the waiting period (‘iddah).
